This was a really interesting hearing, OSG, and a quite different one than we usually see. One fact I truly loved hearing is that Judge Simpsons courtroom is going to be getting a new sound system 👏👏 My ears are very grateful 👍

@@LanaAndJen A strategy in a case isn't always centered around someone proving they are innocent, you can very well acknowledge you are guilty, but seek lesser sentencing based on different things, in that case, it doesn't matter if he flat out admits in open court that he did it, as long as he deosn;t submit an actual guilty verdict.

Do not apologise for the long video! I, for one, love the longer videos. You are the old man bringing the videos that everyone else reviews! For this case, and any questions of competency, the court should rely upon the trained professionals. Law scholars, even the judge, should not have the final say. However, I know you can doctor shop to find someone to give whatever answer you want. Any evaluation should be done by two different doctors and if there is a disagreement, a third should get the final say. This costs more, but we should, as a society, strive to never punish a crime caused by an incompetent defendant.

I'm with you, UMG - I, too, appreciate the long videos, as well as the shorter ones. I spend most of my days crafting because I have "retired early" 😅 due to my chronic illness and these videos keep my brain working and (I hope this doesn't sound uncomfortably sad) makes me feel like I am not entirely disconnected from society - even though I'm in Australia 😂 So the longer the better.

It seems so. He seems to think, for some reason, that the jail call is enough that it would change her mind. Issue is, the doc recognizes that the man would prefer a claim of Insanity, but that doesn't make him sane. It's a very stupid point, like.... im surprised he's in his right mind saying this as a professional level of stupid.

Being threatened by someone who is completely delusional , is freakin’ scary. Having that person threaten your kids is worse. It’s life altering. Law enforcement doesn’t always take verbal threats seriously. In our case , it took a long time to get anything to happen , but once it got in front of a magistrate followed by two judges, the threats were heard , taken seriously and we have been protected . The case is slow due to multiple evaluations and treatment to restore competence. I’m under the impression that’s been completed but it’s hard to tell under medical privacy laws. Because it’s been going on so long , I expect them to do something with this person soon . Trying not to think about it too much. I get that the courts have this person’s rights to consider . We’re probably luckier than most who have stalkers released on bond with a stay away order. The alleged stalker gets to continue with their life while those threatened have to drastically alter their lives to remain safe , if that’s even possible. It’s all very complicated. 😓Thank God security cameras are getting better and better.

My brother was diagnosed Paranoid schizophrenic since I was 13 he tormented me through physical abuse and trauma until he tried to attack me 8months pregnant in front of a caseworker in my parents house at a family meeting with the caseworker! Jail and prison is no place for the severely mentally ill. Our system is broken. My brother passed Oct of 2018 I am happy that although extremely dangerous to me and the community he had LOVING family where as soon as his delusions and hallucinations became obvious he was admitted for long term treatment in a hospital prior to him hurting the public. He in the 9 years I lived with him on and off mainly as a child broke my nose and my wrist. I was stalked by him and he consistently broke the lock on my door, I now suffer from severe PTSD. Our country needs to reopen all these closed down psychiatric hospitals bc most of these people fighting with extreme mental illness are ok when on medication it is the delusions however that make these people believe they are not in need of medication that everyone else is being brainwashed by the government out to get them. Keeping these patients on medication is the hardest task. Prison is no place for people severely mentally ill bc they are on a permanent bad acid trip everyday of their lives. Believe me paranoid schizophrenics are more afraid of others than we are of them bc mentally they think Everyone is out to get them.

Delusionality is *very* hard to work with, and scary because delusional people will tell you things that sound completely implausible ... but they do it without throwing any 'lying tells' because they *aren't* lying, not in the usual sense of the word. I've sat there and listened to a woman tell me, very earnestly, that KGB agents were coming into her hospital room at night and r~ping her to impregnate her with a clone of Khrushchyov. And she was dead serious; this had happened to her. It hadn't happened in physical reality, but for her, it was entirely real and she wasn't lying. When their delusions are not that outright bizarre, delusional people can be highly convincing. Vast hell has been brought into people's lives by this.

I have both fostered and adopted children who were affected prenatally by alcohol and have struggled to help them navigate through life. It’s not easy and there has been grief ,but it’s nothing compared to what you are describing. The person threatening us has a long history of threatening their family members , also . Two sisters have protective orders from their sibling . It was actually a sister of this person that wrote something on social media that we were able to take to law enforcement and we are so grateful to her. I know that realistically jail is not a long term option , but this person does not comply with treatment. We aren’t related to this person who wants to kill our kids ( some are now adults) . They think they had some type of money transaction ( billions) that never happened, not even anything close to an interaction of any kind. This person’s delusion is that there was a conspiracy involving several people . If the family members of this person are afraid for us ,we’re taking it seriously. Do you have an alternative? They’ve been through medical intervention repeatedly , according to family members, but will not comply , once released. Do we wait until they shoot our family?

School couldn't help the threats my daughter got. The police wouldn't helped. My daughter moved in with my sister and went to her school out there. My sister was a teacher at that time. And in that school any bully got expelled and couldn't return to that school. So my daughter was able to thrive in that school. And rumours just flew at her old school but no one got to hurt my baby because I refused to let anyone who was not family know where I moved her to.

@@justanothersmith6012 I don't know where you live but in NY there is a court order called an AOT order basically judges approve less than 5% of these orders. What this order starts of as 6months of a kind of probation for the person who is a harm to themself and others! Its starts with a 6month order nurses from the state come to the home , in the order it mandates They MUST take meds! They MUST attend intensive outpatient services and they must stay abstinent from drugs and alcohol. Most don't follow the rules end up having the order than extended 12months so know they have been on the order 18months. Now knowing my Brothers story the nurse from the courts came to his apartment he started slamming his head against the wall she made a major mistake and put him in the back of her car with no childlock to go to the hospital. he jumped out of the car while moving vehicle onto opposite side of traffic! Was hit by the car thank God the women had a bad feeling that day and was driving slower than normal. He was admitted to the psych ward of our county hospital which just happens to be 2 miles from my home. My son was 4 at the time. I couldn't visit him bc I had no one to watch my son. The court kept him there for 7 months while waiting for a bed in the state psychiatric hospital. He was in Pilgrim State hospital in NY for 2 years when he got out my son was 6. He lived one more year than Oct 24 2018 he took his life with an intentional heroin overdose! I flipped out! REGARDLESS OF what his diagnosis he was my only sibling! I had expected him to stand beside me as I buried my parents eventually and be part of my life. He was allowed visits in my home while on medication. He was not violent when taking his meds. I found out during my families grief my mother feared that when her and my Dad passed he would kill me bc she couldn't leave him in the will anything more than a little support in a trust so he could continue to get disability and state aid and Medicare. I know most states have some form of this court order you may need to speak to a pro bono legal aid to find out it's name in your state and petition for it. This would be the only way to keep society and himself safe I hope this helps! Stay Positive I know how hard it is to deal with chaos everyday of your life it takes a toll on everyone involved. I still have night terrors that wake my now 12 year old up across the hall who then comes in to me kicking and punching, cursing in fear, he wakes me up every time he hears it. I blackout in public when I feel unsafe and snap out of it in random places. I am now disabled can't work have diabetes and heart disease at the age of 38 my Doctors believe my heart issues stemmed from immense stress and trauma. Once I get my health together I plan to foster children who come from families with severe mental illness like myself. Thank you for the things you are doing I wish I had a peaceful place to call home as a child and you are Amazing for providing the stability children like I was need. God Bless you!

She wasn’t an expert for the defense.. that expert was the prosecutors expert witness😑🤦🏾♀️. That’s the entire freaking point of the video &; why the prosecutor &; judge Simpson kept going back &; forth towards the end of the video🤦🏾♀️😅. Duh. Oh yeah, &; no.. they can’t ask leading questions unless the judge rules that it’s okay in that specific situation &; yah, the prosecutor could’ve introduced evidence to dispute his own expert witness if he disagreed with their findings. That’s why judge Simpson and the defense kept saying the prosecutor was trying to object and argue against his own expert witness(😅😅) with his feelings and personal opinions/thoughts &; not actual evidence🤦🏾♀️🤦🏾♀️😅😅. Did you even watch the video?! 😅😅😅. Maybe the prosecutor shouldn’t have just assumed that just because she was his expert witness that she was just going to what aided the prosecution &; he should’ve done his due diligence &; actually spoken to her about what her findings were.. that’s the entire point of them being allowed to have their own expert see the defendant. She’s supposed to give an unbiased assessment like she did- kudos to her- &; the prosecutor obviously fails to realize that.

@apatheticaesthetic. -- Prosecutor requested the hearing be scheduled for that day and called the adverse witness to testify about her adverse report, but that does not mean she is his expert. Criminal defendants hire experts to prove that they lack capacity. Prosecutor had no rebuttal expert. But, he is still allowed to cross examine her.

He fully expected the doctor to do an about face after he sent her the calls. He was woefully unprepared with opposing evidence aka he tried to take a shortcut and it backfired.

@@grbenway Oh , thank God. I’m always hesitant to question some things because everybody loves him! Judge Middleton as well. He knows everybody or he knows their family. He has a personal story for every hearing , but complains there’s never enough time to get things done. I prefer sticking to the basics. It’s the defendants who are so interesting to follow.

Does this prosecutor have a law degree? He gets her back on the stand and still doesn't ask the right question. He should have asked do those phone calls change your diagnosis and instead asks if it's possible that he's lying. WTF???

So the prosecution asked for the competency evaluation, called the Dr as their own expert witness, and didn't bother to discuss with the expert what her finding is and how the testimony is going to go? Then the prosecution finds out mid questioning he doesn't like her findings?! I kinda feel like if either side pulls this there should be some penalty or fines or something. To me it seems like a lack of preparation caused a big waste of time and money. Not saying losing side should always be fined for wasting time. But when it's apparent that one side wasn't prepared and instead of asking for a continuance, taking up 10 minutes, they decide they'll roll with it and burn hours going no where, that's just pure disrespect to the court

I worked for attorney for over (18) years & I will say WITHOUT a single doubt he would’ve torn this APA too pieces in less than (5) minutes!!!! I APPLAUSE 👏🏻 too the defendant’s attorney, she was right on the ball at every angle!!!! What an complete IDIOT APA🫣‼️where did he get his license from? The tooth fairy “pro sea”???? I’ve ONLY seen a single time where the judge took an IMMEDIATE recess to calm down due to the APA’s questioning & they NOT clearly listening too what himself was objecting too!!!! Something tells me this guy may just walk possibly OR get an small amount of jail time ONLY because of the probation violation & that, too, may depend on what he’s on probation initially? And I’m also betting that APA’s boss CHEWED that APA butt up BIG TIME🤬😤‼️

This prosecutor is weird. I've never seen someone try to rebut a witness without evidence or another witness before, and be a professional lawyer. It's not about feelings. I thought he should know that by now. Poor Judge Simpson.

@@grbenway the state should have hired another expert to present an opposing argument. The expert on the stand heard the tape and still came to the same conclusion. The judge isn’t a doctor, he can’t just discount the forensic psychologist’s entire opinion because of one sentence on a jail call.

The man sure sounds competent to me. In jail call he mentions he does not want to go to jail and he might have a way out. Sounds like ue planned on mental competency. Wow, never seen Judge so upset, let alone walk away from the bench. He is usually so patient and jovial that was surprising. 😮

Could be. It could also be delusion. After all, there are people that believe in alien abductions. Are they all lying? Some probably are, but many more are probably just delusional. And there are any number of such examples. MMS, flat earth, chem trails, Holocaust deniers, etc.. 🤷♂

I'm only about half way through, at the first jail call and regardless of his competency, he speaks very well. I haven't heard a "u feel me" or a "u know what I'm saying" and no cursing!

First things first: Never EVER serve your own court papers. Pay the fee and have the sheriff's department or private service company. Sounds like this could have been avoided if he didn't do that

That I’m aware, most (if not generally all) courts have a rule that documents can only be served by a disinterested 3rd party. Among other things, serving them yourself creates a “he said/she said” about whether or not they were served, or served in a timely manner. US Postal Service with Certified Mail is probably the most hassle-free way of serving. But yeah, no self-serving!

I agree and have never heard of serving your own PPO. If she tried to run him over in the car, then she should be arrested too...unless he was the instigator. It would be an interesting trial for sure.

You did a great job, first it’s something that made me want to follow the case, I could see the issue for both sides however the point is to find out if he is competent to stand trial, the doctor says no, that the evidence proves that he did something however his recollection of the events even though he may be holding back evidence that would help her beyond words but she’s saying that he’s not competent, of course the state’s not going to like that because of his feelings, he’s allowed that but he can’t explain it to the judge he just wants to show more evidence against the defendant and the judge as well as the defense is saying no more, he should have been able to explain why he thinks the guy is malingering or lying and trying to be found incompetent. If they took this to court they wouldn’t get to far, a doctor who says he’s incompetent or the state that says he’s lying and manipulating everyone, mistrial and when you order a competencies hearing either agree or get another one, but you can’t keep doing it until you satisfy your “feelings,” the judge will send you packing.
