@@Promethe3u5 let me break it down for you. For starters, Demi Moore’s character in this film is one of the stupidest and most obnoxious film characters in history. The defense had a shaky case to begin with, and the prosecution dealt them a huge blow with the revelation that Downey was not actually present in his room to hear Lt. Kendrick issue the Code Red orders. That was a colossal f**k up by Galloway - it’s incomprehensible that a real-life defense counsel would miss such an important piece of information. Then the defense loses its key witness (Markinson). At that point the defense’s case is lost. Yet Galloway is there telling Kaffee they still have a case, all they have to do is put Jessup on the stand. So she now bases their entire case on Kaffee being able to goad Jessup into incriminating himself and confessing to murder in open court. In real life no lawyer with any ounce of common sense would even consider such a ridiculous strategy (all Jessup has to do is take the Fifth) especially since it would result in a court-martial for Kaffee, for smearing a high-ranking officer. When Kaffee (naturally) pushes back against this idea, Galloway (after almost botching their entire case) then has the nerve to mock him as a “chickensh*t” when he’s the one who faces all the consequences if this strategy fails, while she gets to go home and go on with her life. Markinson’s character also bothered me. Why would he go out of his way to leave his post to show up on Kaffee’s doorstep to tell there was a Code Red, then take his own life? If he was so ashamed by Santiago’s death he could’ve testified and helped bring justice.

All lawyers make mistakes and she could be forgiven for the Downey thing, but what really pisses me off is when even after they lose their key witness (Markinson) she is still insisting they have a case. Meanwhile she is berating and mocking Kaffee for plea bargaining and pushing him to take the risk of a court martial by smearing a high-ranking officer while she sits back and watches from the cheap seats. One of the stupidest and most annoying characters in any film I can remember.

@greg oscar I've seen Born on the 4th of July, and he was alright in it, nothing too special. IMO, Tom Cruise only does really well with two basic emotions: arrogance (or cockiness/smugness), and sometimes anger/irritation. Hence why I think Jerry Maguire is one of his strongest movies. Rain Man too, since both movies capitalized well on both emotions, and not too much else.

@@andrewcabral963 Earlier in the film its said Kaffee was their best lititgator having successfully plea bargained 44 cases and Kaffee says "one more and I get a set of steak knives" she's basically saying sorry for him losing the case since she can't offer anything else and he just wants to give up instead of challenging Jessup on whether he ordered the code red which is basically all they have at this point.

I know, right? I mean the screenplay is AWESOME. And the director and the actors did a marvelous job with it. Honestly, I cannot stop watching it. It raises ethical issues that are still relevant today, and this was during the '90s. I honestly loved Demi too, here. Maybe she doesn't use her face a lot in her acting, but her voice compensates wonderfully for that.

I only wish that people were this wonderfully articulate and animated IRL. Most people IRL are boring, predictable and utterly lack this kind of emotional fire........even when they're drunk. Most people IRL think screaming and flipping over a table in rage is one of the worst things you can do, even if its justified. The world bores me.

He should have mentioned that colonel Markinson has kicked the bucket, cashed in his chips, or bought the farm 🚜. Use a lot of slang words. I believe a "code redd" is military lingo. Besides Lieutenant Kaffe mentions a court martial, he would be looking at possible disbarment proceedings in which wherever he is licensed to be a lawyer will be disbarred.

He has been blackballed from receiving his justice recognition and reward (Oscar; BAFTA; Golden Globe our lifetime achievement) for best actor all because of his beliefs, his business intellect and prowess. It shows the type of closed industry that he works in and we support. Life. Sad indeed.

No one types with 100% accuracy. I've already made 3 mistakes, that I had to delete, lol. If anyone is still using a typewriter they must be out of their mind. :D

What I love about this scene is that both Kaffee and Galloway are basically right. He's right that Downey's testimony -- and their failure to discover its flaw aforhand -- shattered their case. She's right that proving the order came directly from Jessup is their last remaining hope. He's right that attempting to force such a confession without evidence is a career-shattering gamble, and she's right that his fear of losing a case outright compromises his ability to fight vigorously for his clients.

All very true. Also, from Kaffee's perspective: Galloway screwed up the case BAD, and her brilliant idea to fix it is for Kaffee to put his entire life and career on the line. She's right about Kaffee's ability to do it, but Kaffee has every right to be pissed off that she wants him to take the fall for it.

She’s not right about anything. They have no way to prove the Code Red order came from Jessup. Her idea is basically “let’s put Jessup on the stand and he’ll just fess up and implicate himself as a murderer and we win”. If this were real-life all Jessup would have to do is channel Mark Fuhrman and plead the Fifth on all of Kaffee’s questions. Kaffee would’ve been held in contempt of court for screaming at a witness like that, not to mention being court-martialed for smearing a high-ranking officer. Meanwhile Galloway gets to go home and go on with her life as if nothing happened.

Their entire case now depended on whether Jessup would slip up during questioning and admit he ordered the code red. That was definitely a galatically stupid gamble. If Jessup just kept quiet then the movie would've ended very differently, lol

I strongly disliked this particular aspect of the film. It's so unrealistic. I especially disliked Demi Moore's character constantly badgering Kaffee to continue with the case even after they lost Markinson as their key witness (nor did I like the idea that a Marine officer would take his own life over something like that).

The point was to attack Jessup only apparent weakness, its ego, which at that point was their only card left to play. Jessup was dying to tell anyone that he ordered CODE RED, because he thinks that the death of Santiago saved lives, because he was weak and he would have put people lives in danger. The concept of honor and duty its all fucked up in Jessup mind. He thinks that he was only doing hes job, just look at hes face after he confesses he ordered code red, he could not belived he was convicted for "doing hes job" and also admits he would do that again if he had to, thats how dellusional he was. My grandfather fought in WW 2 and was a colonel and he told me that he had collegues who were just like Jessup. Great scene !

In real life, if someone like Jessup were so eager to tell everybody he had ordered the Code Red, he could’ve taken the Fifth with Kaffee’s questions and then fessed up “the truth” AFTER the trial was over, and he would’ve been safe from prosecution by virtue of double jeopardy.

Yes only because the plot demanded it and the "good guys always win" story telling. In reality he was 100% right and the case would have ended there. For movie purposes I'm glad he did go with her plan otherwise we wouldn't have gotten one of the most famous exchange of quotes of all time.

@@sean2015 and it's still not a compelling argument. If you want to debate how much of any given movie would happen in real life you will discount 90 percent of any film. The fact remains, in the framework of the film, Kaffee ended up doing exactly what she said based on what he observed in his interactions with Jessup and how he would respond to questioning. And it worked, again in the framework of the film.

honest question, how common was it for people to have type writers in their own home back in the day? I was alive and remember when this movie came out but cant think of anyone who had one. That said, the version of the job I do now back then would be greatly benefited with one; so it just get me wondering.

In 1992 I used an electric typewriter, but most people I knew had MacIntoshes or desktop computers. In 1994 I bought a Compaq Presario.

Seriously, she was the one who screwed up the defense, not Kaffee. And then has the nerve to insist that Kaffee risk his entire career which wouldn’t have been necessary had she not screwed up. It’s easy to suggest ideas like that when you have nothing to lose.

it's from an earlier point in the movie where Kaffee (Cruise), when first meeting Galloway (Moore) and she's told his amazing plea bargain record, says that if he successfully plea bargains another case (i.e. wins another case) he'll get a set of steak knives.

Drunk because he was sweating real hard over how he was going to get Jessup to confess. And even though Galloway has some passion, it's not her career on the line, it's Kaffee's. He messes this up, and that's his military career right there. He has to prove that Jessup called Code Red on Santiago, and evidence means everything in court. It's a big risk to indict and get a highly decorated officer to confess without it.
