@benjianubis I never quite understand the level of support that Jessup receives (and yes I was in the Military myself although not the USMC)as the main post points out it comes down to him allowing two young men to take the fall for is error and his Chief Medical Officers incompetence. It also paints a pretty dark overall picture that it was part of a much wider cover-up, if this was real-life I would imagine the arrest of Kendrick and Jessup would just be the start.

@@mjc8281 The cream rises to the top in all organizations; unfortunately some debris rises with the cream and with competition to get selected to ranks where the quotas are tighter and capped the higher in rank you go; you not only get officers that may or may not be proficient in their jobs but also officers that would do what they may to avoid being blamed for a decision or action, even if it means letting a subordinate take the blame. Unfortunately this practice is not uncommon.

@@kentexican5844 very true, while not in the US military I was based in a location while serving that had a situation that was being adjudicated not dissimilar to this and my understanding is that the individuals that testified never had the opportunity to return home and had to move elsewhere in the country.

When I was in the Marine Corps in Korea in the 80s, more than once I had South Korean civilians thank me for protecting them from the North Koreans. I cannot stress how good that made me feel, knowing that I was making a difference in someone's life. When they thanked me for doing that, I would have done anything for them, including putting my life at risk.

Just a shout out to the actor who played the Judge, JA Preston. I know him as Mayor Ozzy Cleveland from Hill Street Blues. Played with the right amount of steel, authority, and self awareness that role calls for. “ I’m damn sure I’VE earned it”. Tongue like battery acid, the flash of the eyes that says “ Don’t fuck with ME.” Glorious.

For those who did not understand what the verdict meant. They were not guilty of murder. Murder entails intent. The two Marines on trial never had any intent whatsoever to murder Willy Santiago. His death was merely consequential. There was motive sure. But this argument fell apart upon the admission of Jessup that he indeed ordered the code red. They were not guilty of conspiring to commit murder. Conspiracy would mean that they were fully aware of the intent to commit murder, and fully consented to the plan of action. They acted on the guise of an order that they had to follow. Which to their best of knowledge intended to merely punish Santiago for breaking the chain of command. They were guilty of conduct unbecoming of a United States Marine, because they carried out an order that went against conscience. See, soldiers are only supposed to follow legal orders. If the were ordered to do anything illegal or unjust, or even went against the very principle of good conscience, they are supposed to disobey that order. It is their obligation to. In this case, they had the prerogative to stop executing the code red because Willy was literally being killed but still chose to keep carrying it out. Therefore they were guilty. And as Dawson said, they were supposed to fight for the helpless, like Willy but they did not. Hence they were guilty. On a side note, if the charge was manslaughter though, I think this would end differently

At 1:09, you can see the slightest grudging respect on Jessup's face after Kaffee says the witness is excused. Kaffee shows no fear and on some level, Jessup admires him for it. That's what I think, anyway.

He probably did. Jessup in my view was kind of a tragic figure. A man who got so consumed with being a good soldier and with his own ego he forgot to be a good human being. I think it happens to a lot of military men.

For some reason all the characters' names in this story sound like musical notes or chords to me. They all have a lot of presence, imho. Dawson, Downey, Jessup, Kaffee, Galloway, Weinberg, etc. All of the names are so specific and so well chosen. I don't know why I'm hung up on the names, but I've always liked them.

The Code Red included Santiago being restrained, having a rag stuffed into his mouth and duct-tape being placed across his mouth, and then having his head shaved; Santiago died shortly thereafter because respiratory complications due to the rag being stuffed into his mouth.

No, you’re right. There really aren’t anymore. There’s practically nothing to recommend that even compares halfway to this film. If I could recommend something, it would 2013’s The Wind Rises which isn’t an American film anyways [it does have an English voice over though] and is practically a decade ago.

This is the one time I ever saw the prosecution never go for the win, but rather making it a fair and honest trial. He put up a great fight and argument against the counsel, but still takes the loss like a true gentleman and laughs it off.

Judge is my favorite character in this movie. You could tell Cafee won the case when Jessup tore into the judge "and witness will address this court as judge or your honor I'm quite certain I've earned it!". Cafee never once disrespected the judge like that. Jessup also forgot that a courtroom and cross-exams are home court advantage for an attorney. Great finale to the movie. Ross still scored a conviction for conduct unbecoming. So he didn't lose his case. Way this ends he will likely score a conviction on Jessup and Kendrick.

But Kaffee’s examination of Jessup was not cross-examination at all. Jessup was called, to his disgust, as a witness for the defense, so Kaffee’s questioning was DIRECT examination, not cross. When the prosecution questions a defense witness (and vice versa) THAT is cross-examination, and different rules apply. After Jessup’s initial behavior, Kaffee could have asked the court’s permission to treat Jessup as a “hostile” witness, and if granted, different rules for questioning apply there as well. Kaffee did well in not requesting a hostile witness ruling, for he would have put Jessup’s guard up, and he might never have elicited the self-incriminating outburst. Well played by everyone in the scene!

This scene merely exemplifies Jessup's arrogance and thus is a perfect example to compare to similar people. Kaffee wasn't about to object to the grandstanding. He was all too happy to let Jessep get emotionally wound up, as he knew (hoped) it would lead to the critical admission of the Code Red.

Nope but for any good job such as a government contractor position, you would need to divulge that information ion your SF86 forms for your security clearance and if you left that out you'd be subject to fines and jail time. If your going for a job at McDonald's (no shame in that its honest work) you'd be okay but something government or legal it wouldn't be a good idea to not divulge it.

No employer even checks what discharge did you get. Hell half of them don't even ask you if you're a veteran. Only really matters if you're doing government work then yeah you're screwed. ~ Former US Navy.

That's not true. There is an Article under the UCMJ that requires a dishonorable discharge if a Service member follows an unlawful order. Technically, they are ordered not to follow unlawful orders. Jessup had those kids so wired up and pumped full of crap that he knew he had them in his hands.

There are many memorable quotes, but I love the exchange between the lawyers: Ross: Airmen Cecil O'Malley and Anthony Rodriguez, what exactly were these guys going to testify to? Kaffee: Unless I'm mistaken, they were going to testify under oath that they had absolutely no recollection of anything.

the judge dismissed the jury because the Colonel implicated himself in a crime. As such he has a right to an attorney, to be silent...etc. The jury from that point on would serve as witnesses (this is why cafey says, 'The witness has rights')

The guy should have been transferred or discharged. The moment he was given a red code, the colonel and the others were responsible in different degrees for the consequences of that decision. Not taking responsibility for one’s decisions’ outcomes implies cowardice and lack of character, in this particular case.

3:21 oh yeah this guy was gonna go far in the Marine Corps with that mentality. Even though the kernel was guilty, it does not erase the fact that their actions against a fellow soldier resulted in their death. It does not bring Santiago back or erase their guilt. This situation is multi layered beyond a corrupt senior officer. I'm glad one of them gets it if not both of them. Quite frankly, dishonorable discharge and time served is a lot better than life imprisonment or the death penalty.

Kendrick had no honour though even though he talks about it his is the lie of the past where brutality, which should never have been ,was actively encouraged by a bully against weaker people who for whatever reason couldnt defend themselves against so called legally sancttioned abuse.

I am a big Tom Cruise fan, I liked him in, Risky business, Jerry Maguire (especially) and Jack Reacher and I liked him in this movie one of his best performances, but the Kernel played by Jack Nicholson out ranked everyone in this movie, an outstanding performance that should have made him an Oscar winner.

Possibly, but in the majority of cases, the ones doing the "Code Red" decide what to do (unless the group they are a part of already has an established way of doing C.R.'s).

Jessup obviously is one man who raised to the rank of full bird colonel and abused his position. That is a dishonor to those who came before him, those that came after, and the real crime, he dishonored the men who have fallen in the line of duty. His is a huge crime the in true life would give the corp a huge black eye.

I would say Col Jessup and 1LT Kendrick will be similarly charged under the UCMJ with eight or so Articles of the UCMJ. Namely, Article 90-Disobeying a Superior Commissioned Officer, Article 92-Failure to Obey an Order or Regulation, Article 81-Conspiracy, Article 107-False Official Statement (at least 2 counts), Article 131-Perjury, Article 119-Manslaughter, Article 133-Conduct Unbecoming an Officer and a Gentleman, and maybe an Article 77-Principles just for good measure.

Hitler made the order! I was *merely* doing my duty! Yes I pushed the gas button, but I'm not the one who made the order." Pure unfiltered stupidity.

LOL, in this situation your ass would have conducted that code red if it was ordered, making the case that it was an "illegal order" would get you no where, the complaint would fall on deaf ears and your ass would be reprimanded at best and severely punished at worst...even if that punishment was not itself "official", you have absolutely no sense of the reality of this world.

And your response reflects my sentiment exactly - you are right, in this situation, I would have conducted the code red. I think most people in that situation would. Because of our human limitations; our limited cognitive faculties, including being, for the most part, relatively stupid. In these types of situations, whether in the military, or elsewhere, it is extremely difficult to put morality and ethics first above duty, because the consequences of not fulfilling an order would be too severe. Only rare, extremely strong characters are able to rise above fear and a sense of duty to do what's right. I don't really know what you're talking about here. But your comment about me not having a sense of the reality of this world is kind of stupid. I'm making a general statement about a military culture that I know hardly anything about. But I do know how the reality of the world of politics, the work force, the institution of education and marriage, family - all aspects of reality - works. You're assuming that because I don't know exactly how one aspect of this world works, that I must not know how all aspects of this world works. Well that's just stupid, and you're an asshole.

I agree completely. I think Downey and Dawson deserved to be put in jail for at least 10 years. They both decided to follow through on the code red, and they should have faced tougher consequences for causing the death of Santiago.

Alternate ending: The two get not guilty not guilty; guilty. But when Jessup flips out he has a fatal coronary. Buried with full honors, he "gets away with it". And the Marines avoid a scandal
