Imagine if you could be sued at any time for things you did at work. Cops would be getting sued all the time, and would go broke trying to defend themselves. No one would be a cop. And even if they made a mistake and did something, they would get sued. If I make a mistake at work, I do not get sued. I might lose my job, as they should. But I am not going to lose everything I have because I made a mistake.

As a former cop I truly believe that unmarked cars should only be used in undercover surveillance, warrant service, and SWAT operations. Everyone knows when they see a cop car marked they slow down, there's more to policing than just writing tickets and making arrests just being present is a great deterrent and policing is all people skills not brute force.

You're right. Unmarked cars are restricted from doing stops for traffic violations due to situations when they first started being used by kidnappers posing as undercovers. If one flashes lights, you're supposed to call 911 and have the dispatch check first because it's impossible to know whether it's an actual undercover officer.

Qualified immunity doesn't automatically apply to every situation. Qualified immunity is usually when a cop claims they didn't know what they did was wrong. If there is prior case law of a similar incident in which the cop was found to be wrong, then there's no qualified immunity. Also, in most states a police vehicle must be clearly marked to affect a traffic stop by law. Either way, qualified immunity doesn't matter. Even when cops don't get qualified immunity, the lawsuit is paid by the department, municipality, insurance or police union. It almost never comes from the cop's account, even when they are found to be held personally liable.

Undercovers are not supposed to pull over people for traffic violations. Citizens can't be sure they're officers and when they were first being used widely, kidnappers would pose as undercovers and pull over lone women/mothers with kids. You're supposed to call 911 to check if they flash lights.

Did you even watch the video? The biker was a criminal, about to commit another crime, and the officer held the gun properly, keeping his finger off and away from the trigger, not that it matters. The video had nothing to do with a gun. It was just about the injuries from officer kicking that man.

Cops are sent into situations that are violent and likely to end in some kind of altercation and thus it’s more likely for ppl (the suspects) to take issue with their conduct and try and sue them - No cop would try and make an arrest on anyone for fear of an assault or excessive force claim.

You don’t understand what QI or absolute or judicial immunity is. If the guy was awarded money or received a settlement that means QI was tossed already. QI prevents you from suing the officer. Should QI go away? Yes but it’s the city just deciding it’ll pay for the lawsuit that’s the problem. Good news is that the cop is on the hook for any punitive damages.

Cops need to have some sort of immunity- They’re put in dangerous situations, therefore much more likely to get into an altercation of some sort, and thus much more likely to have lawsuits filed against them.

His car hitting him at 5miles an hour isnt going to kill him. Considering he broke multiple traffic laws while putting his life and others lives and safety on the road in danger. Along with that at that point most bikers who are doing those kinds of activities are the ones who will run from cops so his use of using his car to incapacitate the bikers bike is justified. However his use of force is not justified at all. The biker was in a state of confusion as to what happened but he was complying with the officers commands. The officers use of force (using his foot) is not legal by any means. He should be put on administrative leave and then either fired or have to take multiple classes on use of force and be watched by a training officer when back out on the road (for at least minimum of 3 months).

Yeah that biker was driving recklessly and might've gotten himself killed (unlikely he would have killed anyone else though) and could have caused some damage, but that's no excuse to treat him as less of a person.

@@Powerpickle68 I get that he didn't hit him hard with the car, but it is still a 3500 pound bullet. At a minimum that is assault with a deadly weapon, max it can be attempted murder. Problem with maxing the charge is proving intent, which isn't easy.

Do blow your cover because someone blows their nose and the snot rag bounces off the rim of the trashcan? No, you maintain your cover even at the cost of having to snort literal coke to keep people believing you're real. So yeah, undercover can call it in, but they should not be making stops.

@@frogridge Well, undercover cops are quite common where I'm from and they do patrol mostly highways, some areas away from cities and villages. They do perform traffic stops. The presence of them makes others a bit more "paranoid" (less reckless driving), but the major difference is... they (police) have some form of education requirement and training prior to being enlisted. Not that they are perfect, as our local saying is something like "Only special people go to the police force". Yet, it seems we are like light years ahead of what seems to be soviet era conscription that happens in US law enforcement.

This was not an undercover cop. He was in full uniform, in an un-marked car (not an under cover car). Lots of police departments use un-marked cars for their traffic patrols. An under cover car looks like a regular civilian car, with no lights or internal police equipment (no laptop station, no back seat cage, etc...). They also have regular license plates. That way there is nothing to tip off anyone that the car is police related during an undercover operation.

I watched the video several times to be sure before I commented. The cop did the exact same thing as the biker. How do you suppose he kept up with the biker. No emergency lights no siren and ended up at the same traffic light. That cop is more of a threat to society than the guy on the bike ever was.

There's a reason why it's called "qualified" immunity. The principle of qualified immunity is exactly what led to the charges in this case. The legal immunity was disqualified by the officer because he used excessive force.
