- It is illegal for any hobbyist to fly a drone (or any aircraft) anywhere within New York City limits, per Administrative Code Section 10-126(c) Violations of this code can carry misdemeanor charges and a criminal record - Additionally, New York City Park Rule 1-05(r)(2) outlaws any drone flight over parks within the city - violators can face fines of up to $1,000 or up to 90 days in prison - Flying a drone in an area where people are or could gather can result in charges for reckless endangerment, as some drones are heavy enough to cause injury should it fly off course In 2014, two men were charged with first-degree reckless endangerment, a felony, for flying drones too close to an NYPD helicopter Source: The Law Firm of Andrew M. It's completely illegal to fly drones in NYC, even being a professional is hard to fly there. I'm curious as to how he was able to fly? If you live in NYC, you're suppose to call 911 if you see a drone flying in the city.

Regarding legality, NYC Administrative Code 10-126(c) states, "“Take offs and landings. It shall be unlawful for any person avigating an aircraft to take off or land, except in an emergency, at any place within the limits of the city other than places of landing designated by the department of transportation or the port of New York authority.” ("avigating" is a fancy word for "navigating"). So yes, Adam's flight was completely illegal. What makes it 100 times worse is that he crashed his into the new World Trade Center. The original WTC was targeted by terrorists TWICE. Six people were killed in the 1993 bombing, and 2,606 people died in the 9/11/2001 attack. Drones have been used recently in multiple terrorist attacks in the middle east, including 2 attacks on cargo ships in the last week. Adam isn't just lucky he wasn't arrested, he's lucky he wasn't slammed face first into the pavement while being arrested. If he had caused any kind of panic if somebody had seen his drone heading for the WTC, NYC's drone law would have been the least of his worries.

Like I said, that law isn't enforced. It's an old law from the '60s and things have changed over time. Yes the law still exist but it's a work in progress to be updated.

@@xavier_arthur Exactly. You gave the perfect example to destroy your own argument. Jaywalking laws have been on the books for a long time. Many people jaywalk every day. BUT, jaywalking, like flying a drone, can and will be prosecuted for egregious instances, and when deemed necessary for public safety. And, of course, when the police receive complaints. In this case, the person did one of the stupidest things I have ever heard of a drone pilot doing. He flew a small aircraft into the site of the worst terrorist attack in American history. He was arrested and taken to jail. What are the consequences for breaking this law? A criminal record that will show up in many different places for the rest of the person's life. Oh by the way, there is that second drone law related to city parks. If you fly in a park not on the approved list, you can go to jail for up to 90 days. You really can't say that the drone law isn't enforced when you're doing a story about someone who was arrested for violating the drone law.

@@xavier_arthur Jaywalking will get you a ticket. Flying a drone in NYC is a criminal offense. (BTW, try jaywalking on the Las Vegas Strip and see what happens). Enforcement depends on the situation. These are laws that are enforced selectively, at the discretion of the officer.

Flying around buildings and over people in the city is dangerously stupid, regardless the size of the drone. Imagine you are walking your child and drone falls, hits your child and dies! Professionals do it with the use of parachute system. No drone police here but thats thats damn dangerous and reckless

I agree. And it's not just flying directly over people. If you fly your drone towards people and something fails so that it continues towards them and injures someone, that is also considered flying over people, and will result in serious consequences

Local ordnance makes it illegally to fly drones in the 5 Boroughs. Only legal in a couple hobby parks in Brooklyn.

Yup. It is absolutely no legal and not allowed ANYWHERE in the 5 boroughs, except in a few hobby parks in Queens and Brooklyn, like you stated. O P even has videos of people getting busted by N.Y.PD cops, who are trained to bust any drone operators.

Saw this report on another channel as well, the pilot says that it was a DJI AIR2S. Was arrested by Port Police, NYPD Anti terrorist unit and FBI after they conducted an investigation and proved it was nothing more than an accident by a hobbyist drone pilot no charges have been laid as yet only a summons for flyingvan aircraft in NYC. Will be interesting to see what if anything the FAA does

I was born in the Bronx, lived there for years. Do I miss it? I'm still not sure. As far as orbits, EVERY time I orbit, I do them manually. Fantastic info for urban dwellers.

Great video but there is something you forgot to mention with the aloft app. At the bottom where it says the location you can scroll up and see if there are any flight restricted areas or TFRs in effect. If you do you will see that there is a permanent flight restriction in Manhattan. The map will look clear but there could be a temporary or permanent flight restriction in effect. I would like to check out one of those spots you pointed out where it is ok to fly. Again, thanks for the great video.

I am visiting New York for my second time in October, and since the last time I have visited, I have bought a DJI Mini 2. I've been trying to figure out whether I can fly in NYC or not, because I'd love to make stunning shots in my No. 1 favourite city. I have registered the drone with the FAA (even though it is not necessary, I want to make sure) and I have taken the online test and gotten a certificate. my plan was to fly a bit from Flushing Meadows, because I've found it is allowed over there. but from this video my understanding is that I CAN fly in certain parts of Manhattan? is that correct? because what I understood from other sources it is just overall illegal by NYC laws.

Forget flying in NYC, if you want city drone shots try Chicago, there is a whole section of city under class G airspace. The cops are too busy doing other things to care about you fly your drones. Flying between the skyscrapers could be tricky. Flying at night you get the best cityscape shots, just don't get mugged.

FANTASTIC! Thank You so much for making and sharing this video. I'm in Chicago and prefer not to fly downtown. GPS loss Signal, Steel EVERYWHERE, time of day and the Wind channels, nothing to do with a Chicago nickname and it has nothing to do with actual wind conditions. People don't realize the number of things You may not see, e.g. thin ass lightning rods atop many buildings, a hidden large ACE unit, guy lines/wires and don't me started on construction equipment. It's wise to do a thorough site inspection before ya think of flying in many urban areas. Fly where You can retrieve Your drone if it needed. You will pay dearly if the city and the like have to get it and might face criminal charges. FYI, We have 26 miles of Lake Michigan Shoreline most of which is public land and accessible to all but I strongly caution flying to far off shore over it due to the Lake having it's own weather pattern plus a few other issues. I'd also suggest similar care if flying near or over Lake Superior.

I am sure you know this already but your friend's mishap is all recorded...spec wise. Right down to how may satellites were connect(or not connected) at the time of the incident. It records all telemetry every two seconds. '51 Drones' just put a video out explaining how to get/find it.

Hey guys, was flying in Philadelphia down by the Ben Franklin bridge, over the river. Carried out all necessary checks. However, after putting my bird in the air, I discovered I could not use my camera. The fly app indicated that Independent Mall (a national park) was near by (3/4 to 1 mile away) and would not allow the camera no my A2S to work. I have used my air 2 at this location with no problem. Any thoughts on what was happening?

Xavier, Xavier. Mavic 2 has side sensors active and functional in orbit. Mavic Pro, Mavic 2 Pro both of them have 2 imus and 2 compases.

And sensing from dji website [1] Omnidirectional Obstacle Sensing includes left/right, up/down, and forward/backward obstacle sensing. Sensing for left/right directions is only available in ActiveTrack , POI, QuickShot and Tripod mode. Omnidirectional Obstacle Sensing does not fully cover the circumference of a 360-degree arc. And left and right obstacle sensing system only works in specific modes and environments. DJI warranty does not cover any loss caused by crashing when flying left or right, even when ActiveTrack or Tripod mode is activated. Please be aware of your surroundings and App notifications when operating the Mavic 2 to ensure safety.

Oh. my God! what you explained sounds scary! I'm from Maryland, a recreational pilot, I'm on the way to get part 107 test. I have DJI mini 3 pro I did shoot a lot in Downtown Baltimore, inner harbor. Cops walked by just to say Hello to me a few times! no action, but all national parks are prohibiting Flying drones, park police will catch you because they can see you once you turn your Drone on. that's true you said that you will constantly lose your signal when you fly in the city, especially New York City. I do have a trip to the city, I really want to get shot for the tallest building in the city, thinking to take off not fly a circle get quick shots, and land. cuz my battery won't last too long. I will have a big risk to lose my drone. should I take that risk? Love to hear you back! I saw a lot of awesome drone footage online do that drone pilot has got approval from FAA? or they bigger drone.

That's really bad news, to lose any drone regardless of how much it cost. As cool as it may be, flying lower Manhattan I don't think I can do that, even with permission. It's too dangerous, way to many people and buildings. Thanks for sharing X. I enjoy watching your videos. 👍👍👍

I have a wifi drone and it gets interference from buildings mostly the ones with antennas that are own by cellphone companies i fly near one and when it gets high by the roof up a 5 floor building the drone lose the signal starts beeping,or gonout of control, on the aloft b4ufly app almost all queens is restricted or 50 feet max altitude which is lower than some trees is ridiculous but oddly the map in lower Manhattan is not under the restricted 50 feet ( the blue area ) by battery park , and by the riverside between Manhattan and queens there's no take off or fly by ...Gantry Park and its on blue 50 feet

Let’s be frank, there is no “fly properly” in NYC. UAV use is illegal in all 5 boroughs per a local ordinance. The future of this local ordinance is still uncertain, but the fact of the matter it is a law. If you do decide to take a chance with flying a UAV in NYC, do it at your own risk.

You have some great advise on flying a drone in an urban environment, but you’re forgetting the cardinal rule of recreational UAV piloting, line of sight! If the unlucky fellow in your video had kept his eye on the drone, it would have never hit the building. Regardless of sensors, GPS, etc.

Yeah I learned my $500 lesson about doing an orbit on my Mini 2 (NO SIDE SENSORS) Ugh 😣. Ran side-ways right into a tree doing an orbit. I wasn't clear by 5ft. 5ft while flying a drone os like 2cm.

manhattan is more or less no fly zone, what are you talking about? and by the way, vlos is vlos, so eyes on drone all the time. if he do it as he should (but not in no fly zone in most crowded place in the world, lol), he would visually see drone coming to the building and he could stop operation. so again, people: if you're stupid enough to do such things, at least don't be stupid enough, to post video doing it on youtube. they all cant wait just to ban drones from the sky, why helping them?? edit: skydio? you would fly that neurotic thing in middle of nyc? that would be my last pick or better to say not even thought of doing it.
