I'll never forget the day I got pulled over and the cop word for word told me exactly what he thought happened in the car prior to him walking up. I looked him dead in the eye and said well that's a good theory. Can ya prove it? And he said have a good day. With a quite pissed look on his face cause the guy he pulled over knew the system 😂

How do you respond to "Oh, you want your attorney present? Who's your attorney" or if you choose to respond with "My attorney advised me not to answer any questions without him present; May I call him now?" If you do not have an attorney on retainer or a relationship with one? Who do you call if you make that assertion?

Got pulled over one night, so I pulled over and drove a little further to get under a street light. Put on my flashers, turned the truck off, rolled down my window, turned the dome light on and put my hands on the wheel. I watched the officer’s face change as he got up to the window and saw that everything was open to view. He asked for my info and asked if there was a reason I crossed the line and went back into my lane. I told him he’d no answer except I just had no answer. Asked if I had been drinking, I said nothing but coffee and if he checked my caffeine level I probably would be in trouble. I laughed and he did so. Told me to pay attention and have a safe trip home. This was the first time I actually saw an officer’s face actually change as a result of my actions.

An officer pulled me over for expired tags. I tried to inform him it’s normally just a work truck i use around the house but the jeep was still waiting on a radiator so I had no other choice. I showed him my valid ID and proof of insurance for the vehicle but instead of writing a ticket he sat there waiting forever on back-up to arrive. Next he asked to search my vehicle. I said “I do not give consent to search or touch anything, want to speak to my lawyer, and not him any longer. He said i wasn’t allowed to speak to a lawyer until he said so and continued questioning me. I answered that I didn’t want to talk to him anymore only my legal counsel but he still refused to let me call my lawyer. Then he asked me to exit the vehicle I said no thank you I feel more comfortable staying in the vehicle so opened my door and pulled me out. Everything escalated from there. He became extremely hostile bending my thumbs behind my back to make me pull away trying make it look like I was resisting arrest. Said I was acting nervous so they started searching my vehicle and me without consent or a warrant.

Hi. Thank you for sharing. I am sorry to hear that you were mistreated by the police. Overall, I think you handled a difficult and scary situation well. However, if a police officer tells a motorist to get out of his or her car, the law requires that you do so. I understand you were uncomfortable and felt unsafe; I would have been too. But there was a Supreme Court case in 1968 that stated the police are allowed to order civilians to exit their car if ordered by an officer, and the motorist must comply. Otherwise, the cop might arrest the person for not exiting their car. I am not being critical of you. I know that is a scary and tricky situation to face. I'm just telling you what I learned.

Very good video but in rule #3 you said only answer basic questions. What is a basic question? What are you talking about? Are you talking about a question such as, "What is your name?" Or what? Where is the dividing line? One person may think basic questions are very different from what another person thinks. You might want to address this. Thanks for this info though.

Are you sure it's a good idea to answer "basic questions"? If so, you might want to do a video on just that. I will never answer questions with statements or a simple yes/no. I'll respond with my own questions to gain some clarity on things like their questions, answers, statements, orders/commands.

Any Lawyer Worth His Salt will tell a suspect in no uncertain terms to never speak to the police under any circumstances. Straight from the Supreme Court Justice Robert Jackson. When stopped by law enforcement always envoke your 4th, 5th and 6th amendment.

I was arrested for CPW2 and the gun was not on me or under my exclusive access and control over it. It was thrown from a car 4:29 by another person while I was inside a store shopping around. I invoked my right to remain silent and asked for a lawyer. They said ok no problem. After I got my Discovery I seen they completely fabricated a full confession but obviously it's not signed but they say I never asked for a lawyer but fully confessed to everything. What do I do??

It's my understanding that if you say that you will answer questions once your attorney is present and then do not answer those questions, it can be used against you.

When the police put you under surveillance in your apartment, they take away any chance of a person withholding anything. The police try many cases this way but to stop them requires a trial or it goes on forever.

What are "basic questions"? What rights do foreigners have when interacting with the police? Let's say I'm Danish, I go for a vacation or a business trip to Texas, rent a car, get pulled over. I'm there as a non-citizen detained in a car that isn't my property, then what? In this case how long is it reasonable to detain me if there is even a limit? Can I refuse to let the car to be searched? Do I have the right to remain silent? Do I have the right to legal counsel? Do I have a right to an interpreter? As a foreigner I'd expect to start at a higher baseline suspicion and have fewer rights than a citizen.

My viewpoint is a bit different from yours. I do not believe that an innocent person should have to spend one penny to defend themselves. It just doesn't seem just for an innocent person to pay an attorney when they have not broken the law. OK, OK, I know that Public Defenders are just one step above worthless but I honestly feel that I would die before I would pay to defend myself. No, I would not go to court Pro Se and try to defend myself. However, If the court appointed me an attorney, I would make sure to tell the judge that I and am also going to act as co-counsel. That way, if I get a buffoon for a public defender, I would also be allowed to question witnesses. As far as Bail is concerned, I would tell the Magistrate that I would like to be released on my own recognesece unless the juridiction would like to be responsible for my healthcare while being held in jail. Since I'm 78 years old, you can bet those expenses could be quite large.

Contradictory information,...at first he says be quite dont talk,...then he says answer basic questions,...yes or no. Best advice is SHUT UP,...DON'T TALK,...YOU DON'T HAVE ANSWER ANY QUESTIONS,...EVEN WITH YES OR NO ANSWERS. The cops can trap you by the way they asked the question,...with a yes or no answer.

WRONG: Don't be quiet and don't talk - you must clearly, communicate you are exercising your constitutionally protected right to remain silent, to not answer questions without an attorney present. Until you do that, remaining silent will be used against you. After you clearly communicate you are exercising your constitutionally protected right, that right endowed by your Creator, then they can't use your silence against you in the USA. Not legally that is.

There's no reason for this type of a dialogue with any cop. Simply ask them if they are conducting a criminal investigation (if they initiated a traffic stop then it is certainly a criminal investigation). At this point you are not required to cooperate with them in any way because no one can be forced to give evidence against themselves pursuant to the 5th and 14th Amendments. Don't speak, don't offer them your license, don't offer them an insurance card or anything else. They can't use it against you even in a stop and identify state because of the aforementioned Constitutional Amendments.

Lawyer? Why don’t you learn the law and do not use their system. Not everyone has the ability to hire an attorney. Why aren’t we taught law in high school? This attorney would have you believe that you need an attorney to defend yourself. The court will appoint you an attorney but you can bet that you probably are not going to win your case with a court appointed attorney. If you lose your case you will have to pay for the court appointed attorney. They don’t tell you that until later. The attorney in this video was a prosecuting attorney. How many people has he sent to jail for bogus crimes and enforced made up crimes crimes by cops? It takes a special type to be a prosecution attorney. Know your rights and know the law!

When under arrest by one of these thugs you have no rights. Why would you have to bond out of jail if you are innocent until proven guilty? It’s all bs and they know it. Don’t be fooled by these people claiming that they are going to help you. The only thing that they are going to help you with is taking your money. You can always count on that.

Rule number 6 don't use this guy as an attorney. He will get you in jail or cost your c*** load of money period. He left out the supreme court Said that law enforcement can ask you three questions that We'll not incriminate you Ask for your identification Your license and registratit's for a vehicle stop Do you know why I pulled you over this? Is an attitude check question not a trick to get you to confess to something? Where did you come from and where you're going? Always check with your local district attorney to To see how the laws are practiced and enforced in your jurisdiction also checked with any local law enforcement agencies again to check to see how they enforce those same laws. I'm verified what i'm saying with those same two agencies if i'm right

CORRECTION: In the USA, you have inalienable rights endowed by your Creator, which are codified in the USA Constitution, to protect you from government. The Constitution doesn't give you these rights.
