1985, L4-L5-S1 fusions. I was told the surgeon would chip and shape bone material from my hip to create wedges to place between the vertebrae. I was “good “ for 20 years. (good in quotes because I was always in some level of pain). Though the pain was in the area of a 2-3, kind of like a reminder, dont do anything stupid. A little electrical stimulator was implanted, about the size of a large caliber bullet. Four wires are still in me, I have the stimulator as a souvenir. Here’s my current situation. (original pain on my left side), currently pain is on my right side and it’s approaching level 9 again venturing into level 10. Moving from a horizontal position to a vertical position brings on level 9, I feel level 10 if I’ve been horizontal for an extended period of time. I’m currently working on an old Chevy, and in doing so I’m on a creeper, getting in and out of the car, and handling parts and tools of different weights. I am taking care to not pickup or carry the heavier items. I am on 100% VA disability, PTSD, and Agent Orange exposure. I’m looking for recommendations from you. Thank you.

I had L4-S1 Discectomy with fusion and instrumentation in Dec 1993. Rods, screws, bone graft fusion. I was age 33. It was a workers comp case. Back then, when I had my follow up meeting, I was classified as 60% permanently partially disabled. At that time, comp did not give monetary settlements for back related injuries but gave coverage for life for any future medical attention for it. I was told by my surgeon that I can expect to have Adjacent Segment Disorder as a result. The areas around the surgical area take the strain, especially above and below. I saw the surgeon at least once a year. My problem was from below at the Sacroiliac joints. From ‘93 till 2015, I worked full time doing HVACR. I retired from that in 2015. I also had a part time job driving a charter bus and had to give that up in 2021 after 36 years. The pain from the SI joints got too severe. I had a Spinal Cord Stimulator implanted to address the nerve damage pain in my lumbar area and down my legs. I had Si Joint fusion on both side Dec 2023. I will be having Cluneal nerve block injection next month. My point here is, I’ve had issues as I got older. I’m now 64. I’ve been covered by comp for those years. And will continue to be, though I may need to fight for it sometimes. Now, only a few months ago, I got a letter asking if I would consider a buy out of my case, basically taking money and close the case, giving up any future medical payments from comp. They offered me…………..$5200.00. Obviously I turned that offer down. So nowadays, they offer payouts after a few years instead of lifetime coverage. That payout has to be solely for future medical issues pertaining to the comp case. Who knows if it will cover 30, 40 years or more. It could cost millions….

I’m 41, and working with my doctor to plan a 360 fusion at L5/S1. I wish I had someone to go after for a settlement, but I don’t think I’d be successful going after genetics and lifestyle mistakes. The MRI report makes it seem so mundane that I wonder if my pain level is appropriate for my level of damage “L5-S1: 5 mm broad-based disc osteophyte complex. Mild left neural foraminal stenosis. No significant spinal canal stenosis” Wording like “mild” and “no significant” make me wonder if it’s bad enough to cause me to have days where I can’t get out of bed, or make it impossible for me to do things like clean my legs, or at times to be able to control my bladder.

I see my doctor every 3 months and am on prescription medication for this still. I haven’t heard from my adjuster in a couple years. Very strange to me. Not sure if I would settle because everything I’ve read and several friends with this surgery have told me or have had to get further fusion surgeries later on. This surgery would most likely be more than any settlement.

There is an art in timing settlement. It depends on issues such as whether your still working at that company, whether you have health insurance, and whether or not you are on or have applied for Social Security Disability. Do not settle such a case without consulting a comp lawyer. If it's done incorrectly a lot can go sideways.

Fusions are actually not the best option anymore because they cause deterioration of surrounding joints. Disc replacement surgery is becoming the preferred method because it allows similar mobility to your natural spine.
