Once he was fired for cause and GBI Investigated and turned findings over to the DA. He lost all immunity. But the sheriff himself can also be held liable because he knew of this guy's actions. And there are other federal and state civil suits due to this former deputy past actions.

It's a crime to resist detainment for investigation. He was detained for questioning of why he was there, a safety pat-down was being done and he was jerking hands and arms away, turning on the LEO. You can even be cuffed for detainment-ruled legal by a lefty majority SCOTUS years ago. You become detained, yes you have rights, but you have NO CONTROL of the process going on. Comply, go on your merry way when it's over.

Let's all just slow down here a minute. You would *think* this would be true in America, but it is not (depending on your State). For example, in Texas is _illegal_ to resist an arrest, even if that arrest is unlawful. You can (and probably will) be charged with resisting even if never charged with anything else. For reference: Texas Penal Code Title 8, Chapter 38 Sec. 38.03. RESISTING ARREST, SEARCH, OR TRANSPORTATION. (a) A person commits an offense if he intentionally prevents or obstructs a person he knows is a peace officer or a person acting in a peace officer's presence and at his direction from effecting an arrest, search, or transportation of the actor or another by using force against the peace officer or another. _(b) It is no defense to prosecution under this section that the arrest or search was unlawful._ (c) Except as provided in Subsection (d), an offense under this section is a Class A misdemeanor. (d) An offense under this section is a felony of the third degree if the actor uses a deadly weapon to resist the arrest or search.

@@don5062 You can be detained for a lawful investigation, including being secured in cuffs for the LEOs and your safety. If you commit a crime you're responsible for doing so. This example is different than in this event but shows committing a crime is committing a crime. Guy from a small town I lived in at the time was busted for a large quantity of coke. Went down. Appealed the conviction. The court overturned his conviction, dismissed the charges with prejudice-meaning he couldn't even be recharged. It just so happened that same morning he'd escaped from prison. Standing before a judge on arraignment for escape he argued "I wasn't even suppose to be in prison" The judge responded you were legally there the hour you escaped, you committed a crime, you're going to be found guilty of escape and I'd advise you to get with your attorney. He got 5 years for the escape.

The citizens of Paulding County need to vote out the Sheriff (Gulledge) because he allowed this loser on his force for years and did nothing despite multiple complaints of abuse by McMaster. This deputy had a long history of abusive behavior. He never rose in rank because of it. He was reprimanded multiple times for every year he was a deputy. He should have been fired years ago. But the kicker is , the charges against the guy were dropped until he sued the Sheriff's department. They came out and rearrested him and recharged him in retribution. I voted for Sheriff Gulledge every year for the past 20. Time for someone else to take charge.

The rearrest would be tossed on 5th amendment. Once they were dropped, they cannot recharge. I bet that part of why the settlement is so high. Because of constitutional violations. Can't be charged with the same crime twice.

Also the case is trash because the deputy reputation is trashed because he was fired and was under state (GBI) investigation. Without the officer testimony there is no case. And they cannot just use his written report because it has been proven he lied and made false statements in it. Any prosecutor would be commiting political suicide.

There several failures across the whole nation. One, officers supervisors not spot checking areests and providing corrective education. Two, DAs not checking body cams and reporting bad arrests and bringing charges against the officer when appropriate. Three, judges not stopping cases when the facts dictate it should be. On many of the officer involved videos seen, there are officers, male and female, seem to be seriously overweight. This would handicap them in foot pursuit of a suspect. Why aren't these officers kept to a weight standard and as part of their requalifications, required to run a quarter mile in their duty gear? If they are supposed to be of service to the public, they should be fit to serve physically if there is an emergency. Or they must be suspended on 1/4 pay for a period of no longer than three months, during which time they meet set standards or will be terminated.

Just some details not mentioned in this video: The cop proceeded to mock and belittle his victim after the bodyslam. At once medics were called, the cop lied to the medics that Canaris resisted arest and that he injured the cop on his arm. The cop also searched Canaris' belongings without a permit and declared his work gear that was in his backpack were tools for burglary.
