This is what I think, they got into a fight, (it takes two to fight) and he ends up getting hurt badly so I feel like the thug should have to pay for it because he hurt him badly regardless if he hit you or not. .he didn't hurt you badly like you did him so therefore the thug would have to pay the damages.
