Just for the record, In Wisconsin, it is unlawful to apply the brakes unless there is a legitimate reason to do so. It's amazing how many rabbits and squirrels have tried to cross a highway since this was enacted.

Having someone on your rear bumper is a legitimate reason to slow down. It's not safe to be doing 60mph with another vehicle 5 feet from your bumper.....so you have to slow down. If you slow down a little quicker than the person behind you is expecting that is their fault, not yours!

@@gregbarry5875 As a former professional driver AND a former Driver Education Instructor, I can say that you are using flawed logic. Being tailgated is NOT a reason to slow down. Even if this happens in the rightmost lane. You have an obligation to do everything possible to AVOID a crash. Hence, maintain your speed. If your in the a leftward lane, then maintain your speed, signal, and move to a lane to the right. Don't be another "headache" on the road. Sudden and/or abrupt speed changes are dangerous and can affect many drivers at the same time.

@@beksbrat When I had Driver's Ed a long time ago, they taught the "Fundamental Speed Rule" which said you have to drive the appropriate speed for the given conditions. For example if the roads are snowy, the posted speed limit may not be safe and you are expected to slow down. I am saying that driving at 60mph with someone right on your tail is not safe and you are obligated to slow down.

Probably not. People who do that are hyped up either on caffeine or energy drinks. Some are just type A hyper active people. A woman where I worked did that EVERY day on the way to work. She finally hit somebody who braked for a deer that ran out. Six cars stopped to make sure the cops got the story right. She tried to blame the guy she hit. Six people were willing to make statements that she was tailgating and that they had seen her tailgating numerous times. Cop got the message. He found three more things with her car ticket her for. It cost her a bunch of money and her insurance about doubled. She was dumb enough to whine about it a few months later.

To be fair, both drivers in this video are idiots. 3 mistakes are made here, in order of severity: 1: The front car should have gone to the right after passing the truck. Dont let an arrogant idea of "I drive the speedlimit, i don't need to move over for someone who is speeding" lead you. You are not the police. 2: Tailgating for obvious reasons. Keep your stress levels in check and don't drive dangerous because of it. 3: The breaktest is the worst by far. The driver is purposely causing an almost certain crash. This is inexcusable. If you really, really feel the need to let the tailgater know your feelings, use your windshield sprayer or ease of the gas and slow down gently. (although i don't recommend the latter either since it will likely cause more aggressive and dangerous behavior from the other car)

This only shows me that the guy in front was not intelligent enough to remove himself from the equation. He had full control over whether someone was tailgating him or not. He could have just pulled over to the right and let the tailgater go on and be an idiot somewhere else but he had to cause an accident that could have cost the lives of everyone in the tailgating vehicle. Speaking of which, you are aware that driving is a privilege and not a right, yes? Because when you uphold that privilege, you're bearing responsibility of yourself and your fellow drivers, should something directly or indirectly happen because of you. What if this guy had to apply the brakes for something legitimate? If it wasn't a break check, the tailgater would've plowed right into the rear of the leading car; it would've done serious damage, killed the tailgating driver and their front seat passenger, and possibly injured everyone else. There's a point to be made with this crude method of road-law enforcement, and it's a point that was once voiced in a Reddit thread for this particular video: If all you can do is swerve after being break checked like that, you're way too close.

US highways/interstates are DESIGNED to be driven in the right lanes, left are for passing/overtaking PERIOD, which is also coincidentally the LAW in nearly every state. This isn’t about how you FEEL about others speeding, it’s about safety, PERIOD. Fast drivers shouldn’t be overtaking on the right because you’re upset they’re speeding-the safer of the two traffic violations. Get over yourselves.

@@audieconrad8995 I had a tailgater once that got mad after I started slowing down (did not brake check) and after he passed me on double lines he slammed on his brakes several times in the next couple of miles and nearly wrecked us. I had two littles in car seats at the time and he obviously didn't care. I have no sympathy for anyone who pulls any stunts on the highway and acts like stupid children.

I remember doing something similar to this some years back. It was mid winter. Snow thick on the ground. I was taking a shortcut through a park. Lighting wasn't great. I was driving for the conditions. Saw the lights of a car behind me, in my rearview. He got closer and closer. I pulled over slightly to let him pass. He didn't. Instead, he planted himself on my ass. And then put on his main beams, blinding me until I lowered my rearview. He stayed like that for a bit. Finally, I had had enough. I reached over and flicked on my rear fog lights. Which would have looked to him like I had braked hard. So *he* braked hard, and spun off the road into the snow embankment. Where he got stuck. I might have laughed as I drove away.

@@astromec6303 What if you ARE already in the right lane, the left lane is clear, and they STILL tailgate you, because they are too lazy to change lanes and pass? What do you recommend in that situation? I ask since it happens to me nearly every single day (and keep in mind, I'm already speeding by 5 miles per hour, so I'm not going obnoxiously slow or anything). Side note: I almost never brake check in those situations, because I don't want to get killed. I just give a big, sarcastic wave that I know they can see, and keep scooting along. But, I'd be curious to hear your thoughts on that particular scenario. Thanks.

Yet, there are ALSO laws in place that state cars are to remain a specified distance between themselves and the car ahead of them for safety. So, you can't complain about the front car breaking the law by not moving to the right, without ALSO complaining about the tailgater who is ALSO breaking the law. Both are breaking a law, not just one.

If you think the brake checker deserves a special place in hell, what would you recommend for the tailgater, who is the reason for the brake check in the first place by breaking minimum safe distance laws? You must REALLY think they deserve massive punishment in hell then, since what they are doing is much worse than what the brake checker is doing, right? I had somebody tailgate me like that when I was already about 20 mph over the speed limit on the freeway. He wouldn't go around me either. Suddenly there was a piece of lumber laying in my lane...I swerved, he hit it and rolled a few times, off into the desert. And no, I didn't do that on purpose, it was just a case of instant karma.

Stephen Pain - since you are jumping in here, I think you must have meant to cite what state has a 10 year penalty for a brake check, which was the original statement. "Many states...?" Actually, all states have traffic laws about reckless, as well as increased penalties for bodily injury. But a 10 year sentence would be associated with serious felony charges, not a traffic offense like a brake check.

Can't stand it when people tailgate...especially when we're all in close quarters traffic and cruising at nominal speed. Very dangerous for everyone.

@@Sweetheartbabez While the rear vehicle was tailgating at a very unsafe distance, the cause of the crash was the unnecessary and reckless application of brakes to purposely affect the driver behind him. If the video was seen in a civil suit the front driver would be more than 50% at fault, therefore being his fault.

I never claimed to tailgate myself (I don't) but I have felt the frustration of wanting to use the left lane to pass but can't because the driver in the left is going the same speed as the drivers in the right and I can definitely see how people justify tailgating, I don't because it's dangerous. I love this. My personal favorite way to deal with a tail gate who is pissed that I'm not speeding however fast he/she wants the road to go is to literally start slowing down in 5 MPH increments. Drives them nuts. Best reaction to this ever was the guy who got so focused on shooting pass me when I had slowed down 25 MPH and getting back to his preferred speed quickly (likely had the pedal floored), he completely missed the cop in the emergency crossover lane. Got pulled over in just a few miles.

Yeah, only get that close to another vehicle if you also are using your turn signal to get into the next lane very shortly after (and even then, your nose shouldn't be inches from the other car's butt). I've had people tailgate me when I'm doing 15 over the speed limit on a interstate that turns off shortly into another interstate. 15 over, and we're all getting close to the exit, you need to hold your horses. Once I'm on the next interstate, the exit I need is on the right so I'm happy to go slow and remain in the right lane and they can zoom ahead in the left. But I'm not moving over for 60 seconds just to need to get back into the lane again when I'm already risking a ticket just to let someone impatient pass. Not just that, but traffic for that exit can be thick and I've seen idiots bully semis to nearly keep them from merging in for that off-ramp. Getting over to the right can often mean squeezing back in is going to be a pain in the ass. Normally, I'll get over and let them risk the ticket (and I've seen glorious justice when an officer catches them). But that particular area is just stupid to rush someone when it's not that long of a stretch before the interstate breaks off and we all need to be in the same lane anyways.

Not defending the tailgater but this accident would've been avoided had the slow driver been in the right lane where he/she belongs. I realize there was a car merging onto the interstate but they still had an opportunity to move over. Instead they hit their brakes contributing to the accident. Neither party is innocent.

The "slow driver" was using the passing lane as it was meant - passing a slower vehicle. If the tailgater had just been patient for 10 seconds, he would have had the lane free again, but NOOOO, he had to be a dickhead immediately.

I have high beam LEDs on the rear of my car that a previous owner installed. They’re linked to the reverse lights (they did it because they were parking against a wall), but it also has a toggle switch. Perfect deterrent for tailgaters. Sad to be selling it.

I know this case. The person "tailgating" was driving his wife to the hospital in labor (water broke) while that slow poke was "parked" in the left lane not letting anyone pass saying "speed limit is 60 and I'm going 58 that's fast enough" So everyone get off your high horse and use your brains. The left lane is for passing and fast traffic only. Studies have shown slow drivers in the fast lane are more dangerous on the roads than speeding drivers going fast with traffic. Seriously. So please just drive right and use left for passing.

Obviously untrue. The "slowpoke" as you call him was in the left lane to pass the dash-cam vehicle and was moving at least as fast as other traffic, and the tailgater was only about a car length behind and closing. If his wife was in labor, he endangered both his wife and the baby (and himself) with his reckless, aggressive behavior. That said, doing a "brake check", while satisfying, is also unsafe. Best to stay off the brakes and move back into the right lane and let the tailgater pass. But all my sympathy is with the "slowpoke".

Drives me nuts when people follow so closely. I'm a commercial driver and see at minimum 3 accidents a day, usually caused by people tailgating or attempting to cut someone off. The average following distance I see on the freeway is less than 0.5 seconds. Even in my personal vehicle I would never leave less than a 3 second following distance. I've never had an accident, but my following distance has saved me more times than I can say. Please be safe out there people, if everyone drove legally we would cut down traffic jams to almost nothing. 2 seconds isn't worth someone's safety or life.

The best way to avoid a tailgater is to remove yourself from the equation/move over! The tailgater could have gone on his way to be an idiot someplace else. An accident caused by following too close, is always the fault of the driver... following too close. Law requires that you maintain a safe distance between you and the vehicle in front of you (even if they are slow) and also that you maintain control of your vehicle.

ROTAXD It's very simple. I didn't even notice he was there. I saw an animal run across the road, and hit the brakes on a panic. If I knew he was there I would have already moved over to the other lane. Don't answer any questions till your lawyer says it's okay to. Like on the stand. They basically have to get you to incriminate yourself to prove this. So clam up, and do what your lawyer tells you to. They'll probably have an even better explanation. But how can they prove there wasn't a mouse, or something? You have a right to brake. Just not on purpose to harm someone.

YES the rule is 1 car length for every 10 mph over the speed which you are going, i my self have a 3 second rule in where i count how long the car in front of me passes a object and then i count how long it takes for me to pass the same object and it will have to take 3 seconds for me to reach the same object that is the best way to keep ones distance.

I'm going to go against the grain here, but the driver hogging the passing lane was the precipitating event here. You notice that the silver minivan moved back over to the right when they got done passing the semi, but the hog just camped in the left lane with no sign that they were going to ever pass anyone. No, tailgating isn't smart, but the brake checker is the real asshole in my estimation. Passive aggressive to the max.

The lead car just passed the truck at a smart clip. He also no doubt saw the overpass and realized someone might be coming down the ramp. He was ok with being in the left lane. The tailgater should have backed off.

Law states if you’re merging onto a highway you should match highway speeds and find a gap... left lane is for passing, right lane is for slower traffic. Blocking the left lane = slower traffic both lanes = bad.

I used to brake check the a holes, but figured out a couple of things. I just move over now and let them go. 1. You are not going to change their behavior. They will still be a holes. 2. You are putting yourself and them in danger. 3. They will not see them as the one causing the problem and it will probably escalate. I loved the video though. He got what he deserved and I wish it would happen to all of them.

The tail gater was probably being a jerk before this, but based just on the video I think the brake checker is wrong. He is in the passing lane and passes the 18 wheeler pretty quickly and going fast enough that he could have passed the mini van in front of the 18 wheeler in a short amount of time. Instead he slows down to just slightly faster than the 18 wheeler. Now normally I would suggest getting over if you are going to slow down that much, but with the car coming on the freeway that would not have been a good choice. With the brake checker slowing down, of course the car behind is going to get closer and slowing down that rapidly will almost garauntee that. Then brake checking them is very dumb with a car that close to your rear end. If they do not slow down enough, then you are getting rear ended and not only that you are endangering the other people on the road like the car that just got on the freeway. Its not worth the time (if it fails) to teach an unteachable person a lesson. Especially putting innocent people in danger. Just do what you need to get out of their way and move on with your life.

You're on the right track realizing that the brake-checker was put in a tough spot with the new car joining via the on-ramp. You're also right regarding B checks- you should actually Never brake-check on the highway, it is just Too dangerous- it's bad enough on city streets. And even more than being a "jerk", the tailgater was Very wrong- at those speeds, that is also Very dangerous and should Never be done (if there is an Extreme idiot crawling in the passing lane, use your horn, bright lights, etc, but Never tail that close on the highway). I think the additional angle you're missing is that the brake-checker had just sped up to pass the 18 W, and was now slowing down to determine if his desired "cruising speed" justified passing the van. (Like all GOOD drivers, you don't want to pass someone at your *temporary* passing speed only to learn that your cruising speed is Slower than the car you just past- and now they have to pass You; it's better just to file in behind them- but again, in this case, the new on-ramp car put him in a squeeze).

There's also a reason everyone moves to the left lane when there's someone merging into the right lane. And the tailgatee had just passed a semi on top of that, justifying their use of the left lane. They had no opportunity to get back into the right lane safely because of the merging vehicle. If the tailgater didn't drive like a dick, they probably would have been on their way in a moment when the driver had an opportunity to get back into the right lane.

In all 50 states, it is illegal to drive in the left-hand lane with certain exceptions. Generally, those exceptions are when a driver is passing or overtaking a vehicle or making a turn. Some states additionally require that a driver must go to the right-hand lane if they are moving slower than the flow of traffic

Was you riding in the passing lane, holding everyone behind you up? Thats about the only thing that pisses people off that bad. The gene pool is getting all kinds of fucked up with brain dead idiots, and its frustrating. We have to share the road with them and they are so dangerous. They create traffic jams everywhere, and you have to squeeze through a little gap to get around the retard hoping the person in front of you doesn't hit their brakes. Seriously dude, pay attention and have some courtesy for other drivers. Not everyone has time to pussyfoot through life. Some of us work long hours, and we want to spend some time with our familes too.

@Dirty Harry He was in the left lane. Its pretty obvious, and yes often times it is good to run a red light. Especially in towns that have outdated lights, that dont work correctly. You just look and make sure its ok. Also if someone is tailgating you in the right lane, its ok to give them a decently light brake check, if they continue then do it harder. I did this once to a guy who kept tailgating me and eventually I got mad and slammed my brakes to a complete stop, and i saw his coffee go all over the front window lol. I gave him like 5 hints to back off. Traffic jams are way more dangerous then speeding. Having 20 cars with half pissed off drivers stuck in a bundle is dangerous. Having to squeeze in little gaps to get around an idiot is extremely dangerous. People need to drive correctly, it helps everybody, saves fuel, is way safer. Driving correctly isnt following the law, driving correctly is driving at a speed that is engaging, and paying attention to the other drivers, keeping right if you have cars coming up behind you. Things like that. I saw a wreck once where someone was blocking the passing lane, and got in an accident with another driver trying to squeeze through, and it backed up traffic through 5 states.

I'm sure he knows to merge back over. That doesn't give anyone the right to tailgate and endanger everyone else. Even if someone was in the passing lane be the bigger man and go around, what are you going to accomplish by tailgating other than risking your own life? Hopefully the people that hog passing lanes get a ticket that teaches them to only use it to pass. Just like how police need to start pulling over tailgaters.

Well to be fair the driver was in the left as traffic was merging into the right lane from the exit, there was nothing wrong with them being where they were. Driver riding their ass was a moron. I know, because I tend to be aggressive like that, but not that damn close on a highway. You drive in front of me at the speed limit or faster, I'm good and won't fill your mirror.. You drive 1 mph under the limit and I will be passing you as soon as I safely can. lol Or if you are one of those that can't keep their speed consistent and constantly force others to adjust because you keep slowing down and speeding up. Use your damn cruise control if you have no sense of speed control. Or driving distracted.

why do you call it a slow lane, both lanes can be driven at the speed limit. it is not a slow lane. along with tailgating, peoples knowledge of the highway code is very lacking. a lot of drivers think "what they perceive" as the slow lane, is not for them, but just for lorries. like tailgating, lane hoggers are the danger on the roads. the car in front, was not a lane hogger btw. he was approaching a slip road joining the motorway, and with a slower moving vehicle about to join, he stayed in the left lane. the tailgater should have been aware of this if he had given himself enough room. but because they have no regard for other road users, any action in front of them makes it impossible for them to react safely . pure idiot in my view.

April 4, 2019----When I was a kid, our neighbor Cho Cho Charlie installed wiring/switch for his brake lights for people like this. When a tailgater was on his ass, he simply hit the switch, brake lights came on but brakes were never engaged. Of course, this was back when everyone had a dial phone, phone book, etc.

And even if the tailgater had a dash cam, how's he going to explain why he's up the other guys ass when he turns it over to the cops. The only problem with this is that when you tap your brakes, you ever so slightly slow down which may lead to getting rear ended. There's a better way. Instead of hitting brakes, just reach down and flip your flashers on. The minute they come on looks like brake lights and will have desired effect without slowing your car and risking rear end damage.

My sister's ex had a 71 Charger. He was driving through town one day and someone walked out in front of him so he hit the brakes. Right on his ass was someone in an Escort. The head lights lined right up with the heavy chrome bumper on that big Dodge. No damage to the Charger. The Escort however required a tow truck.

Hopefully someone in the comments(over 7,694 atm) was smart enough to point out, this may make you feel good, but what about the other people that almost got nailed because of the stupidity of the situation? I promise this, I have been behind those that hog the left lane and never move over when there is clearly room to do so and it is friggin annoying. I have also been tailgated for no good reason other than the people are A-Holes. I have been the observer of this kind of FN road rage BS from safe distances.(and the victim of it) And something I learned in defensive driving has never left my mind: Cannot make an insurance claim if you are dead from stupidity! In other words for those that need that explained, there is zero good reason to get into a road rage situation. It can cost lives(yours, theirs and everyone around you)and in the end, the only one that cares about right and wrong is the law and insurance company. Which will do zero good to the dead!

minombre esnada actually, if the brake checkers vehicle was not struck, he had no obligation to remain on the scene as he was not involved in the accident.

He shouldn't have been so close to begin with. However, he got off lucky with that crazy maneuver.
