I agree! They should not be able to use dogs or any animal at all! It's a terrible life for a dog, LE are often not kind to them. It's taking a shortcut & it's cheating imo.

Qualified immunity has nothing to do with dogs. It would of the Supreme Court ruled that dogs were not probable cause and the officer did it anyway. Then qualified immunity would be invalid. They get the best food, constant attention, theyre always very well trained, and most officers that get K9's have families and theyre very well socialized with kids. When they retire the last K9 officer will usually keep them personally. My dad was a K9 cop and we kept multiple dogs for their whole life and they were no different than being our normal dog, except they got to go to work with their owner everyday and spend all day in the car with them. My dads dogs werent drug dogs tho, they were actual K9 units where they would back my dad up on a stop if ever the need arose. The law enforcement slush fund (the civil forfeiture monies) is over 5 Billion now. That is "off the books" monies that can be used by agencies for whatever they want... mostly to increase the militarization of the police departments meant to serve and protect (we are not foreign combatants!) And used to continue to fund new task forces and schemes to gain even more in civil forfeiture! (Look up project/ operation runway... where police officers not even in the jurisdiction of the airports can go "fishing" for monies as passengers are literally in the final walkway boarding a plane. Saying they are part of TSA, or that it is a random "final check before boarding!) The laws protecting criminals are much harder, so, like any other unethical and immoral predator, they go after the "easy money" (Look into criminal asset forfeiture versus civil asset forfeiture.) I'm so glad for the institute for justice taking on the government about this outrageous atrocity against our own citizens.

I once had a CHP & Border Patrol order me to "break the seal, unlock & open the doors on my refrigerated trailer so the dog can search inside." "Respectfull, I will not violate Federal law, my companies security policies & my civil rights. You must A) sign the sealed BOL envelope with your name, badge #, and state reason & necessity for breaking the seal. B) Call the 800 # 1st. C) This is a load of fresh beef & iced fresh chicken, & your dog will not enter the trailer. Your dog's nose will explode from all the delicious aromas, giving a false positive. f you have probable cause, you can get a search warrant, relocate the trailer to a refrigerated facility, and unload it to search. D) The company will immediately contact Federal Marshal's to intervene. "No sir, that is a warning, not a threat. FYI: The company already knows I'm stopped, my location, & I advised them I thought you would attempt to open trailer as I observed done on trucks ahead of me. E) This load delivers to Haward CA, is for Hawaiian Express, if not there on time to put on ship, a $50K fine, & you now own all the product & the fines. Please do your job, but be aware that now informed, you will lose your implied immunity for violating Federal laws & procedures if you don't do it by the book, as the dash camera is recording & livestreaming the live video & my voice to company. I was " searched for officer safety, contents of pockets removed, then detained in handcuffs in a car, (during which my phone in thier possession rang unanswered seversl times brgore thry did answer it. Approximately 15 min after which I observed very animated phone conversation. Officer: "suspect is acting suspicious" Dog: "alerts on car" (supposedly, in the officer's judgement) Officers: detain citizen and search vehicle in over one hour stop NOTHING FOUND AT ALL Officer: "have a nice day" (rinse, repeat) There have to be repercussions for making wholly bad stops. The officer was wrong. The dog was wrong. The search revealed nothing. It was all lies and/or incompetence and the system as it currently exists encourages and incentivizes all of it. No one gets in trouble. No one has to pay for this man's time. If this is the case, then why not simply have K9 units running traffic? Make up some pretext for a traffic stop, talk to driver, claim they are acting suspicious, bring out the the K9, K9 "alerts", search the vehicle, rinse repeat. This is completely out of control.

He was going to do what he did from that moment forward. Cooperation does not help you. Shut up, other than to assert your rights. This is why you don't ever talk to cops beyond what is absolutely mandated by law, such as presenting your license, registration, and insurance. It is none of any officer's business if and how much money you have, or any other possessions. An actual criminal won't admit to wrongdoing, and good, law abiding people have zero obligation to incriminate themselves.

They made us sit separately on the side of the road without talking while they spent 2 hours going through our things, including taking $300. You guys missed a HUGE point in talking about to dog alerts. That is, perfectly legal Dr. prescribed oxy smells the same as stolen illegal oxy. Marijuana has gone recreational legal in my state of Ohio, but none of the K9s that have been trained to alert to Marijuana have been pulled from service. How does the scent of something that is perfectly legal generate probable cause for a search. The dog will never be able to tell us what it smelled. Also, in this day in age, who thinks cops aren't just teaching them to alert to diesel fuel, gasoline, or even automotive carpet. I think some agencies just bring in dogs from home and just say that they alerted so they can search. Bottom line is if cops really want to search they are going to do it legal or not.

The animals are trained to "alert" or " indicate" when the handlers signal them to. All those animals.. I mean the dogs in this case..want is their reward. A toy, a treat, whatever. There is a video of a dea agent detaining a backpack because the owner refused to let him search it. Ultimately, a dog was called...and you can hear the handler making a kiss or click sound just before the dog "alerts". Of course nothing was in the bag. I'm not sure if IJ got in on this one. The pubic servants do not allow the victims to walk around and record the animals actions. Tactical security, officer safety, being detained, and the newest crap is that they are afraid of cameras because the cowards claim that they are stun guns or firearms. Just a new way to restrict our first amendment rights.

If a K-9 handler makes his or her K-9 false alert in a open air sniff the handler should lose their ability to use K-9s and if it's a repeated behavior from the K-9 it should be removed from service. And the ability to pull anyone from the vehicle because they may be armed is crap because every American should be seen as armed at all times and if your scared to be in law enforcement because a citizen's rights to be armed scares you don't be in law enforcement. When government and the supreme court started making law's for officer safety or the ability to create revenue or in the attempt to prevent crime instantly went against citizens constitutional rights and was criminal in there creations. It's clearly demonstrated that these law's weren't written for the people but for government itself and is in direct affliction with our constitution. And when the supreme court allows law enforcement act in any manner that goes against citizens rights it's a constitutional violation and a crime to increase government authority over it's citizens
