The problem with knowing your rights is much of the information is hidden and difficult to find until you're in the thick of it.... policies, procedures and statues can be monumental to conceptualize. Even for seasoned law firms. I think legislation needs to be reduced and converted to a form the general layman can interpret and understand.

These proceedings completely circumvent all of the values of American jurisprudence. Due process, presumption of innocence, right to confront your accuser, Habeus corpus, standards of evidence, right to jury trial, it’s all gone when cps comes into your life

What good are rights if you don't have the ability to exercise them? Lawyers are out of reach from a cost standpoint for the majority of the population. Most lawyers won't even act until proceedings in court are initiated. Also have you ever tried to find a lawyer who will accept a case involving CPS?

I had custody. CPS took him, immediate removal, imminent danger. CASA came later on in the case and asked why? Nobody really knew the answer. She said you just opened yourself up to a rights lawsuit. We are not worried. She can't afford an attorney anyway. She has a n appointed attorney sitting right there and she said and did nothing. The get paid good federal $$$ to take and adopt kids. Legalized child trafficking. TX gets millions a year from the Fed to do this.

Check your state laws, but your child may also qualify for their own separate legal representation, and /or a CASA worker for the child, which you likely can request from the court.

Get an attorney ASAP. File to get custody, guardianship of the child, request all information on the case. Word to the wise if you feel the attorney isn't doing you justice fire them and get another one.

ALWAYS ignore them, yes tell them you are answering no questions to begin with but after that do not communicate with them. It's their job to prove you're guilty, its not your job to prove you're innocent. If you talk to them they will make things up to get you for by using anything you tell them against you. To them you are guilty until proven innocent. (From someone with real world experience on the matter who isn't trying to sell you themselves)

This happened to my daughter she was forced to voluntarily give up her parental rights or they were going to be terminated against her will. Unreal. CYS in Pennsylvania screwed my daughter. Those kids were never abused or neglected there's money an adoptions.

Is this for all 50 states? My daughter was forced to voluntarily give up her parental rights or they were going to be terminated for her. CYS in Pennsylvania's reason...time. it took her too long to get her stuff together but she did. Finished everything that was required of her and if she would have done nothing or everything the outcome still would have been the same. What hope does this give people? We never wanted this or expected this we thought the kids were going to be coming home one day soon. Taking the kids was wrong. There's money in adoptions. The kids want to come home.

This is a Texas-specific law, though I think most of these rights are backed in constitutional principles. Did you happen to see our video on How to Answer CPS Questions? The first line of defense is the front door and too many parents just give up at that point. CPS is an evil machine.

Have you heard about the recent law passed in Texas that makes it much harder to remove the child? The child has to be in immanent danger, they can’t just remove for marijuana use, you can’t make anonymous reports anymore etc… Texas is really getting on board!!!!

Unfortunately, I don't know that they do. However, there is a strong argument that all of these rights that must be read by CPS are in fact pre-existing rights that are already protected by the Constitution.

Mathew, I have a neighbor who has been blasting music and have loud parties until past 2am. Their noises audible throughout my house. The cops can’t do anything about it. Even though we have “quiet hours” in my city which is from 10pm to 7am. What can we do? What does it mean by quiet hours? I can’t even sleep in my own house. What are the best ways to take evidence? I'm not sure what state you're in, but you could file suit against a noisy neighbor in Texas for violation of the Disorderly Conduct statute as a nuisance. If you're in Texas, you should inform the police officer that the conduct is disorderly if the noise exceeds 85 decibels after being warned. If you're not in Texas, your state laws may offer something similar in the Disorderly Conduct statute. You might also contact the landlord of that property if they are renters.
