Impeachment this time, is when you remove a traitor, a highly paid Russian operative, who has laundered billions of dollars for Putin and his Russian oligarchs since 1987. A man who continues to destroy our ability to defend ourselves in every conceivable way. Donald Trump is a traitor. And we are at war with Russia, and we have been for a long long time. Many decades. The Impeachment Process is about airing Trump's dirty laundry in a structured and public way. The rules are such that he wont be removed from office, or found guilty but, an inside look into the swamp in the White House might affect public opinion next year. It depends on how long long Trump can keep himself out of trouble, and how long the memory of the American Public is. Its a whole year before the Election, so of course, it is a no bet proposition.

The basic idea of an impeachment procedure is not to try by law, otherwise it would be incumbent upon a court of law and it’s pretty clear that the founding fathers didn’t intend to have the popular sovereignty which is implicit to a mandate such as the president to depend on bureaucratic stare decisis considerations. Aiming at a composite type of judgment, in which the legislative apparatus turns into a court, always results in the raising of the same questions about the observance of court rules, impartiality and the very concept of the crimes eligible - always with a politically biased rhetoric. It’s something that has been seen in South Africa, Brazil and South Korea, countries whose legislation on the subject is by far more elaborate. In the end it’s not legal enough to command the respect of a court judgement and not political enough not to rely on legal considerations that always appear to be inherently biased. Here the good intentions of the founding fathers presents an uncommon naïveté as to the natural development of “factious sentiments” in a mass democracy...

The US Constitution is law, so impeachment is trial by the law. What the founding fathers in America did was to reserve the legal right to impeach and to control the impeachment process to Congress and the Senate, rather than the Courts.

Why would they do it if they intended it should be just a regular trial? Why not leave it to the regular courts? It’s pretty obvious that they wouldn’t aim at borrowing the bodies politic only as an anomalous judiciary court, as it would be pointless. “Political weight” certainly doesn’t mean party-related political reasons - such as those which served the Andrew Jackson procedure, which was correctly dismissed. The whole constitutional architecture of the impeachment procedure was meant to avert majority partisan-conformity as a way of ousting the chief of the Executive - and the expression “high crimes” is quite enough to settle this question, if it’s not its only legal purpose. In any case, political considerations certainly concern the merits of the questions presented and accepted as proved, notably about abuse of power, as opposed to simple exegetical verification of factual compatibility with case-law. The level of discretion is much greater exactly because in specific situations certain illegalities would lead to an ousting by the Judiciary, even though it would result in an enormous break of the democratic dogmas. The founding fathers were trying to protect the president from the Judiciary’s typical “modus procedendi” so as to preserve the political aspects involved in the executive decisions allegedly ilegal, once they thought the bodies politic would provide a better forum for such discussions. Unfortunately there seems to be no ideal place amidst such fierce political passions...
