(I vaguely recall reading somewhere that Cruise asked director Rob Reiner to shoot the reaction shot first, in order to get genuine reactions from the other two...)

Can’t believe no one’s brought this up. Jack Nicholson’s impression of Tom Cruise was scripted, as well as Kevin Pollack’s impression of Demi Moore and Demi Moore’s impression of Kevin Pollak. No improvisation needed. That’s just how good these actors are

I think this is my second favorite Tom Cruise moment in the film. You see, in the previous scene he comes back to apt rained on, drunk, found out the crucial witness that could make anything stick to Jessup is gone. The case is in tatters. But here he now knows what he needs to do and he knows he can win. Great hero moment befitting of Tom Cruise.

Markinson would've been an unreliable witness. He'd gone AWOL, along with there being questions regarding his mental state, the prosecutor very likely would've insisted on his detention pending a psychiatric evaluation. The federal marshals were there to prevent his escape, that also means escape by suicide, that they don't always do. To be fair, Markinson would've have been better protected from injury to himself or escape if he was detained in the brig. The MPs would've strip - searched him and removed all items that he could potentially use as a weapon, they're better trained at detecting signs of a potential suicide risk and can often talk them out of it with a hot drink and listening ear. Usually there are collection of stresses that have led up to the AWOL; bullying, trauma, violence at home/unit, a sudden death, knowledge of illegal activity; but afraid to tell for fear of the consequences. Then the last straw breaks the camel's back and the soldier/marine cracks.

@@francessweeney2308 Yeah. Markinson was a troubled double agent, and if Captain Ross knew of it, he'd object and move for a strike. He'd also move for a psychiatric evaluation of Markinson. Just goes to show that the only way to win the case was to badger Colonel Jessup into admitting the Code Red.

@@francessweeney2308 Markinson would have been reliable. He had reasons for everything he did. The fact the went AWOL would have been used to inpugn his character but that is separate to being reliable. Markinson was very reliable in that he knew everything that had happened and before going AWOL had a very long successful career in the navy

I rewatched this recently. The chemistry and tension between Jack Nicholson and Tom Cruise was so tangible and convincing that at times I actually felt like I was watching a real trial. Two brilliant actors who fed off each other and made the viewer forget they were watching on TV.

Tom Cruise wasn't scripted to do the impression of Jack Nicholson so when you see Demi and Kevin laughing that's actually their genuine reactions and they then carried on the scene as planned. The director liked it so much he kept it in.

Fun fact: Tom Cruise's impression was unscripted. In fact, everything he does in the movie is improvised: the script was blank for all of Kaffee's lines. In fact, he wasn't even supposed to be in the movie in the first place, he just walked into the studio and acted. Moreover, he was born out of a spontaneous pregnancy; his mother just gave birth to him all of a sudden. Actually I am Tom Cruise, randomly playing a guy who has André Breton as his profile picture for some forgotten, probably idiotic reason, and I'm improvising this comment right now.

Although Tom Cruise impersonating Jack Nicholson wasn't part of the script, the reactions we see from Demi and Kevin aren't completely genuine. As they do know that the cameras are still rolling and nobody has yelled cut, so while it wasn't in the script, they were experienced enough to roll with it and stay in character. That's what the best part about this is.

Fun fact. There was some scripting going on in this movie, then an actor (can't give away who without spoilers) decided the heck with the script, I'm going rogue. He decided to do a little unscripted action. In other news, there was also an impression in this scene. Ohhh, the unscripted was the impression? Thanks other million comments.

Pollak does a better Nicholson. In fact, he's so good, the director had him fill in for Nicholson in the courtroom for additional scenes after Nicholson was done and had left. Pollak delivered Nicholson's lines to the actors and they said it was like Nicholson was there.
