actually not all states have a duty to flee, under stand your ground law or castle doctrine, depending on the state. in florida there is no duty to flee, if someone where to pull a knife on me in the street, i could shoot them dead on the spot and no charges would stick EVEN IF i had plenty of places to run to. also, if you decide to run from an attacker, if they are faster than you, or they have a gun, you will die. standing your ground and dealing with the problem as quickly as possible is always the safest option. i hate duty to retreat states, their citizens are moronic and the people they vote for are even more so.

It pains me to say that you wouldn't be able to pardon him if you were President. The POTUS only has power to pardon federal offenses, not state ones, and motor vehicle theft is normally not a federal offense, unless it has some sort of federal element (such as if the thief transports the stolen vehicle across an interstate or international boundary, for example). So... run for governor of his state, instead.

Another good piece of advice: the police always drive better than you. I know the area they're talking about with the drunk driver, and it's usually a calm small town. One time I was driving on the freeway and I saw a minivan (try to) get into a high speed chase with the police

@ attorney Tom, I'm pretty sure that you can't just respectfully decline to take a sobriety test (or at the very least this varies by state). I know that in my state, when we get our drivers license/permit, we HAVE to sign a paper that says that the license means that we automatically agree to all sobriety tests.

I'm not a lawyer and I don't remember for sure, so take my words with a grain of salt, but isn't that just for the breathalyzer test? I'm not sure whether they require you to take a roadside sobriety test, they might let you skip that and just take the breathalyzer. I'm not sure though, also any information I know would be for Wisconsin if it does vary. Back after a few minutes, the first results seem to be all from legal blogs (I don't know how trustworthy those are) saying that, at least in Wisconsin, you don't need to take any tests in the field, but you can be forced to take a breathalyzer after you're arrested. Although there wasn't any mention of one, I thought there was a fine/fee if you refused to take a breath test? Anyway, it sounds like you can at least refuse a field sobriety test, and that one reason you might want to is that apparently it can be inaccurate... Sounds like if you know you're sober, you should try to just take the breath test, instead of risking an inaccurate fail on a sobriety test being used against you. But don't listen to me, I don't have any expertise or anything in this.

In Florida you don’t have to. At least in 2015. I was with a guy and the cops told him if he failed the breathalyzer he’d get his license taken away for a year or if he refused it’d be taken away for 6 months

There is no getting out of it, and you literally have to sign a form saying you will comply to sobriety tests if an officer asks you take one when you get a Florida Driver’s License

@@edenbey5725You’re gonna get arrested if you come to Florida then 😂 Nobody gets coerced into signing the paperwork that says “Yeah ok I won’t drive drunk” because it’s your choice to sign it or not. But if you choose not to sign it you aren’t leaving the Florida DMV with a license. You can refuse to take a field sobriety test, but then you’ll most likely be arrested on suspicion of DUI. When that happens, if the officer chooses to give you a chemical sobriety test like a breathalyzer and you refuse, you will automatically have your license suspended for a minimum of one year. You aren’t allowed to refuse a chemical test

Being suspicion does not denote guilt nor is it a crime. Say nothing admit nothing and let you lawyer handle the rest. I've done this countless times and my lawyer has gotten me out of paying a number of tickets. Your merely speculating while I've already gone through the process and was proven correct. My knowledge is first hand while yours come from youtube.

Probably for people like me. I had an Ohio drivers license, insurance and Ohio plates but I lived in another state at the time. The state I lived in had vehicle inspection I didn't want to deal with, So i used my family's address in Ohio for everything. So it would be reasonable to assume I lived in Ohio when I did not.

Why? It's all part of the legal process. When the police believe you are doing something illegal, they will try and gather as much evidence to be able to successfully charge you for that illegal thing. If you respectfully refuse to talk to them, you are denying them a major part of the investigation process, and therefore making it much harder to reasonably charge you with whatever crime you may or may not have committed

Tom, In a past life I was an United States Air Force medic. For special events we would sometimes stage our ambulance on the flightline, just in case of an emergency. I had a dream last night that I was staged on the flight line for an air show. Everything was fine until a F22 began flying erratically shortly after takeoff. The jet turned upside down and then began spinning end over end just a few feet off the ground. Finally, it crashed. When I got to the wreckage the pilot was crawling out unharmed. He lifted up his visor and it was you, eyepatch and all! You told me that you had lied to the Air Force about having some kind of blood pressure issue which somehow interfered with the planes navigation system. I have no idea what the hell you were talking about. You slapped my shoulder and asked if we could keep it between us, and then excused yourself because you needed to get a funnel cake. Tom, I have some serous concerns about your behavior while piloting that aircraft. You and your ego put a lot of people in harms way, and while I can’t be sure, it appears that it had something to do with the funnel cake. I expect a lot more from my pilots. I’m very disappointed in you. I just needed to get that off my chest.

Leaving aside that I think that taking the thieves' car was a great idea, I'm not sure how stealing a $10K (?) car would be proportionate force to prevent the theft of a $400 television. Definitely falls under the Rule of Cool, though.

Plenty of tvs are worth more than $400. It also sounded like they were stealing a lot from his house not just the tv. The tv was just what he saw. He didn't steal or sell their car he just drove it away and aside from a few extra miles it's in the same condition.

I once gave a police officer my debt card by mistake. He had me get out of the card. I tripped over some muddy ruts getting out of my car. The cop could obviously tell I wasn’t drunk after talking to me for a few seconds. It got so awkward

Was a Six Flags season pass holder in Arlington for several years. The way it worked in those years was that the first time you used your pass they would scan your card then have you press your finger against a scanner. Your biometrics would then be associated with the pass and from then on you wouldn't have to scan your card, just press your finger against the scanner to get in. I'm certain the reason was to prevent multiple people from sharing a single pass. Prior to that they printed a head shot on the pass, but it was really low definition and could get smeared easily. I assume it worked the same way in Illinois, but they ran afoul of a local law that doesn't apply in Texas which uses the consumer legal standard of "bend over, daddy corporation gonna have some fun. if you want lube that'll cost you $10,000 an oz".

This was me getting pulled over for speeding. Immediately handed my bank card to the officer. He told me bribing a police officer is a felony. I said 'oh, oops'. He laughed then gave me a ticket.
