She never got her fox tattoo because she refused to pay anymore money than she already had already paid for a new design that wasn’t what was agreed upon. She liked (what she thought) was the artist’s work, and had a friend who said they had a good experience with the artist, so she was initially willing to spend the money for what should have been and what she thought would be a one time design fee for a tattoo she thought she’d love forever. When that changed, and when the artist started making other demands that screamed scam, the fox tattoo woman refused to go further, refused to spend more money, and stopped all communication with the artist, and considered the money she already spent to be a loss. She then went on TikTok to warn others about the artist’s tactics. Nobody is perfect. Nobody sees things exactly how they are in the moment 100% of the time. There is a reason the phrase “hindsight is 20/20” exists. And there is also a reason why there is a well documented and well studied psychological phenomena of the “sunk cost fallacy” that explains exactly why people fall victim to these types of schemes when they otherwise wouldn’t. Scammers like the tattoo artist are not only aware of this, but exploit it and take advantage of it KNOWING they have put their victim in a vulnerable situation. Nobody deserves to be manipulated, scammed or exploited. Period. It’s the scammer that caused this situation with dishonest and exploitative tactics, and the scammer alone.

@@who__cares__we all have different learning paces, right? You’re probably thinking “yeah, and? who cares lady, irrelevant”. But it is relevant. She learned a few things from this situation: 1) She learned the proper pre-tattoo routine. She knows what is normally expected of the client and of the artist. She admittedly knew nothing. 2) how to stick up for herself when she feels uncomfortable and when something is off. To people who have been bullied, abused, weren’t sheltered, or were just plain unlucky, they learned that lesson as a child or in early adulthood. Some people genuinely NEVER learn to stand up for themselves and are a doormat until the day they die. At least she learned the lesson. Have some perspective and compassion. Makes the world a better place.

What the tattoo artist should realize is that ALL the clients who were/felt scammed will be coming out of the woodwork to testify against her. Also, if she loses in court, it will definitely destroy any credibility she may have. She should evaluate her business practices before she has no business at all

Just graduated from law school, but I wish I had my license already because I'd take this case - 100% Whoever takes it will probably get this whole thing struck down as a SLAPP case fairly quickly.

We have to write the bar exams, the same as in the states, but we also have to do 8-12 months of supervised work experience before we can be licensed by the provincial bar association. So, even though I wrote (and passed - woot!) the bar exams in June, the earliest that I can get called to the bar is June of 2024.

I hope so but I’m not sure. There best defence seems that it’s the truth and therefore not defamation. Technically she has damaged her reputation but I’d argue fairly. Otherwise leaving any negative review would be defamation. You can’t be defamed by the truth.

@@patsysadowski1546 All true, but I just hope that it doesn't get to the point where a defence is needed. Shoot, I hope it doesn't even get to the point of an anti-SLAPP motion. It can cost BIG money to get through the anti-SLAPP motion, nevermind a full-blown trial (we're talking well over the $10,000 mark, up to hundreds of thousands in lengthy and complex court cases). Plus, our courts are still backlogged from the pandemic, so a case would take forever to wind its way through the system. Best-case scenario: the lawyers work it out before it goes any further than the cease and desist letter.

Depends on the state of the lawsuit, as anti-slapp legislation differs a lot per state no? Still, even with that, she should lose a defamation lawsuit, they’re notoriously hard to prove/win.

If I were this lady's lawyer, I would file to have the case dismissed as a slapp suit. Canada and Ontario do have anti slapp laws, and it really does seem like what this is. Not legal advice. Just layman's understanding of both situation and our legal code.

Bc what would her defense be? She can claim that she offered a luxury service, and now an unhappy customer is complaining. Fine. But the amount of nickeling and diming, the clear pattern of not performing to customer expectations (which can happen to any business), but with the goal of driving up prices, over a pattern of several clients, is what’s gonna do her in. No one will see past that. Once, fine. But several to the point that your own mentor denounced your practice as predatory? Gonna be hard to fight that. Something similar happened locally, a woman went to a hairdresser. The hairdresser messed up her hair. Women went to a Facebook group to complain. Hairdresser sued her for defamation. Judge held that the customer’s hair did get ruined, and even if it didn’t, it’s her 1st amendment right to complain about her experience in public and implicate the person who caused it. Hairdresser lost the case and had to pay back attorney fees

I don’t think Lindsay understands how this will turn out. A)She wins, but now people will be apprehensive to approach her business because of not only the paymwnt methods, but now because they could get sued for talking about their Tattoos and their experience with her Or B) She wastes her money fighting a lawsuit that will not go in her favor and she shows the world how petty she is. Win or lose (I definitely think she has no chance in hell in winning) she looks awful here.

@@ronaldoago-go5907 probably both. I decided to check if there is an explicit law against charging more after a client has already paid and there is. It’s a civil complaint, but breaking that law can incur a fine of up to $750,000. She’s angry her customers went public, because the consumer protection agency in Canada might get word and take action against her. I have no idea why the cops advised someone they still have to pay-they literally forced someone to take part in a scam against them? If it was possible to hold the police accountable, that could be considered extortion.

I also imagine she could make a case with the FTC against the tattoo artist for sharing her personal information willy nilly like that. It’s violently illegal to violate a consumer’s privacy in that manner, she did not consent to her personal information being passed around like candy.

In the US the burden of proof is on the person suing. She’ll have to be able to prove that the tiktoker knew she was lying and lied specially to cause harm. Defamation is incredibly hard to prove, legally speaking. Not gonna happen.

It absolutely IS a scam. She produced a sketch that I have no doubt she KNEW was not what the customer wanted, in what i truly believe was an attempt to force her into buying the next package for "revisions". She also told the bird customer LAST MINUTE that she wasn't able to do her tattoo, while refusing a refund for her OWN denial.

Thing is, while it can be debatable if it's a scam from one angle, it DEFINITELY is from another. It's debatable from the pricing side of it because, as you said, she was up front with the prices that she chose to pay, so it's her fault for not knowing better or doing research or "not making herself clear the first time", right? However; it IS a scam if you pay for an original sketch to be made, under the specific guise it's original, only for it to be just a re-trace of another persons work. And it gets even worse if you have to pay for retraces multiple times because "you didnt make it clear enough", so you pay even more for the same retrace to be done but with only more of it traced or other art traced with it. She could most definitely win the case from that angle as long as she provides evidence, and helpful to ask help from others the woman scammed to give their testimonies and/or evidence from their encounter with her re-traced tattoos

Adding on prices after the fact is not only a scam, I’m pretty sure it’s illegal. The only reason the tattoo artist isn’t in legal trouble is that scams aren’t held to the same standards as other crimes (involving stealing, anyway).

I about lost it with laughter just imagining this going to court. Stupid… and it all could’ve been avoided, but no, she had to be greedy. Make an actual name for yourself and then sure, spike up the price if you’re really worth something by then. She should’ve just dealt with the big L and moved on with some reasonable prices.

I have a fairly large tattoo on my back, nice set of wings. It's an original design that took HOURS for my tattoo guy to draw. And he didn't charge me anything at all for those hours. Got an excellent price on it, it still looks great after 13 years, and I absolutely LOVE it.

I mean, you do pay for the design but that's part of the tattoo cost. I've known several tattoo artists in different shops and different cities in my 45 years and I have never once heard of any charging a fee up front simply to design it because that's literally part of what creating a tattoo has always been. And if you actually listen to your client, you don't have to spend hours on one design only to trash it completely and start from scratch- you create something like you think they want and together decide on any adjustments or changes to the design.

I'm not sure about proving the timeline of her tattoo, but this "tattoo artist" literally doxxed her. If she has screenshots or one of the other tattoo artists is willing to testify that she shared a client's private information, wouldn't she be in trouble?

I’m 30 minutes from this artist, with a change of fee structure and a little bit of silence on social media this totally would have blown over by the end of the year and she could have continued to have a career that paid the bills. They’re are way worse artists in practice, in terms of artistic skill level, where I am that I know people go to. I certainly wouldn’t have forgotten, she’s on my blacklist note with the ones that shared the drivers license and those less than stellar artists I’ve encountered work from👀, but so many new and even returning clients who happened to be satisfied would totally have continued to go to her. Not everyone is tied into the tattoo world, not everyone’s on tiktok, I only heard about it because I follow a few tattoo youtubers that I heard it from, and that’s only because I’m interested in the art beyond just having it on my body, most people with tattoos aren’t. People forget, the internet’s memory is short, but they’re certainly not going to as quickly forget an artists trying to sue to past clients. I will say, it seems like the artist deserves what’s hopefully coming and came for her👀

I appreciate that you spoke out about the tattoo artists that shared the drivers license. They didn’t receive ENOUGH backlash in my opinion. People are crazy, you don’t just casually share personal information like that so freely. As professionals (hell, as people) you think they’d know this. And I feel like most of them did know it and still shared her license out of spite which is even worse.

The burden of proof lies with the tattoo artist - she has to prove defamation which is not easy to prove bc not only do they have to prove defamation - they have to prove that it was malicious (i.e. intentionally tried to lie to hurt her financially) basically - it's a waste of money and she'd lose - she's just doing what all social media influencers do - sending an empty threat by a c&d.

People forget about this stuff..seriously, even I forgot this was a situation. The tattoo industry is so small, especially in more suburban/rural areas so even if no one said anything on tik tok if enough people have issues word of mouth about the alleged shady business practices would be enough for her business to be affected. That’s how a lot of artists build their portfolio/business by word of mouth. I’m sure this isn’t the first time she pulled this and I’m sure it’s not the last. Don’t want your business to take a hit? Behave ethically and do good enough work and listen to your clients.

As far as I remember, I don’t think she said the word “scammed”, though I think she actually was, and I don’t remember her saying anything about police complaints? In defamation it is up to the complainant to prove the statements are not true, so she’s blowing smoke. Her statements were all true, so come on Lindsay prove it’s not true… Also she cannot be liable for the reuploads other people have made. That lawyer is a quack.

Where I live the clients can't be hold accountable- all tattoo artists here have to be very clear and upfront with the prices - before they even start doing the work. If they conducted business like this here, the artist could be taken to court bc of this extra stuff being put on.

In terms of scamming, the fact that the art is stolen from the internet is proof enough that it is a scam. Just because they knew what it cost doesnt mean they got what they paid for. Additionally, there is also the fact that Industry Standard is used when discussing if a vlient is being taken advantage of. And nothing about this proceedure was industry standard. Lawyer would be "is it industry standard to charge thousands of dollars for an unoriginal piece of artwork taken from the internet?" And boom she loses.

Hi Markie...I am in Ontario and have access to the full list of court cases in all of Ontario. Peterborough and Lucid Tattoos are also in Ontario. No lawsuits have been filed. She got a cease and desist letter and doesn't know the law. I just searched the entire database for the lawsuit in question and it legit has 0. I searched under her first and last name as well as the business name and there's not one civil case that has Lucid Tattoos listed or Lindsay Joseph. If you need to see the proof, let me know how to get that to you. I just don't want you to be spreading misinformation.

I don't see that going well for the artist. Fox Lady just explained what actually happened, and anyone can come to the conclusion those actions were a scam. I think once a judge hears what happened, I think they'll come to the same conclusion

So because she told the truth about her experience it’s not legally defamatory statements. Also even though she says scam she literally explains how it was laid out so she says that this is what she offered so even there she is safe. If that “tattoo artist” wants to sue her, let her. She will loose and be stuck with a huge lawyer bill. But she just needs to make sure she counter sued for lost wages, cost incurred while defending herself, and legal fees. That way when the judge rules in her favor they will make this artist pay for her legal fees as well. My degree is in law. This is a clear case.

What so many people seem to not understand about what ends up being just slap suits is that defamation, libel and slander have to be knowingly false statements made about you or your business and you have to prove actuarial loss of some kind. If the statements made were true or even the person saying them believed them to be true the case doesnt go forward. Its very difficult to prove someone knowingly falsified info about you and represented it as fact. Most internet lawsuits fail to even make it to the filing stage as they usually are just a cease and desist which is non binding. The very fact that the fox lady went into so much depth about the experience rather than making a blanket statement is going to make this fall apart most likely. As long as the statements were true to the best of her knowledge using the term scam will likely be seen as her interpretation of what these event mean. Besides that it was mostly others opinions that those events equaled up to the threshold of scam. So whether it was a defined scam or not likely doesnt matter. So long as the facts around the retelling of the actions the tattoo person did were not purposely falsified its fine to attach the word scam most likely and on top of that fox ladt didnt come right out an say it was a scam. People came to that opinion from the retelling of the actions tattoo lady did and her pricing scheme etc

I don't think the tattoo artist stands a chance in court. Especially if it can be shown that she was stealing and tracing artwork when she is telling clients that they are custom pieces and even if she is "upfront" with the cost of the tattoos if she is wasting time that the client is paying for causing them to book additional appointments incurring additional costs seems quite scammy. Also, I'm not a legal expert but I'm fairly certain the burden of proof for defamation will be on the artist to prove that they intentionally and maliciously misrepresented the truth to harm her and her business. What basically equates to a negative review I don't think would be provably defamation.

I can see the tattoo scammer losing on some points at least because for example legally if you charge a daily charge for your work and don't specify a specific number of hours the law will revert to what most people expect and that would be a lot more hours than she received from the scammer.

So with American defamation lawsuits, it's up to the claimant to prove that the statements were false, not the defendant to prove they were true. She would have to prove that she didn't scam. The legal definition of a scam under American law is: the intentional use of deceit or some kind of dishonest means to deprive another of their money, property, or legal right. Even proving that will be difficult without solid evidence that she outlined, every step of the way, how much things cost and why. Furthermore, she'd have to prove it was the defendant's video and not anyone else's, including commentators who used the video as a jumping off point and other clients who came forward, caused the damages. The fun thing is that if she does take this to court and fails to prove that she didn't scam people, that could open her up to getting sued by everyone she scammed, since they could then argue the verdict from this case (assuming she fails) as a legal precedent. It's a REALLY bad idea for her to pursue this, but gosh I'd love to see some justice for wrongdoings.

Defamation lawsuits are the hardest ones to prove in court. Ain’t no way that scam artist wins. There is way too much actually proof of what she did. She’s literally shooting herself in the foot here, and I for one, am thrilled. 😂😂😂

Could be a bit of a bluff - posing a threat to someone. They may think they won't need to follow through on an actual lawsuit. It could end up making things worse for the tattoo artist. Making it even more public.

Is not defamation if the ex clients didn’t even said her name in videos. The internet did their homework and found out who she was. So the tattoo girl has to prove they said her name. If anything she will be found guilty for doxxing the other client and showing her ID. Defamation lawsuit are hard to be proven true.

My first tattoo was estimated at $160, ended up only paying half that because it was a simple tattoo and was pretty easy to do. However, I have never heard of any tattoo artist increasing the price AFTER you're on the table, at least, not without discussing it prior. (As in; While this is what it's likely to cost, if it turns out to be more complicated, it may cost a little more, but nothing over xxx. Is that okay?) And even then, I'm pretty sure it doesn't happen.

It is a scam though; the price quoted was never firm. She waited till her clients were already in shop and having work done to change the price and then threatens them with police if the try to refuse to pay. That _is_ a scam mixed with extortion.

On your last video about this, I linked the Better Business Bureau page where the owner (I assume it is Lindsay Joseph of Lucid Tattoos in Cambridge, Ontario, Canada and not a random worker) goes back and forth with the customers but because it was an actual link my comment was deleted. I didn't know it would be deleted but i just wanted to update the community since it looks like Fox lady complained to them. And she and the owner kept going back and forth. It was frustrating to read that one and the old one because both of customers say that there was a certain price or service both parties agreed upon. Then when there was something broken or changed that was not agreed upon (price hike, change in date, etc) so the customer goes back and forth with them but then Lindsay stops responding. The most frustrating part is the end where she says something along the lines of, clearly they're lying first they say I always responded but then later in the complaint says I don't respond at all and then closes the complaint. It's such bad faith argument and a scummy skeevy tactic. Clearly the customers said she was responsive to their complaints up to a point then she stopped and there still hasn't been a resolution like a refund or even a change in her website -- oh my god, I checked her website like 2 weeks ago (mind you, this drama was around May) and up until then she still didn't have anywhere in her FAQ or other pages about the "optional" design fee, how that's tiered, and not refundable. At some point, she knows purposefully hiding these fees and she's not giving a way to remedy the situation (legitimate complaints on review sites because she takes those down, refunds, arbitration, just not doing the scummy practice) so if I were them, I would be suing her. And if I were them I would also point to the fact that her mentor Russ also threw Lindsay under the bus.
