This is funny that you spent all this effort getting yourself into and out of this saga. Thank you for having the balls to tell us this story and inform us about some of the motor insurance industry pit falls. Sounds like some counselling might be needed after this saga. Next time a damsel in distress comes knocking, consult the pizza girl for advice or do a runner. There's a novell in this story, you should write it. Best regards Scott.

Before hiring an attorney, if I were the owner, I would file complaints with the state and federal agencies that regulate car insurance companies. The insurance company might decide to pay her if a government agency started looking into this case.

All the headaches she endured would have been handled by her insurance. This is a video that should be offered at every driver's ed class in school. She will have a strike on her insurability even with it sitting in her driveway. The bank has the title for x amount of years and she will still need to be insured for driving a beater.

oh man I HATE it when you do someone a favour then they bash you for it or try and rip you off. I did YOU a favour and YOU are dumping on ME? Sorry, no, I don't play that game. Just a month ago someone was dicking me around so I told them to take a hike, they knew they went too far so they offered to drive 3 1/2 hrs and pay me $700 in cash to apologize I said "nope, take your business elsewhere". When I worked for someone else I had to put up with it but now that I run my own place, NOPE.

@@ddemier Had 2014 Tiguan with a timing chain issue towed in. Customer gave us a "go ahead" by email after quote was given. Completed the work and was "ghosted" by customer for over 6 months (with promises to pick up/ "sent an EFT (which never came)"/ "can you leave it across the street and my employee will pick it up and pay for it". We finally placed a garage holders lien on it and came to find out that it had been purchaed in Ontario (we are in Alberta) and no payments on the loan had ever been paid. We worked a deal out with the bank and they seized it after luckily poaying our bill with storage!

My favorite as a shop owner is having 4 people at the same time a week or four before a holiday like Christmas say go ahead and fix my car. All 4 of the people were having major work done. One was a trans overhaul, one was a minor front collision, one was a head gasket, the other was Rear axle rebuild. I spent my money on parts on all 4 vehicles and had all 4 done in less than a week. and stored them for a month because they some how forgot it was almost Christmas and wanted money to buy gifts party etc. Huh, I kinda wanted to eat ..................... maybe be able to buy parts to fix the other cars still coming in for repairs. (sarcasm) the other cars did get repaired.

Actually, this was a very informative video, even if repairing cars wasn't involved. Your takeaways were crystal clear to me as they came up. What wasn't so obvious was the extent to which someone would "fight" to get their way. You sound as though your career has been extremely varied and at times, incredibly challenging. In any case, what this whole incident brought to light to me was a lesson that my Father tried to impress on me a number of years ago. He used to say that "the customer is always right. However, some customers are just not worth having." ...And your lawyer contact sounds like a "straight up guy" as well. He just elected to bail before he found himself getting stuck. As far as her asking you to compromise the integrity of your repair work and reputation, he also used to tell me that "good, clean oats will always command a fair price. Once they've been through the horse, they're then considerably cheaper."

I just hope this incident doesn't jade you from helping a person truly in need that would be appreciative beyond words in the future. I have been burned by trying to help people a few times too. At the end of the day, don’t buy a car you can’t afford and make sure you have insurance. If you don’t, make sure you can hire a lawyer. If she can afford a lawyer right now, boom, she can get her car fixed.

I’ve felt your pain as a fellow Collision shop owner for over 35 years, familiar story helping people out who don’t deserve 5 minutes of your time. Glad I sold out to a developer and now I go by and the once proudly owned shop is now a very large car wash. I still miss it but not all the scammers including the insurance company scammers as well.

You're a stand-up guy. I've been in the repair business myself for 13 years, high end computers though, not cars, but this stuff happens once in a blue moon. Great video, Scott. I thought you might address the previous damage and how the dealer who sold her the car might be liable because he represented the car as not having been in an accident but it had been. But, I'm guessing there was nothing dishonest that dealer did and it was incumbent upon her to get the car inspected for previous damage prior to her purchasing it, which would be another good lesson from this.

Moral of the story: we’ve become a society who lives beyond our financial needs, all for the sake of giving the perception that we are doing better than we really are. But in reality, we usually do not have two nickels to rub together. I’m sure the idea of her buying $1000 basic transportation beater was beneath her. I sure wish I lived closer to you! I gladly purchase a vehicle from you! Thank you for all you do! When I was in my early college years, I was gonna switch to a tech school for auto body and paint but was talked out of it! Sadly I listened! I’m still a painter now for a big ten University that does the spraying of doors and jambs, all the lacquered doors and trim, and conversion varnish on the cabinets! Luckily I get to have my own shop with a spray booth! Deep down I’d love to do what you do!

I'm only three mins in and some change and every second I hear more and more of this story, I keep thinking if I were to do these jobs, I would not take a unit that someone else has been at before. Could be a red flag for a pissy owner/client. I don't own a shop or body repair business, but I wonder if it would be good general advice on dealing with people and choosing whom not to with. Especially if they have one f the entitled owner cars. Like Lexus, BMW, Tesla etc. The brands speak for themselves. Strangely enough, Toyota might be the polar opposite. Despite the relation to Lexus, it's the owner, not the parent company. Continuing to watch now, have a feeling I'll really enjoy this. Hope you can recoup some of what you put into it.

You know what? I liked this A LOT! Partly because it's kind of a little more reveal on how you do business, and also part of how you are on the other social sites. I think I can add some takeaways you missed. Granted I have not yet been through the 800 comments to see yet. But also you can count your negotiating skills at the yard. And just your sheer strength if I needed you to defend us in fisticuffs. If you were willing to do that and I was that lady I would have immediately given you a hug. Another takeaway is I've been burnt this way too many times already and I'm tired. Burnt out on helping. I suggest you don't help people of people you know or have relationships with anymore. Or even stop helping people in a bind like this at the get go. After she wasn't going to pay your $200, I would have said now she has two options. Pay me what you would have paid them or lose the car to them for storage. $10,000 for storage, and tow/tolls/fuel. And time spent on estimates to let her negotiate written estimates with insurance. Which I would have written "not for insurance purposes" on it or watermarked under it all. Plus pay the lawyer for his pro bono time. Or pay you what you think she could have paid, maybe $500 for some time and a true tow rate. Another reason I liked this? I bet it was really therapeutic for you. In a different way than working out. If you can make it as good as this, feel free to keep it up. But I request most of the content to be about the stuff before this. Straight repairs and witty banter.

In cases like this you do NOT sue the insurance company. In Illinois the minimum coverage for car insurance is 20k. So that is why they were offering that as that is all the insurance it had. You sue the person driving the car and the owner, if not the driver. That only works if they have assets. If they are broke then they are whats called judgement proof. But moral of the story, pay your car insurance and make sure you have he un/under insured part added as well.

She had the best setup to succeed once you got involved, too bad she didn't realize that. I'm sure that not having money to cover her mistakes makes it a bitter pill for her to swallow... butdefinitely a good lesson of what not to do. Great story Scott and different lessons and advice from your usual repair videos, but still relevant. It sounds to me like the lady found herself in such a corner with no driveable car and not enough money to get hers fixed that she lost the ability to see the things that other people were helping her out with. No excuse, but maybe selfishness borne out of desperation. Can't help wondering if there will be a 'part 2' to this story in 12 months when the car needs to be gone from the driveway...

Scott that story was very interesting and well delivered. I couldn’t relay that without getting animated and agitated. My son can vouch for how I am when the right buttons are pushed. It’s amazing how nervy some people are when it’s costing you time and money but when you look for compensation it’s line you were trying to steal from them. She seems like hf she comes into money would show up again and pretend it never happened and expect the same price regardless of price increases over time. This car is losing value while it sits so she’s up that creek and drifting without that paddle.

This was an awesome instructional video on how Insurance and body shop will rip you off. Thanks so much for posting this. Also it shows how people are too stupid for the credit money they are given.

Excellent and interesting vlog Scott, you and your lawyer friends certainly know your subject, you were extremely helpful and patient, same as myself, but their comes a point where you just have to say to that person “go and do one” best regards and take care Mark from the U.K. 🇬🇧

I could not agree more, Scott. Being a small business owner myself (but in IT), I have also run into many people who want an Aventador for Corolla money and want all information transferred from their old machine, all programs installed and the machine brought onsite and set up as part of "my service" - like my time, patience and knowledge is worth little and far below their level of need. It's like they think new computers just appear and get put on their desk like what happens in the ivory towers they work in and because they do not see the work that goes on behind the scenes - matching the user's need up with the right processor grunt, enough RAM and hard drive space so the machine won't lag, a video card to suit their gaming / CAD / video editing needs and a screen that shows it in the level of detail required - they believe it all happens by magic and that we just "know". Knowledge is gained through experience and experience takes time and effort to gain and keep up with. Quotes take time, invoices take time, job records take time, driving to and from site takes time, couriers cost money, arguing with them about the damn bill costs time AND money.....and it all adds up and like your good self, I am reasonable, honest to a fault, hate seeing people ripped off and will go several extra miles for someone I believe has landed in a pile of crap that they don't deserve or that I feel sorry for and want to help. However, push that envelope for all it's worth, then act like I was the one who caused their original problem and try to make it MY problem to resolve....and I will dig my toes in and lay it all out for them and won't budge. My good nature doesn't like being taken advantage of and there is only so far I will let them push. I've told several clients where to take their business (well, I have told them where I think they can put it and it is up to them whether they consider this is anatomically possible or not) because simply put, they are more costly to me than clients that call and tell me they want something, I give them a price, they say yes, I install it, they pay the bill and everyone is happy. I don't need to be on the phone arguing with them when they get the bill, wanting me to reduce my hourly rate or deduct several hours' work from the bill because THEY don't think it is worth it, when they know my hourly rate (about 60% of what others charge) and were given an estimate before the work started that was actually larger than the eventual invoice total they received. Funny how us good blokes get taken for idiots by those who think we have nothing better to do with our time (or nothing else on our schedule) except to behave like a charity and cater to every whim they have. Unfortunately, it is getting worse and worse and is a global phenomenon. They really grind my gears, but it doesn't stop me being who I am though - especially not to people who appreciate the extra effort I put in and lengths I go to in order to give them a good deal on something. she should have just taken the 20 grand payout and then sold the car on the rebuilder market for the difference still owed....would have probably made money on it

Unfortunately, if she took the $20k from insurance for total payout, the insurance company owns and takes the car. She doesn't get to sell it.

she is under no obligation to give her car up, she can take the 20k to repair the damage and then sell the damaged car. I did this and made alot of money rather than keep the wrecked car. @@BSGSV

exactly, she can take the 20 to repair and put on the loan, then sell the car for 18 on the rebuild market to pay off the rest and walk away learning a few things maybe. whe wont be whole but alot better off than paying 1000 a month for a wrecked car she cant drive. @@briangray5921

I have to say your patience surprised me just seeing your videos I would have bet it would end way sooner. I was just pushed over the edge with a guy that I told to go somewhere else because they would save him 10 grand and he thought I would eat the difference because we were friends he was wrong, if you get good advise and don't take it you will have to pay. 20 years of friendship done.

This was a sad frustrating story. I don't understand why she wouldn't try to get a $1000K car to have something to limp along with until her Lexus fiasco could be fixed. I paid $200 for a 40 mile tow with my GMC Sierra when I suffered a head gasket failure. So yeah that was a deal with the 100 mile tow.

Doubt if she had $1000 to scrape together. Even if she did, she doesn't sound like the type of person to drive a $1000 car. Even being that desperate. She needs a white knight to come in and save her from herself😂

I owned a few auto repair shops in SoCal --- Lawyerland to you - and after an engine replacement, I got sued to the rear brakes failing. The judge told me I was "the last professional in charge of the vehicle --- pay to plaintiff for their damages". I hear ya Scott --- run away from these kinda jobs --- once you feel any sideways motion, it's gonna get worse!

Thanks for sharing, It sounds like the customer was just angry and frustarted about the entire suituation, rightfully so, but was mis placing the anger and frustration towards the wrong people. I do hope she can get things worked out.

Air bags, please don't turn this channel into the Scotty Kilmer channel where everything is a big conspiracy designed to keep the little man down and Kilmer is the only person that has figured that out. Nope, the reason to pop all of the bags is to prevent a law suit if someone was in place and a bag didn't go off. Remember, the time window for a bag to pop in time to save a passenger is very short. The air bag computer would need to assess all inputs then fire the appropriate bags, this could lead to a delay. Computers are not instant, I've worked in industry with PLC ( Programmable Logic Controllers ) and have run into instances where the mechanical operations out run the processing power / speed of the computer leading to issues that are sometimes random. So, the choice is to build an air bag system that works 100% of the time by firing all, or do extensive software testing that might uncover a program / hardware bug still possibly be sued for " defective product "

Great story, I would think that whoever financed would have back up insurance, so if she doesn't pay her insurance, they (Car Finance Co.) wouldn't be out what was owed on the car.

Toyota financial does, I told her to call them but they were not interested in doing anything because she was still paying for the car. They don’t care until she stops making her payments, then they will use their insurance to protect themselves, she will get nothing.

No feebies is my motto... I am a PDR tech.. Girls comes with a hail damaged Camaro..(friend of my daughter) I give her an estimate & she files a claim .. (She said) The damage was minor as hail damage goes , but it was $3100.. She calls me while she's on vacation & tells me the check came & could I fix it so she will have a car for work when she gets home. I have my guys fix it.. She gets home & tells me a b.s. story about the cheque. I call her insurance h they tell me she only had liability .. Now she comes to my shop screaming that she wants her car ! I say , fine . Pay the $3100 ! So a few wks later a tow truck comes to get the car .. Turns out she bought the car at a "buy here pay here" lot & they're reposessing it.. I say fine, pay $3100. Now I get a lawyer threatening me.. I contact my lawyer.. I had to file a shop lean on her car .. Cost me more money. Then the car lot reports the car stolen & where its located.. Cops come , I tell them the story. Meanwhile , its taking up space I dont have. Months go by & the girl calls me & wants to "work it out". She pays me half the $ owed , I let her have the car because she has two young kids & one on the way.. A wk later , the lot she bought it from comes at 3 a.m. & repo's it. Now I get a letter from her lawyer saying I owe her for all the money she paid in payments because I would'nt release her car (after she paid me in full) & she had to buy another car to get to work & ..... My lawyer did his thing , case dropped... So ...I paid my guys $2100 to fix the car , I paid $300 for new moldings , and my lawyer $1000 . So Im out $1850... The best policy is , dont do any favors.

You can bet she never would have gotten that car until I had full payment. Luckily, if I did have to put a lien on it, Toyota financial would have paid whatever I was owed, or just left me the car. Either way, I would have gotten paid, better if they left the car!
