@@richb.4374 Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States. For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim. The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.

I know of a small town gun shop in Co. that still sells Magpul 30s. Sheriff has told them that if anyone from the State comes in and gives them any problems he will arrest them and escort them out of the County.. We need more Snerriffs like this...

Most AR mags have a date on them believe it or not. It's in a tiny circle about 1/4" and it has the month and year it was made. A hot 1/4" punch makes it disappear pretty easy though.

They know when new 15 rounds for a gun come out. For example, just recently you can now get 15 round magazines for the Glock 43, when previously you couldn't. They came out in 2023 AFTER the ban. They can also tell the date of a magazine sometimes just by it's appearance.

When this law passed, I stocked up on 5.56 p-mags for my AR, 13 round .45 magazines and 16 round 9mm round magazines for my pistols, prior to the law taking effect. I consider it an investment in the safety of my loved ones. Thank you for the video.

You aren't the only one... Currently sitting on either 14 or 15 (not sure without doing a "touch every one" level inventory) 30 round pmags for each AR mag well I own, 10 17 round Glock mags for each mag well, and have everything needed to make as many of both Glock and AR mags in whatever size I feel like, from 5 up through 60 rounds each. And absolutely no qualms about punching the "got" button on the printer to make them whenever the urge takes me. I'm also putting the finishing touches and testing on a 75 round AR drum mag for the specific purpose of violating this illegal law. Still can't get the spring on that one quite right by printing it. May end up having to go with a steel clockspring in it to get reliable feeding - I just can't seem to get it to feed the full 75 - it starts out fine, but starts pooping out and getting "iffy" around 53/54, and usually gives up feeding at all by 57 or 58, and has to be rewound before I can finish shooting it empty.

Let's have a discussion about the penalties for wilfully passing unconstitutional laws and the absolute dereliction of duties that are happening in our government, By our employees. As with other criminal activities in other employment situations you could easily be arrested, fined,serve prison sentences and have to pay restitution to your employers. Why do our employees constantly use embezzled tax dollars to NOT perform their duties that they all have sworn an oath to do?

I asked my husband this, he is a criminal defense attorney in WA. Basically, if you owned it before the ban you are grandfathered. If you buy after, the officer has to prove you broke the law.

What if an online purchase at a state without magazine ban,was made and the gun was brand new "old New Stock" and came from the manufacturer with more than 10 round magazines ...let say it went to an FFL in Washington after last June and the gun was picked up after background approval and the magazines were not permanently blocked down to 10 rounds or blocked at all, So the owner now has this gun that was made this way years ago... Does the owner stash these until maybe this ban gets lifted or they move to a different state that allows more than 10 rounds magazines and in the meantime buy different magazines with 10 round only or pay for just one of the original magazines to be blocked What's best move here knowing the owner resides in Washington state however would like to keep these magazines as they came for obvious reasons

It is impossible to tell between a pre ban mag and a post ban mag unless you post it on social media. If you come to Idaho and buy a bunch of standard capacity magazines the chance of getting charged would be minimal. If you chose to sell said magazines that is where you're going to get into trouble.

Why do citizens in Washington State still talk to cops when a cop is investigating them on a GUN incident of ANY kind? I live in Idaho and fly out of Spokane. I was just flying with a checked firearm and it occurred to me that I could potentially be in violation of this law if I wasn't careful. I was flying with my 1st Gen S&W 9mm Shield which has a factory magazine capacity of 8. Had I been flying with my other pistols I lack a low capacity magazines because the shipped with factory15-18 round magazines and I would have to purchase a non-standard magazine to be compliant. It is so easy to be an unintentional criminal when you come from one of the freedom states.

I went out of my way to get a bunch of mags before this passed. They include 30, 40 and 100 round AR mags in addition to 22, 33 and 50 round Glock mags. Yes I have heard the story about the 100 ARs and 50 Glocks jamming but so far so good. First time I took my 100 AR to the range, the range master asked “what the hell is that”? I told him just something to make gun grabbers cry. After I emptied it down range, the oil on the barrel was smoking. Moral of that story, don’t empty your mags as fast as you can pull the trigger especially if you have cleaned and oil recently.

Depending on the jurisdiction, I could see someone being charged for importation, when returning with mags they owned before the new law. In those cases, you may beat the charge, but not till you spend lots of money defending yourself.

I would not put it past Inslee and Ferguson to deploy officers to "observe" border area stores and then snag you as you drive back in. They have done this with sales tax on things like home appliances in the past for people coming in from Portland into Vancouver. They would love to catch someone doing something like that.

This is standard practice for Southern California. People go to Arizona to grab items from the gun shows and Ca. DOJ will be in the Arizona parking lots recording license plates. When you come back over the border into California and through the fruits, veg and plants checkpoint, law enforcement will be waiting to pull you over. Not everyone gets yanked but it’s enough to make you think twice about alternate methods of purchase and travel. Disclaimer, I no longer live down there, so Ca DOJ can eat a bowl of Frisco dicks!

I doubt it. I know many people that have crossed over to Portland, Oregon to buy magazines after the Washington State magazine ban. The police could care less what you do. Even the gun shops know that people are coming from Washington to Oregon to buy magazines.

The gun-grabbers know the laws they create are unconstitutional but legislate and enforce them with the comfort of knowing that it will often take years to work its way through the various courts, appeals and possibly the U.S. Supreme Court. During that time many legal gun owners will be incarcerated, pay fines, pay attorneys fees and some will have been declared "prohibited persons". Look at the Red Flag Laws enacted in 19 states and the District of Columbia. As of May 29, 2022, Red Flag Laws in Florida have been used 9000 times. Red Flag Laws violate a number of Constitutional Rights including due process but it may take years to get to the U.S. Supreme Court.

Interesting. That seems like a pretty hefty penalty for somebody who, hypothetically, goes out of state and buys one magazine for personal use. Hopefully somebody will get the 10 round mag limit overturned in WA. We really need the US supreme court to rule on a variety of 2nd Amendment issues to clarify that "shall not be infringed" means what it says.

Colorado seems to get away with openly ignoring their magazine ban. You can find 30 round magazines sitting on the shelf for sale in pretty much any gun shop outside of Denver. The only real issue is online retailers won't ship them to the state.

The problem with too much of this is that it makes everyone a criminal and out of the blue, at any time anyone can be discriminately prosecuted.

I've wondered what would happen if I was insane enough to travel to states with various mag cap rules with my 30-42-50 round mags to use at local ranges. This first came to mind when Dragonman's videos kept popping into my feed. Colorado has a 15-round limit and it had me thinking "his property, his rules" but at the same time I'd rather not have the law come over and beat me black and blue for possessing something I've had for years. There's talk about that limit being overturned at some point. ~ Resident of Indiana where nobody gives a f*ck.

I’d be more worried about traveling through a jurisdiction such as New York while in possession of them, most law enforcement that would be at a range more than likely won’t care.

That reminds me of something Iraqveteran8888 said a while ago regarding a woman who was travelling the nation. She was just _barely_ across the New York line (bathroom break I think) and she was busted for possessing a firearm. Not sure what came of it but nevertheless it sounded like a lot of petty bullsh!t. Always can do a road trip into Oregon (for now depending on what happens with Measure 114) or Idaho and stock up on standard capacity mags. They don't ID for mags in Oregon (yet).

The local gun store had a line out the door of people buying high cap mags the weekend before the law went into effect. How would the state even know if someone broke one of those and replaced it with something they bought out of state, or even if they picked up an extra? This is going to be so hard for them to enforce. They would have to prove it was purchased AFTER the law went into effect and the mag was not grandfathered in. Unenforceable laws or laws that cannot be enforced without violating multiple rights are simply not good laws.

Sometimes you can tell the year of the mag. For example if you purchased an S15 Gen 3 Mag. They know the Gen 3's didn't come out until 2023.

Correct me if I'm wrong. Most AR magazines have a date of manufacture built into the mold they are cast from. So if a person pays cash for a "oversized" magazine per Washington's magazine ban out of state and the magazine has a manufactured date that predates the Washington magazine ban technically there is no record to prove you purchased the magazine after the ban, and as long as you get the magazine home without incident there is no evidence that you violated Washington's magazine ban. One of my favorite movie quotes, "it's not what you know but what you can prove in court." -Law Abiding Citizen.

They still have to PROVE the violation. That would mean subpoena the manufacturer's records to prove the numbers stamped on the mag are actually the date of manufacture, and not a serial # or order date or sell-by date etc.

@@jondoe406 the is no such thing as a sell by or expiration date on a firearm magazine. A magazine is not perishable, but that's just common sense that any person with at least half a brain cell should know. Serial numbers don't go on magazines and I have never heard of a 3-4 digit serial number on anything built in the last 40 years or so, but again common sense. If you know guns and ARs this is pretty common knowledge.

@@jondoe406 well, it's also hard to build the date of an order into the mold on a molded part like most of these mags that simply made en mass then used to fill various orders all over the country that could come in at any time after the part has already been made and the date put into the mold. A simple diagram of all the parts and information listed on a magazine from a manufacturer website or something would suffice. If they wanted to go after someone for a supposed violation they would need to prove that I violation took place. Without receipts or detailed packing slip the only dates they have to go by are the dates on the mags. As long as those dates are pre-ban they can't prove a thing.

The 15 standard capacity magazines - ranging from 12 to 16 rounders - I have for my compact carry pistols were all obtained prior to the unconstitutional ban taking effect. I assume the burden is on the state to prove any were obtained after the unlawful ban initiated.

@@davep4610 The last two of my so-called large cap mags were obtained in mid-June, just weeks before the unlawful ban went into effect. I did not save the receipt. It'll be interesting to see what anti-gun legislation is proposed in Olympia come January. Each January my anxiety would rise with proposals to ban "large cap" mags, and I'd add up how much I'd have to spend replacing or modifying mine. I doubt this coming January will be anxiety-free.

If you willfully violate it and get caught, then you get a free ticket to court to fight it. Most courts will dismiss a plaintiff case if you didn't violate or have intent to violate.

Those fines and amount of time for simply possessing a prohibited magazine is unreasonable, and unusual punishment for these rediculous laws ,which in my opinion is unconstitutional because it violates the Second and Ninth Amendments at the very least! This magazine ban s hold be determined to be unconstitutional and stop any further attempt by local, state, or federal government from passing anymore unconstitutional legislation, but that will take a very long time, and lots of money to get done.

A question for @WashingtonGunLaw : In respect to the importation issue. I hoping to get clarification on temporarily bringing "high capacity" mags into Washington state for recreation, then leaving the state with them. As an Oregon resident, I'm frequently visiting friends in WA to go shoot with them in Washington, and I assumed I couldn't cross the border with 10+ round mags. Could I, being that I'm not importing, and I purchased them (in Oregon, as an Oregon resident) before the WA ban? Thanks

Wouldn't it likely get dropped, because once it goes to court they'd have to apply strict scrutiny and change the law, permitting sale in WA again? Seems they'd rather keep the law on the books to prevent sales than try to persecute a gun owner for it.

Mr Kirk, one thing I havent heard discussed, in relation to this law, is, how does one prove (or the law disprove) ownership of said magazines? My concern is, what if we travel to Idaho with some magazines, return to Washington with the same exact magazines and for some reason have an encounter with the law, and get charged with importation? Are we required to bring receipts with us proving we bought them pre-ban? Seems unreasonable but Im just curious your thoughts on this matter?

carrying/transporting != (not equal) importing From Sec. 3: "No person in this state may manufacture, import, distribute, sell, or offer for sale any large capacity magazine, except as authorized in this section." Importing is clearly in connection with acquiring with intent to distribute or sell. -- PS The burden of proof would be on the State to prove when the magazines were acquired.

If you continue to disagree, Please show me where in that statute you are claiming "import for personal use" is found. ------ "run u through all sorts of proceedings and jack up lawyer bills" That can happen with virtually any law. That's a corruption of process issue, not an interpretation of law issue.

I think it's all BS anyway. I actually believe there should be a mechanism available to fully restore all rights even to convicted felons if they are able to show that they are unlikely to commit further crimes.
