I live in a high tourism city, and I have felt the housing crisis/Air BnB explosion in that I was without residence for 4 years (with my 3 kids). One occasion, I was standing on the street readjusting my car containing all of my worldly possessions and a group of investors strolled by. They were talking about converting a nearby single room occupancy motel (which keeps quite a few people off the street) into a pricey boutique hot spot. I haven't envisioned swift, vigilante justice as vividly before or since. Thanks for the intel, sis. 😉👌

Airbnb was teetering on the edge when their fees started getting close to the price of a full night, not to mention allowing hosts to set cleaning fees willy-nilly which combined with fees can also double the sticker "nightly" price. Frustrating to sift through each place's final price compared to hotel prices which are pretty straightforward, but i dealt with it for some time. They finally completely lost my business when they removed the option to search only places that offer cribs. I reached out and they told me they had "simplified the amenities list for searching convenience" and I should check EACH INDIVIDUAL STAY for cribs in their amenities list... um, what?! As a mom with littles that's a make or break item for us. We'll steer clear of all the BS and just stay at hotels from now on.

Airbnb outsources customer service to a third party here in Barcelona. I've heard a million horror stories originating from agents who worked on the project. Side note after many many years the company lost the bid to keep Airbnb as a client and Airbnb took their business to a company who offered to pay their agents much less . It's a race to the bottom in call centers. If youve had a rude agent on the phone it's probably because they are underpaid overworked and not given tools by the company to adequately compensate hosts and guests

They're losing in Canada! I was the recent recipient of the ginormous sum of $27 in a class action settlement which occurred due to Airbnb previously not listing fees in booking totals in searches (bait & switch).

I'm in Toronto, we had a case where Host had camera in airbnb bedroom, guest found it then called police, police entered apartment and took camera...thus violating privacy rights of owner. Camera evidence thrown out at trial due to violation of owner's privacy rights. Policy did not obtain warrent correctly.

If you are renting a property... why does the land lord have privacy rights over the property they are renting? It could be a room in someone's house situation but renters still do have rights to let the cops in.

I don’t understand how so many people are allowed to get away with recording others and not disclosing it, especially in the scenario that they’re in a 2-party consent state. It’s very scary - I’ve personally only stayed in one AirBnb and I did feel uneasy there knowing there could be a camera hidden anywhere that may not be obvious to me. On another note, Leeja your house is so beautiful! If you would be comfortable giving a house tour or even a partial tour or just showing us some of the favorite areas or things you have in your house I’d love it!!

I once booked a studio in munich, the host said he's in Australia and he would come after 3 days and we agreed to delay my checking in process. Then he ghosted me and didn't respond to my calls and he cancelled 4 hours after the check in appointment. I later found out that he gave the studio to another guest. Airbnb did nothing but giving me a stupid 50 euros coupon that expired after one month

Fascinating. I remember when Airbnb was a brand new thing, eyebrows were certainly raised, and all of these types of horrors you describe were anticipated... and here we are. I've used the service a number of times, in different cities and countries, but let's face it, it's a weird and troubling business model, and there's no doubt that it has wreaked havoc on housing availability in urban places. I agree that the public should have access to that data, of how the number of short-term rentals affects communities

Anywhere there are compact settlements, population density, access to education, culture, employment, entertainment-- those are urban spaces to me. It's about density. @@TheRatsintheWalls I'm looking on the map right now... Compared to where I live, Davis has density. Many grocery stores, fast food, big box, a few museums, all sorts of shopping and services... That's an urban environment, not rural. Davis has a population of over 66,000. Where I live, there are fewer than 1000 full time residents. On the mountain where I live, there is no electricity. No power grid. No broadband internet. Just solar panels and generators and spotty cellular. College towns are urban, sorry

The hidden cameras freak me out so much and I am so paranoid about them. I travel a lot around Europe and girl let me tell you I go entirely into detective mode searching for cameras, two-way mirrors etc. It's sad that we must be extra vigilant in houses and hotels we are paying to stay in. I would also recommend purchasing a travel-style door lock for the places you are visiting, you don't know who might have a key!!

Just want to point out that, in my experience, settlements happen more often due to the costs of litigation, not because the defendant thinks they’ll lose. I’ve settled many cases for clients that we knew we could win, but the costs of litigating to that stage-or even the costs of drafting, filing, and arguing a dispositive motion-were far more than the settlement demand.

Just started the video. I live in a resort town in the mountains and a lot of businesses are closing because instead of citizens in homes, it’s tourists with no connection to the community that come for a month out of the year. So many homes in my neighborhood are airbnbs that rent out to people from LA who just have no respect for our tiny town.

Wait, how can AirBnB decide the percentage of reimbursement they will give hosts for Covid-19 cancelations if they aren't employees and it's just a platform? They should be receiving a set amount or percentage of the booking, like eBay does for listing, sales, and auctions, not an amount of their choosing.

This is interesting because I work as a planner for a local government and all basically short term rental applications in our locality must go through us. We shepherd each applicant through a somewhat arduous and somewhat pricey public hearing process. I believe that by having multiple elected and appointed bodies examine each application individually in a transparent process in which citizens have multiple opportunities to speak, we curb (but not completely prevent) the problem of short term rentals interfering with affordable housing. But without the data to analyze whether this is true, I can’t really say.

I stayed at an AirBNB once. The host was was renting the place against city & HOA regulations. After AirBNB (did not) handled that situation, I have never used them again and never will.

My experience looking for a rental while we looked for a home was HORRENDOUS. Property management companies are not doing their job and for some bizarre reason owners don’t care. Short term rentals were also a nightmare to even find because we are near a college town that has been bought out by Air bnbs

Hi, I just found your channel and I have recently moved to an area that has many air bnb listings due to the tourism factor here. I know someone who is a landlord and I overheard them talking about how as soon as our lease is up they are probably converting this shotgun house into an air bnb. It doesn't make any sense, this is a fully functional small family home in a neighborhood, not an apartment or room right on the edge of all the stuff happening in town. It kind of disgusted me when I heard it because she is knowingly displacing us and future families who need and can barely afford housing, to convert this into a revenue source for her that makes far more money than just renting out normally. Its happening everywhere here, people renting shitty little rooms in their house for over 900 a night just because some event is happening that weekend. I don't understand it and I wonder when it went from an actual service to help people find temp. housing on vacation or travel, to landlords intentionally taking suitable family housing and converting it into a vacant lot that cycles people in and out all the time.

It was always going to be that. This is what unregulated capitalism does, the pursuit of profit trumps everything else. If you allow people to have child labor they will, if you allow people to make a shit ton of money off renting out starter homes they will. Thats all there is to it.

The original model of renting out an extra room, is now just 20% of their business model. I was ok with that, and even renting a second home. But no LLC should own residential housing, particularly for commercial purposes.

Montreal recently passed a requirement of a license to be able to put a listing on airB&B, after a house fire in a historic building killed the tenants, due to improper safety exits and ventilation. I think it states in it that the resident can only put either a vacation home or their main property up, and if not they need to register with the rental board. It only goes in effect I think in September, but I wonder how much money will be put into actually investigating the listings.

Arbitration sounds like a scam: a process where one party of a contract gets to call the shots on how contract disputes are handled, but that one party has a basic monopoly on the good or service so the other party doesn’t have any way to avoid arbitration

I had an Airbnb planed this weekend. I got there and was immediately told by the security officer that the condominium association forbid Airbnb from being outlet there. He showed me pages and pages of emails that had already been sent to Airbnb to take down listings within the address and how the person I was using was currently being evicted from the room I had booked. I had to spend my entire night on the phone arguing with Airbnb and the “Host” to finally be put somewhere else for free. This was an issue that was first brought up in December 2021 it’s now August 2022. I was in a town I didn’t know with no where to stay.

As someone who works in the short term rental sector, I can tell you the the owners and property managers hate Airbnb just as much. Guest throws a drug filled party trashing the place and Airbnb gets caught up on if two or THREE glasses were broken. We provided a three min video tour of how the guest left the place (by the blood they’d had had fight club in the living room,) and they still won’t honor their host guarantee fully. Honestly they’re failing on both ends of the spectrum.

I went on vacation to a coastal city in California and the *nice* AirBNB offerings in the area were similarly priced to the swanky hotels in the area or higher! Even some of the broke down, raggedy cubbyhole AirBNBs had the nerve to charge astronomical prices in some cases Everyone’s experiences are different, there’s no need to insinuate they made it up/are imagining things

For my last airbnb stay, the street was entirely flooded for the first day and since I didn't own a boat or a helicopter - my bad - I couldn't get to the property and I paid out of pocket for a hotel for the first night. The host or Airbnb were entirely unhelpful and didn't offer any apologies or refund. And the host is a *superhost* too. I would be fine with all this if Airbnb didn't also take down my entirely factual and relevant review for my stay. Theyre really asking for a class action lawsuit with that level of deceit.

I've always used VRBO and had awesome experiences. I read bad things about AirBNB years ago and also noticed their fees were higher most of the time. I have never had any issues with VRBO and highly recommend using them.

The Australian Competition and Consumer Commission took Airbnb to the Australian Federal Court over misrepresentation issues regarding prices. The website was listing Australian accommodation in US$ instead of AU$, so people were thinking the cost was $500 when it was actually closer to $700 due to the exchange rate. They were slapped with a stern warning that Airbnb must not mislead customers and must make accurate statements. I can't find any solid references, but Airbnb has made the media headlines a few times in Australia for getting themselves into strife with Australian state government and local councils, as well as Fair Trading and other such regulatory bodies. It would be interesting to compare different countries and how they each deal with Airbnb, as I can't imagine the company getting away with these types of things mentioned in the video in every part of every country in the world.

I am a host and had a dangerous person in here. Airbnb didnt do anything to get them out for 3 days, until I involved police and escorted the trespasser. Despite everything and evidence Airbnb let her keep the money refunded and took it from my payment. Disgusting

So, I think the arbitrator not considering the air bnb public housing is an example of the law not keeping up with the times. The minute the host posted their property on air bnb, imho, they opened themselves up to the same legal requirements of any hotel chain. But ianal, what is your take Leeja?

I think you should do a video on mastercard & visa charge back provisions. I'm a banker and have dealt with shady companies such as ABNB and other online platforms and successfully got refunds dealing through the credit card companies. Just a thought.

This was an excellent presentation, Ms. Miller! (You have a new fan!) It's time to curb the Airbnb monster here in Cali, in particular. I spent 5-6 months living almost exclusively in Airbnbs after relocating here, and the abuses by both hosts and Airbnb policies are amazing. I plan to make cutting Airbnb down to size my hobby (everyone needs a hobby, and this one just might help consumers). And it's also time for Congress (lol) to amend the federal arbitration act, which corporations use as both a sword and a shield to screw consumers.

Can a host sue them? They have stolen 10s of thousands through gross negligence, rewarding scammers, leaving support cases for a month or over, up to 20 support staff for a simple issue, the app glitches, outright lying to me , changing descions , no clear resolution on policy agreements

The reason why short term rentals cost more than long term ones shld be the expectation of well maintained, safe places with decent anemities that you dont have to worry about for the night. Hotels usually have staff on shift, cleaning services, sometimes security as well as licenses to operate these short term rentals. Airbnb does not do any of this but charges hotel prices for potential perverts to spy on u :((

Airbnb keeps winning because the LAW is on their side - SIMPLE. People keep on suing because they think it's somehow easy money. But they find out otherwise, don't they?

i live in Guanajuato City, which is both a tourist and a student town, however, many clauses given to students are abusive such as needing to see your grades in school, for them to forbid you entrance into house after hours(Cinderella hours), having cameras all over the hallways and that way, knowing you brought someone. I used to think that these rules were somewhat normal when I was 18. now as a 25 y/o I no longer think so (and for the prices they charge , they should be giving us the royal treatment), how can we be real adults signing contracts while having to follow children’s rules? I know you are a lawyer who is in the states however I value your opinion, I wanna know what do you think about this? sorry for the not so great english, it’s my third language:(

I am a 10 year veteran, who has rented rooms in my home, as I became an empty nester. I have some horror stories, but most guests are truly wonderful. But recently I had a guest who resembled a person who walks around downtown smelling and mumbling to themselves. When I tried to get help, Airbnb was useless, telling me to call 911. The problem was, as the guest informed me when I finally asked them to bathe, they hadn’t broken any house rules. When I reached out to Trust and Safety, I was suspended for not following the Inclusion policy. My review was removed, and I was threatened with deplatforming. So, the protected class, no matter how dangerous and delusional, are being allowed to wreak havoc for hosts. It was very traumatizing having to host this person because bathing, babbling to oneself, and going into the front yard and dry humping the moon in front of my neighbors, was not in my house rules. So this will be my last season, and in the fall I will get a roommate, and sell my stock. Airbnb isn’t taking care of their hosts, and putting them and their property in danger.

Are there any real benefits for the majority of The People for arbitration? I remember when I was working at Best Buy we got a notice randomly one day that we can't sue them in court, whether or not we agree to it or sign off, and that employment counted as consent.

Any potential benefits are swallowed up by the massive power differential between a corporate and individual. Arbitration is far too powerful for corporations at this point-it’s a free pass to discriminate/violate civil rights and ignore numerous other laws/crimes
