Remember everyone, if you are a property owner you do in fact own the airspace above your property. You are however required to allow the easement of aircraft in the airspace above your property according to the supreme court. And the FAA classifies drones as aircraft. Shooting at an aircraft will bring about federal charges.

So, I’m thinking that it was too low to be in regulated airspace, would that be correct? I never took the drone operator course, so I’m unsure how it would apply as technically it may have been considered landing or taking off secondary to making a delivery, obviously an aircraft is protected during landings and takeoff. So, if someone would troll another in a helicopter and stay stationary at maybe 50 feet over private property, how would it apply? Any differently? That said, I’m just sticking to Cessnas, since how the rules apply are far easier to understand!

I"m not a Karen, but I am a pilot. Aircraft are REQUIRED to stay 500 ft above any person. Drones don't have that restriction...and they should. We've seen incidents of people flying drones into people's backyards and filming into people's homes. Airplanes and helicopters don't do that. Drones are a totally different ball game because any idiot can fly a drone. It takes a lot training, especially safety training, to fly an ACTUAL aircraft.

I live in the north woods. We don’t have drone deliveries. But we have had an uptick of drones and 20 summer camps broken into. As a result 4 drones have been shot down by neighbors. We all have acres between us but if I was in a neighborhood like that I certainly wouldn’t be discharging a firearm. I do think the charges were rather harsh.

So much missing from this so ill add context. This happened in Lake County Florida which is a very RED and backwoods county. Walmart and a few other companies have started to do drone deliveries in the area due to how a lot of the area is undeveloped. Walmart notified EVERYONE in this neighborhood 1 month in advance they were going to be doing drone deliveries and that they would be a few days where they would see a influx of drones as the engineers would be out programming and mapping the area out, the notice also said that these actions were all done autonomously and that everyones privacy was safe. The first notice was in the mail and the week prior to this they went door to door and left door tags on all the doors to again inform neighbors that the drones would be out the following week! Fast forward to June 26th the engineers were out programing the drones, the 2 engineers were on this mans street about 2 houses down and watched the whole thing happen. They mentioned that they were yelling at the man to not shoot the drone and they were with Walmart, however the reports from a few homeowners and the engineers is that he fired multiple rounds not just the single round he said he did. The drone was damaged and did crash a few hundred feet away. LCSO charged this man with multiple felonies, The DA did drop one or two and downgraded 1 felony to a misdemeanor. But he still has a good amount of charges to him. However what the video did not show is the charges he picked up from the FAA. For those that don't know the FAA considers ALL drones that must be registered (Which is any drone over .55 pounds) are considered aircraft. In the eyes of the law a drone is no different than a helicopter or airplane, the FAA charges him with a few federal felonies and pretty much making an example out of him to make sure no other dingbat will try the same. For all those that say you see nothing wrong or that "you would do the same thing" tell me this I assume you want to consider yourself a "responsible gun owner" right? So tell me how shooting a gun in the air is safe not much in a neighborhood with children? Tell me what happens to a bullet shot in the air? Yea it must come down, you better pray it doesn't come down and hit you or a loved one. Second, These delivery drones are large and have some semi heavy parts to it, what happens when you do shoot it? Where is that drone going to go? In this case it crashed in a neighbors side yard but what happens if that comes down on kids playing in the back yard or your dog that you let out to go play or it just come down crashing onto your car. As well these drones have large batteries on them, if they get punctured at all when your shooting at it or crashing you just turned it into a flamethrower, and depending on where that battery lands has the possibility of catching a building or foliage on fire. See how this is becoming a problem fast? Most states have adopted laws to protect you from "Peeping Tom" drones. In Florida you can't fly a drone in a manner that would invade someone's privacy so you can fly a drone over a house, you can let a drone hover over a house but the minute it starts taking pictures of you (They must be distinguishable) OR it flys to your windows to take pictures inside a building is when its breaking the law and you can contact law enforcement. Also because I know some idiot will say "I own the airspace above my property" umm no you don't. Your ownership stops at the ground and whatever is touching the ground so your home, trees fence etc. Think of putting a big cube over your property that will fit the tallest part of your property in, anything in that cube is yours, anything outside is not. Anything above that is NOT yours!

This happened the next county over from me (Lake County). Multiple companies including Walmart have been operating drone delivery in the area due to it being a somewhat rural area. When this happened and the news articles were being posted there was so many people saying this man did nothing wrong and how they would of done the same thing and people were even trying to gather money to bail him out. People don't understand that not only will you get a local charge but the FAA will go after you as they treat drones just like aircraft especially delivery drones. Last I heard the FAA was going after him, pretty much to make an example out of him and Walmart was also suing him in civil court for the damage he did to the drone. One thing that is different is there is multiple witnesses stated he fired multiple rounds at it not just the 1 like he said.

Shooting into the air... bullets or pellets go up and then come down somewhere unintended. Or, say you hit the drone and then it crashes into a swingset and lacerates a kid. We're an advanced and civilized society. If you feel threatened by a drone, call the non-emergency line of your local PD... don't throw spears at the damn thing. I don't quite understand how a person doesn't have the right to knock down a drone if it's flying over an area that you have a right to have privacy. Your backyard is one of those areas for sure ! Are drones just allowed to fly over peoples houses ? Why are they not restricted to common roadways? They shouldn't be allowed to fly over houses like that. You definitely aren't allowed to fire a pistol in the air, I completely understand that .

Rules are getting very strict when it comes to drones for this very reason. But main problem is you own the land. Not the airspace above. I own a drone and love taking it on vacations to get some amazing photos but I’m very carful what I fly over and be respectful to everyone else. But regardless of delivery drone or kids toy it’s illegal to interfere with its flight. Felony just like in this case.

I think that there should definitely be a buffer zone above a house up to 100 feet that should be off limits for any vehicles or devices used in aviation. Those drones are a ton of technology packed into a small superlight package. The delivery drones are not your $300 hobby drones. Also, a bullet hitting a drone is more like a tank shell hitting your car, when adjusted for scale. It would probably total your car, even if it wasn't an exploding round. There is a certain point where fixing something costs more than a new one because of labor costs.

Screw Walmart, home delivery with drones shouldn't be a thing... too many factors to take into account and if it was hovering over his house not making a delivery for ten minutes... that's on them. I believe he tried to shoo it away several times before getting the gun out. The man seems to be overly-honest if anything. Having him face multiple felonies over this is absurd. I hope his lawyer gets him off with no charges. I have no sympathy for Walmart, doing everything in their power to pay their employees the bare minimum and to have their workers doing the work of three or four people. I'll say it again... screw Walmart.

Drones are classified as aircraft under the FAA, and you cannot shoot at any aircraft under the law. Feds have all control of the sky, you do not want to mess with them. It's also wildly unsafe to fire shots in their air without knowing where they're coming down in a residential area.

I honestly don't think this man was guilty of anything except protecting his property. My understanding is that the drones are supposed to take the same route as a vehicle and not be over someone's private property or they have to be a certain height until they reach the property of their delivery. IMO That drone should not have been that low over anyone's except the recipient's property.

@@user-kt6rf7dh6p what laws are you interested in? Drones must stay under 400 ft. They can fly anywhere as long as they are not within a no-fly zone. Like I said above you do not own the airspace above your home. Anyone can fly right above your house

Some Insurance companies use drones to look at the properties they insurance. Those bullets from his gun have to come down somewhere and could hurt someone.
