What this tells me is: 1. Sign a arbitration 2. Have the company accuse me and the arbitrator decides to side with the company 3. Then *I* have to pay up, even if the accusation was false Sounds like a lose-lose situation. Why even have an arbitration agreement in the first place? That tells a good quality employee you're not worth it.

Arbitration isn’t designed to help employees perse. More than likely the company who made the contract chooses who the arbitrator will be. It is also extremely likely that the arbitrator is on the company’s payroll. It is rare for them to side with individuals, or the company may just release them because they cost the company too much money. But it’s a way to keep their name out of court for a proper case. It’s very much a lose-lose situation

Thanks for this question. It’s a really good question. Technically speaking anyone can be an arbitrator. There are no requirements so long as the parties agree that Alan or whoever can arbitrate their dispute. In practice though, most people prefer professional arbitrators who are often former judges and lawyers. Some arbitrators may not be judges or lawyers but have some sort of expertise that would make them useful to parties in a dispute. There are private companies such as JAMS who provide professional arbitration services. Does this help answer your questions?

yes very helpful.. we are having trouble with solar panel fraud. This company from Texas did a half ass job then filed bankrupcy. left us with a debt with a financial company now we are stuck with payments and a solar system that was never activated and dont work. only way to fight them is by arbitration i just did not understamd the concept.

Thank you for the informative video. I made the mistake of signing a contract that said that if the employer and I had any disagreements then we would have to go through arbitration. We have a disagreement but he gives many excuses for not wanting to go through arbitration. How can I force him to go through arbitration?

I think the law in the UK is similar in that courts will generally enforce arbitration clauses but you would need to consult the UK arbitration Act. In the US, to get more specific you would need to refer to the federal arbitration law (the Federal Arbitration Act), and there are also relevant state laws, to get a better understanding of circumstances where arbitration clauses will or will not be enforced. But as a general rule in the US agreements to arbitrate are enforceable and I think the UK is similar. DJ, not sure why you say this. In the United States and many other countries arbitration is favored. With limited exception, parties must arbitrate those disputes they agreed to arbitrate unless a governing law would prohibit arbitration. Likewise, in the US and many other countries the decision of the arbitrators is enforceable in court. There are only a few exceptions to this general rule.

So this will help if the person hit the driver side into a car accident report but if the a film of the car accident on a Dashboard Camera got it on filming it’s that will not pay anything of the financial fed of the money financial can there used it with the car insurance it’s not to pay it at all will the person hit was Guilty one in the first place to arbitration it was not looking around his mistake but still quite 🤭 when the person say I have on filming recording you in the car accident report

Hi RF, yes it is conceivable for an arbitrator to be corrupt so the scenario you described could occur. If David learned about the scheme he could refuse to pay on grounds that the award was fraudulent. If Patty tried to enforce the award David could ask the court to invalidate the award.

Not really. In your comments you described a scenario in which the arbitrator participated in a scheme with Patty to cheat David. David should have grounds to ask a court to invalidate the arbitrator's award because the award was the product of the arbitrator's corruption.

Are you asking whether arbitrators always receive mandatory training or must always have certain qualifications? The short is, "No." However, many arbitrators have specialized backgrounds that may make them particularly suited to decide certain types of disputes. Some parties might want arbitrators who are attorneys, retired judges, or have relevant industry experience. Arbitration companies will have a roster of arbitrators with different backgrounds and will train their arbitrators.
