Sir, I think there are several judgements of the Supreme Court wherein it has been held that a Memorandum of Family Settlement is not required to be compulsorily registered u/s 17 of the Registration Act and is not a transfer but just a recognition of an arrangement between the family members. Latest case being Ravinder Grewal Vs Manjit Kaur . Ref. (2019) 8 SCC 729. you may like to comment on this. Thanks.

Can the properties divided as per the family agreement be transferred on the name of the persons as per the agreement in sub registrar's office in Mumbai?What about the stamp duty, if payable how much between blood relations?Mumbai,Chennai,Calcutta a probate could be avoided by this method? These are important issues you have missed out.

thanks for sharing your inputs. To add, if there is an oral family arrangement and the terms of arrangement are reduced to writing merely for the purpose of information and record and the document for the very first time does not create or assign any right, such document will not require registration/stamp duty and shall fall under the exception 5 of the Sec 17 of Registration Act. My father and elder brother 10 years back signed one such agreement,but they later made will against it.And kept this truth hidden for 7 years.now when it is a time of marriage of my kids.on asking brother shown me.and father denied.They both play tricks with me.Two times before I have passed through dipression.This time too I am feeling a lot of it.

Sir i am a banker and one property came for mortgage in housing loan. This property belongs to first time A and he decesed and legal heirs are 3 persons into it 2 son and 1 daughter, Daughter release his right in favour of her 2 brother by execute unregistered release deed and after than 2 brother get done a family settlement of all the properties of there father by executing unregistered family settlement deed. My question to you that both the unregistered deed (unregistered release deed and unregistered family settlement)execute by sister and both brother are valid or not. If not than guide in which section? I will be very thank full to you.

Sir I have done land settlement deed to my father, that land i have received from my mother,s parent family. Afer the settlement deed done revenue department refused it to register mordage (dakhil kharij) reason given it was made wrongly. pl guide me they are telling wrong or right and what i can do now.

Sir can the self acquired joint property (not forefathers property) of 2 brothers be divided into 3 brothers by family settlement memorandum. My 2 uncles foul played a trick by this means. We have registery of home

Namaste sir, Apse ek help chahiye tha, Mere nana je 3 bhai the, teeno bhai ke name se 1 plot tha aur grand nana je ke name se 2 chota- chota plot tha, mere nana ji ki sirf2 beti hui (meri maa aur meri mausi ji) koi beta nahi, nana ji ne apna total share(hissa) meri mausi ko registered gift kar diya (jo ki unhe family arrangemet deed se bantwara ho kar mila tha) sir kya hai ki jo property nana ji gift kiye hai wo nana ji 3 brother the unke name se tha(disputed property) , to us property me teeno bhaiyo ka share hona chahiye, lekin 2 aur chota plot tha mere grand nana ji ke name se , is liye 1bhai(Nana ji ke bhai) ko wo 2 chota plot mila aur bache hue do bhai (mere nana ji aur unke bhai) ko bara wala plot me half half share mila, to kya nana ji ko prapt hua property khandani property hua ya self puchase , kya nana ji ko yeh haq tha ki wo pura property mere maa ki apni bahan (mausi ji) ko registered gift kare ?

Hi Sir, My mother died in 1991 and my father had another marriage.So he left us alone. But recently myself and my sister had a family agreement deed registrations without my father. As my father didn't sign in family agreement deed,will it be valid ???
