That's actually a great, great question coming from a person who's not close to penetration testing. How do you run and reverse-engineer malware on your computer, without it affecting the computer itself? Ofcourse the answer to someone who knows is something like a VM, but that's not known to everyone.

Up until even the early 1990's some cyber criminals received little to no jail for divulging their techniques. Some even go to work for the government in exchange for their freedom. A few even make a career out of it and go straight. Those days are LONG gone. Government has their own geniuses who deal with this stuff. Any hacker who thinks he can strike a deal with Uncle Sam in exchange for asylum is living in the past with present day consequences.
