Disclaimer: I'm going to give an unpopular opinion for the sake of all victims, but also I'm team Depp. Since the beginning I thought this might be the case with AH. Even though I believe JD is the main victim, we can't overlook his toxic traits. It may be that because of her childhood/disorders, she's easily triggered and becomes violent. He may have been psychologically, and mentally abusive (I've dated someone like him). That doesn't excuse ANY of what she's done/continues to do to him, but just want to point that out ONLY because victims of passive narcs are already having a difficult time proving their cases. They don't deserve people turning their backs on them because of the damage AH has done.

But we are in an INCREDIBLY reactionary time, especially in the U.S.; and the strides we've made forward in addressing sexual harassment, abuse, and violence and murder against women, along with all manner of other steps forward (Obama's election being the most important and salient ) are existentially threatening to white male supremacy. @@Veeliscious we do need to be very careful about using her as an example, though. Her behavior is not generalizable to all people diagnosed with borderline personality disorder, as people with BPD tend to be the victims, not the abusers. And malicious, violent, manipulative behavior is especially not generalizable to BPD. Manipulative behavior is pretty generalizable, but most people with BPD who manipulate others aren’t doing it with malice, and often they don’t even know they’re being manipulative. They’ve more than likely been abused at a very young age and as a result their brains have been wired in a way that makes their efforts to communicate their needs come off as manipulative. The good thing about BPD specifically is that it’s treatable and manageable (when the person has the financial means and support to access proper treatments, like DBT). I don't get it, it is supposed to be a jury of the defendant's peers so that should mean more than the jury must consist of adult humans. If they had a panel of jurors who are or used to be gang members themselves that would be a jury of the defendant's peers. You would also find that this jury of peers would be more laser-like in their judgements and more draconian in their sentencing.

@@luanngarcia6435 a 'jury of peers" is a legal term. in the legal sense it just means 'a fellow citizen'. It was a distinction that was needed when the system was first set up because it means youre not judged by someone higher than you, like a king, or nowadays a judge. It has nothing to do with the common usage of the word. It would also be increadbily inapropriate to have gang members judge a fellow gang member. That would probably follow for most things. “A defamation of character claim must be specific enough that it refers to the plaintiff. The statement does NOT have to refer to the plaintiff by name but it could be defamatory if the plaintiff is reasonably identifiable.” - I found this on FindLaw. I wish JDepp’s team had made this more clear to the jury, that it did NOT have to mention him by name. He is “reasonably identifiable “ in her article. Plus, the ACLU exec testified that they advised her to edit HIS name out. I wish his lawyers reminded the jury of this.
@liseklerekoper2441

What defines defamation according to VA law is clearly spelled out in the instructions the jury received, including that calling out someone by name is not a requirement for defamation to have occurred. Also, there were hours of this trial directed to this point where Depp’s team made it abundantly clear that defamation occurred w/ out directly naming Depp as “everyone in Hollywood knew exactly who Heard was referring to in the op-ed.” There were a number of Depp’s witnesses whose testimony was focused on exactly this point. The one that comes to mind immediately is the older gentleman who has 50 yrs of experience as a “deal maker” in Hollywood & is also an attorney. I think his name is Richard Marks, but not 100% sure. He was a rebuttal witness as well & gave quite compelling testimony both times he was on the stand. It was said by someone in open court earlier in the trial that calling someone out by name isn’t required to defame them if enough reasonable people reading or hearing something can easily conclude who it is about.

QUESTION: Emily, congrats on the success - so well deserved. Would you please walk through what you would be doing if you were the Jury fore-person right now… would you start with the big questions: Do we believe there was DV - yes/no… did he beat her - yes/no … or do you think they should start by writing down their own answers on the full verdict form and then compare and contrast? What is the best or quickest way to get there on something so complicated with levels.

The thing is: the relationship was toxic, and I tend to think that some jurors might find some of JD's actions like the cabinet doors slamming or verbal insults as abuse. How can anyone believe the SV I dont' know. But jurors might think: they were both shitty to each other, no one defamed anyone. Disappointing because it would mean AH gets away with all her lies and obvious perjuries, but that sounds like where it's going.
@czhaok

It almost doesn't matter if they think slamming cabinets was abuse by him. The headline says he violated her sexually, if they find she was lying on that, then it's defamation still.
@coxfire
2 жыл бұрын
@@czhaok oh, I agree, but you never know. The jurors normally "only" rely on what happened in the courtroom, they couldn't replay KZitem videos that laser on all her slip ups and inconsistencies. They follow their own feeling and as I said, as unbelievable as the sexual assault sounds, a juror "could" think it's true. A juror could think that some of JD's language is abuse, and yes, slamming cabinets can be seen as such. I find it very far fetched, but everyone is different. I sure hope that AH won't get away with her shit. Well the public opinion already made it's mind up but having it backed up legally is important. It's abject to use DV and metoo as a way to promote yourself. It's an insult to real victims, but worse: it does damage harshly years of progress women made when speaking about SV. I'll say: she is an awful woman, but it does pain me to see her get more hate than Weinstein, Spacey, and so many others.

Poor kitty😿 hope he's feeling better. Few little things that I'm sure you know, but just in case: -wet food instead of dry (prescription diet may be needed ex: Hill's Science Diet Prescription C/D) -add liquid to food to allow kitty to get as much fluids as possible. -if other kitty has different food, don't let it be accessible. - check the food's sodium and potassium content, try keep it as low as possible. -have water available in multiple areas, and make sure you can see if it's being consumed. -try drinking fountains, to have flowing water. Some cats won't consume the needed amount of fluids, if their water is still. - use a splash of tuna water to the water or food, to increase interest. -STRESS can be the reason for urinary issues, try manage your kitty's stress. Provide multiple perches, window beds, cat trees,etc. This provides vertical safe space. Provide toys and interactive games, try slot time just for kitty. - if anything is different such as construction or a visitor in town, random things can trigger stress. - make sure other cats are not bullying him. -Dirty litter box: use multiple litter boxes, and clean them daily.

I cant recall if Emily covered this, but was the jury told that Amber did not submit all of the evidence (pictures, phone, etc) as requested?
@tenacaldwell7955
2 жыл бұрын
Good question. Especially because amber personally testified on the stand that it was not her decision to not turn in all video and photos that held significant evidence pertaining to the case. Infact, the actual evidence that would shine some proof directly to her allegations (if any AT ALL) were for whatever reason withheld from the trial altogether. This said mysterious "evidence" was brought to light for the very first time by amber in the witness box. The most intriguing part to the testimony was how quick amber was to throw her own council under the bus in order to better the chances of her statement holding any truth to their actual existence.
@tenacaldwell7955
2 жыл бұрын
Amber is never wrong, even when her actual admitted evidence contradicts her personal testimony. And rather than acknowledging the contradiction(s) she always chose to stand by her statement and would argue it relentlessly. It seems like her own admitted evidence has both her rise and fall during the trial. Her allegations compared with the evidence showed no similarities so she would then "make it work" by continuing to stand her ground and begin to contradict herself on the stand, under oath. Sometimes you need to admit to when your card has been punched, unless you're amber and you forgot your punch card at gome.

He discovered that he had been BETRAYED by people who had been part of his life for over a decade AND as a consequence he had lost all of his money & couldn’t even pay his bills!! Amber Heard chose THAT WEEK to file for divorce & PUBLICLY file for a restraining order (when she knew that he was out of the country!) when she could have let her lawyer file for her! Even if you don’t believe the guy from TMZ… She PERFORMED at the court! She wore “sack-cloth” & dulled her hair. She ‘acted’ & looked like a broken waif for the press. The first sentence she said when asked why she was here..was that "my ex husband is suing me FOR THE OP ED I WROTE." She cut off his finger...eliminated in his bed...staged injuries and crime scenes...faked photos. What else do they need? I don't understand why it's taking this long. I think it's not just a case of who is innocent, who is guilty, but also a case of who gets awarded what, who suffered the most and why. it's clear that Amber's career suffered greater than Johnny's due to the negative publicity she received, however, she was the one who published the OP Ed, unprovoked. 😆 also, her lawyer said, "we're not asking you for 100 million, just damages" when that's literally what they were countersuing for. 😆 so I think it's important that they take their time to decide who gets what. also, I'm wondering if they will push the perjury thing. I hope they do. pledge and donate are synonymous my ass.

The question about which undergrad to have to get into law reminded me that one of the women I did my archaeology undergrad with then went into law. At first I didn't get the connection until I realized that in archaeology we only have the evidence that people left behind and the context so we have to work with that to make a case about how a site or item was used. We also have to know when and how to work with experts and read a ridiculous amount of papers from pervious studies to either build up our case or that we have to defend our case against. Plus I think having an archaeology background is great to have if you want to go into any law related to historic sites or cultural issues.

My son's (27) friend thought that the amount of "hero worshipping" toward JD was getting outrageous. 🤔🙄😒 I don't see his **support** as "hero worshipping." I just want to say as an abuse survivor, just listening to the audios alone makes it obvious who the abuser is in this case and I am mystified as to why AH recorded herself doing the following tactics that are ALL things that a COVERT NARCISSIST does (or maybe any narcissist, but it is the covert w/which I have experience): , , , , , , attempts to , AND continually . I wish that EVERY PERSON who has been abused could have the worldwide support that has been freely offered to JD. Abuse is so hard to deal with and a support system is extremely important. I don't think in this case this is hero worship. We are supporting JD with our Love bc so many of us have felt his pain by the Amber Heards of this world.

Rihanna did a interview about the Chris Brown incident and the similarity of what she said about that during the interview and what Amber said on the stand even down to the same hand movement at the same time seems to be a moment she copied from a real victim recount. It makes me so angry.

This is actually legitimately an insane take. Go touch grass.

It’s pretty crazy, but they’re not the only one who’s saying it. Amber has taken bits and pieces from all over the place. She stole her friend’s DV experience, used it for her own story. No surprise that the friend feels betrayed and violated. Amber has also used bits of dialogue and mannerisms from movies. I would never have caught that, but there are a lot of people who did. Given all of that, I’m not at all surprised that she’d copy another well known case and make it her own. She knows people believed Rihanna.

…Ok, this is now official. One Google search provided a frightening amount of links. I didn’t look too far into it, but according to one headline apparently Rihanna has responded to it. That will be interesting - Rihanna is no pushover. This could also make Amber look even less credible, and a whole lot more creepy, not to mention nuts. She’s just gathering bits and pieces from anywhere she can find them, using what she thinks will help her as her own. I hope Rihanna reacts loudly. And I want to see split screen videos, see just how far Amber went.

@@graciep.6984 this is already disproven.

Ok, I’ll take your work for that, as I don’t feel like chasing it down much. But given how easy it was to find multiple articles and KZitem videos on the subject, then surely that would mean that the comment is disproven, not insane. I don’t mean to be argumentative, it just seems a little bit unfair to call someone insane for something easily found in a Google search. I kind of like the touch grass idea, though. If it’s warm enough today, I may do just that. Sit outside on the grass with a book in hand - sounds like a great way to pass an afternoon. :)
