For you lawyers who seem to struggle with the notion of causality: if Trump hadn't sent his "come to DC will be wild" tweet and hadn't whipped up the crowd, would anyone have been attacking the Capitol that day? It's amusing how the right wing fanatics at Opus Dei and the Federalist society are allied with people who rail against the supposed wishy washiness on truth of modern philosophy, while they themselves have no respect for truth. And just btw their impression of modern philosophy reflects a failure to learn anything about the field, and particularly about Anglo-American analytic philosophy, which views the French philosophy of the 20th century with utter disdain

We are up against the Federalist Society. which is committed to a unitary executive branch. Sooner or later the Senate has to expand the Roberts Court, or democracy will not survive it. Violating sovereignty. Political assassinations. Destroying civilian infrastructure with no military necessity. Targeting civilians. Disproportionality. Torture. Extrajudicial executions of unarmed prisoners. Rape. Deliberate starvation and withholding of water, using multiple targeted means from destroying almost all water sources to deliberate ruining of agricultural land to killing drivers after they coordinated their trips with the IDF. The pager stunt was an illegal act of terrorism due to clear lack of discrimination of targets, and the use of common objects as booby traps. The law is plain on this.

I think bringing the case sooner might have been better because the Supreme Court has become more emboldened, irrational, and unlawful over time. There’s a chance they wouldn’t have dared do this a few years ago. But perhaps that’s not the case.

Doesn’t the Lawfare analysts feel at all responsible for identifying redacted witnesses. They are redacted for a reason. Would Lawfare at all feel responsible if any of the redacted witnesses identified by Lawfare are docsed, SWATed, or worse?

These aren't secret witnesses. They're redacted because it's DOJ policy to redact or not directly identify names of those who are not indicted. If you read the brief, you'll see that they leave in place descriptors that clearly identify them by position, quote, or other references that make it trivial to identify them.

Hezbollah's attack was from a desire to degrade Israel in a war of attrition so Israel can later be completely destroyed by Iran/Iranian proxies. Displacing 60-100k people, setting massive fires in the north, disrupting most farming/business activity is not something coming from a "good place". Hezbollah itself was also planning an October 7th style attack that was thwarted by Israeli mobilization. The Israeli response to October 7th in Gaza would have looked the same regardless of whoever was the prime minister. When someone brings 3k-6k troops into your territory, kills 1200 people, and kidnaps several hundred more the government must respond. If the government doesn't respond, they'll be voted out of office and a government who will do something will be put in place. Imagine you live in the south of Israel - would you go back to your home? Not until Hamas is gone.

@@maryann2970 yes, it was a much much better discussion! And they used appropriate words, in contrast with this group, who keeps calling a certified terrorist “charismatic leader”. At least Dan knows that reported “casualties” don’t distinguish between militants and civilians and they don’t cry a river over “displaced” refugees in Lebanon after being silent for a year about 80-100 thousand displaced Israelis! Disgraceful podcast from Lawfare which only makes my decision to change party affiliation more solid!

@vintageglee6406 That "certification" is limited, not universal---and since none of the "terrorists" are firing on civilians nor civilian structures (unlike the IDF) those Israelis now safe in hotels will actually have homes to go back to.
