I've collected BMI mailbox money for over 20 years. Primarily from TV/Film placements. Works get registered and populated from cue sheet information, not manually. Thanks again for clarifying. I'm amazed after 20+ years in the music industry people still haven't figured it out and are wrecklessly spewing misinformation.

For tv and film yes, they have staff who submit the cue sheets to the PROs. I’ve never registered a single beat myself and always get paid.

@@biggmixxoyou’d be surprised about lawyers and managers. Many times they do tell people, who again don’t listen or do the work. Also, the only thing that has changed about this process in 25 years is the website you can enter the info on. Used to be paper and stamps, now it’s self service. It’s not complicated, but you do have to read and in this case listen to DJ Pain 1 😎

💯bro, awesome video. I use a copyright company myself called (Copyright House) to register works that have not yet been published. It is a one time payment for life and a good service... But saying that.... I registered a demo song a few years ago with them and then put it online, and it was stolen, slightly changed and ended up hitting No.1 in UK & US. The musicologists and lawyers said that the music and lyrics had been changed enough so as I didn't have a case, even though they all agreed my song was stolen. I missed out on millions, so be careful out there fellow creatives, coz this industry is riddled with non talented, and very talented thieves. ✌

DJ Pain is 100 % accurate. Anytime I registered my music with BMI it's sole purpose was for sync licensing. I never registered a beat I was selling to an artist with a PRO. Beats I format for TV are in separate folder. This is good info brother. P.o.p.

Here I want to add that If you want your composition as a cowriter (beats, melodies, lyrics) to be registered when the final song is released it is IMO important to have that in the sales contract with the particular artist you are selling/giving your work to. This should include the process and systems used for registration including the timeframe and the percentages among other things like getting feedback. This will make it very clear for any hobby artist and/or professional what their duties are and what you agreed on to avoid any issues later down the road. How in the world would it make any sense to register your beat/ melodie/ composition/ lyrics with a company that does not scan for that and does not protect your copyright anyhow. If you make a living from selling your compositions it would even be counterintuitive to "register" or publish ANY of the work you want to sell! Nobody wants to buy "USED" products in that field... professionals usually outright dismiss any material that has already been processed in such a way. Registering your beats for example seems really insane IMO.. Even if in theory, they would be able to identify your beat inside somebody else's song, how would they know the percentages of royalties of that song that have to be allocated for you? That is not something they will do. That is why it is important to have all the agreements in writing with the artists that use your compositions so that when the song is registered you will get the agreed-upon percentage within the registering process. But for everybody who wants to look "important", and show off thousands of registered nonsense, this is the way to go I guess... strange FLEX nonetheless. As far as I know, if you really want your creation to be "officially" registered and protected there are lawyers for that, but of course, it will be a fee per creation, and with a couple of thousand beats this will definitely be a lot of money down the drain unless you really have some finished songs you want to protect.

I must be one of the old heads in the game because i could've told a lot of y'all this same information. I'm surprised a lot of people don't already know this. Registering a beat with a PRO, a beat that you haven't "put out" is literally a waste of time and their resources. As long as the track is properly copyrighted and you submit a split sheet, to your PRO, you will get paid; provided the track gets enough spins or uses in the public domain. What he provided is definitely solid free game 💯💯

Anybody reading this post, this is a copy and paste summary from a third party site, not a PRO itself. It’s misleading to a person who doesn’t understand copyright law and suggests you get general copyright protection from a PRO. The scenario in which this would happen is specific to interpolations etc for published music, not unpublished beats. I stand by everything I said in this video. People who aren’t lawyers and aren’t career producers want to prove me wrong so badly here. Ask yourself why that is.

Ive gotten checks from Ascap for beats, so you dont know what you are talking about. Also regardless if a beat has lyrics or is a song, it should still be copyrighted. I have always copyrighted every "song" I made which was a beat, but not some basic ass 2 minute loop that most producers call "beats". I make whole songs that are instrumentals

I have sued barnes and nobles and multiple other companies, and believing that your work is copyrighted because you made it is not correct. You need to have a registered letter from the copyright office to prove you are the original creator and owner of your work. If you think the myth of "automatic copyright" has any value in the real world of law you are incorrect.

There is a reason intelligent companies and people pay to copyright their works of art, literature and music, because in a court of law your imaginary automatic copyright has no value. Again I only sued the biggest book publisher and won because I had a letter of registration. And I also sued 3 other companies because I also had a registration of copyright letter. You can argue this all you want to, but tell me how many billion dollar companies have you sued for infringement with your imaginary made up self copyright? In fact how many small companies have you sued for infringement?

@vongwynbleidd I dont sell beats, not for less than $5000. And I put out whole records, and if you put a record out and release it on itunes or whatever it should be copyrighted. This is what actual legit artists and record labels do. Even a single release should be copyrighted. It is to legally protect the work in the event someone steals your music.

You're telling people not to register the beat that's for sale, you never said not to register the song that beat becomes or not to register your instrumental albums on a completed body of work. Apologies if this is a dumb question. Still wrapping my brain around royalties and how to utilize PROs. How does the royalties that I am receiving from DistroKid differ from royalties that BMI collects? Am I missing out on royalties by not having my already distributed beats registered on BMI right now? For context, all of my beats are on both Beatstars and distributed on Distrokid. I am building lengthy playlists of my beats, and running ads directing traffic to my Spotify Playlists of HipHop Instrumentals, much like Lofi Girl, ChillHop Music, Fantastic FM, JazzHop Cafe, etc. This is the first I've heard that performance royalties are a part of streaming royalties, and so I'm afraid I might be missing out on a chunk of royalties by not having them registered right now. Thank you for taking the time to explain these things to dumbasses like me haha. My wife and I love your podcast. Your advice has been incredibly helpful

Distrokid only collects sound recording royalties aka the master royalties, whereas BMI collects performance royalties for writers. Streaming services like Spotify do pay out performance royalties on the writer side, as well as performance and mechanical royalties to the publishing side, so if you have your beats on Spotify, it might be worth it if you're generating a lot of streams to register them with BMI, as well as a publisher like Songtrust, which Pain is using in this video, to collect all of them.

I still have one question remaining: Would me entering my beats in Songtrust negatively effect all of the artists who have purchased licensing from me? I'm a little hesitant to enter my songs into any sort of contentID, as I feel this might negatively impact a lot of my customers. Unless if I am completely missing the bigger picture here... Very grateful how you continue to help the producer community!! Hmm... I always thought PRO's duty was collecting income on behalf of songwriters and music publishers when a song is publicly broadcast or performed. Never once thought they were involved with copyright protection. Where do these people get that idea... I'm just wondering if ASCAP still does the scummy practice of taking money from indie artists & using that money to pay the performance royalties of top 200 grossing tour acts like they did in 2009. Also, are their copyright alternatives to protecting your beats if you don't register with US copyright office (as that is getting much more expensive these days). Thanks for the advice.

It makes sense to COPYRIGHT your beats and register them with the US Copyright Office as an album of music. KZitem sucks on links but Google "us copyright office album of music." Look for the official .gov listing and educate yourself. You can save some money by registering an album full of beats rather than each on individually. Filing a copyright means if there's a dispute, you've got the receipts. Remember, in a court case the truth doesn't matter. It's what you can PROVE.

Great informational video!! I recently landed a placement on Law and Order. I'm registered with ASCAP. I had a chance to fully understand the split sheet, cues, and how many seconds my beat was played in the show... DJ PAIN 1 is speaking facts!!! It's a lot of hard work registering beats with PROs. All of the information has to match up correctly. Word of advice, Producers, if your beats are sent out and labeled properly, typically you will find out if your beat lands somewhere mainstream.

This is no news to me for as long as I've been making music since the 80s. Has this knowledge been lost over the years? PROs are merely bureaucrats in a way. They don't deal with the recordings and never have. A beat is a semi-finished product unless you register it as an instrumental song. You wouldn't get an EAN/barcode for an unfinished product which will never be sold as such in a shop. Cheers mate for pointing out the basic misconceptions about performance rights. Strange that they still exist.

This is an interesting perspective. I’m not going to lie i register all my beats and that’s my highest form of income is publishing royalties. Maybe it’s different for me because I post all of my beats to Spotify and have gotten a good amount of streams on Spotify. But personally I would have missed out on a lot of money if I didn’t register all my beats

You seem very knowledgeable about these things, I and realize that you know what you're talking about because I do research on everything myself. However, one thing I would like to ask of you - What if you are making beats with no interest in having rappers on your tracks, like me? I am taking a different approach with my music. I don't even won't others rapping on my music (honestly), I'll do that myself in time, however, I am interested in promoting and marketing to television and film makers, video game developers and such. With that in mind, seeing as how if taken up by anyone, my music will not be altered in any way that changes its genetic makeup (sort of say), would it then make sense to register with PROs? I am asking only because your opinions are that of someone, I feel I can trust.

Good vid. Towards the end of the video you showed about if they don’t register the song or don’t register you in the song you can do it yourself by putting title in adding your name and searching the song and adding the isrc number. My question is is there any protection against a random person trying to claim royalties on a project they didn’t make?

It does make you wonder , If an artists song is that big and successful and deserves royalties from Placement , usage , etc , why would it not already be handled by who your working with . Right , if it's already a success , wouldn't you have your lawyer take care of claim and ascap .

This is why I've advised Producers not to refer to their work as beats. They are songs not beats. Their affliation with the PROs does not begin until the Producer and Artist agrees on percentage and your name and signature is included as a co-author of music or just author of music.

Thanks for the information. I knew you couldn't get paid unless you are the Songwriter. Beats are just what they are, Beats. Now, you can Copyright them as a SR (Sound Recording) and you can be added as a co-writer. They have to have words or lyrics in order to be added as a co-writer of that particular song. This is called collaboration!

thank you for this video. there are so many people making beats and are not generating contracts correctly. the beats are nice but the agreements are trash. you on the other hand have the best licensing agreements to date. Facts. You don't have to register the beats, but why not collect royalties for the instrumental and the new sound recording once an artist uses it? Forget about an extra layer of copyright protection, this shows that you're the original composer and publisher. And once the artist inputs the name of the composer of the beat, it would be simple for the P.R.O's to match and make sure that the actual creator, the composer of the beat get's rightfully compensated. I released a song on CDBaby and someone from their organization took the liberty of registering the song and collecting royalties for the works instead of me. Because I wasn't ahead of the game.

Thank you for sharing this video as an admin of the company. I’m constantly explaining to people that there’s a whole process behind it. Registering a beat is perfectly fine; get the necessary approval and publish it on all platforms. However, if the system detects it in someone else’s work, they’ll add a copyright, preventing further uploads. In the Caribbean, especially in soca and reggae, they adjust the tempo to register the beat. This allows them to register multiple versions, just in case someone uses it and the distributor mistakes it for another song. Additionally, KZitem’s algorithm is becoming more sophisticated. It can identify your song, even at different tempos. I’ve witnessed this with one of my artists; someone created a mix with a different pitch and added another beat. The system detected it and issued a copyright claim on KZitem.

In fact, I had to bring in another team member solely to handle execution, allowing me to focus on providing precise instructions about the process. This way, we can ensure that everyone gets something valuable out of their contributions, Example get them pay for whatever it is streaming nowadays. Living in Panama, most of my register at work right now has been music that came out 20 to 25 years ago, and I’m registering work and sounds on behalf of the artist or the family for the ones I pass away
