Thank you for being kind to the ones who couldn't pay you rent. Some were forced out of their jobs because they had children being kept out of school & no babysitter (who wouldn't come anyway cause of the pandemic). The teachers unions are very much responsible for at LEAST half of this mess! THEY should be paying the rent!

This is AFTER I was told I was picked, I qualified, and my landlord had sent in the required information. I'm a single mom who didn't receive child support all thru the pandemic & couldn't work because of LAUSD shutting down! Illegal aliens crossing the border were being put up in HOTELS that cost hundreds of dollars a night. Pakistan was given millions for gender identity studies & Israel just received $3 Billion for their military! Meanwhile, citizens struggle and live in fear & worry about whether they'll be evicted or not!! AMERICA & YOUR CITIZENS FIRST, LA!

my tenant smokes on a non-smoking 🚬 he finally caught the place on fire, I should have let it burn down. but no-i tried to put it out and damaged my lungs. i had to sell the property and take a loss. this paticular tenant is the only one that is not paying. and you do have a great speaking voice.

I had to break 2 year lease to be able to move. I was under Covid protection since I had lost my job when the pandemic broke. During that time my landlord offered to help me to move out if I wanted to return to my old city. Well I stuck it out and found a job and moved recently. San Diego housing paid my landlord the 80% I owed. Now he’s taking money out of my deposit which was 1950 to use in the gap before his next tenant comes in!

All 8 tenants in my San Diego apartment building were told verbally by the new owner's assistant that the new owner planned to upgrade the units and rent them out as short-term rentals (Air BNBs). The official notice said that the owner is taking the rentals off the market and changing the use of the building. We were given the last two months rent free. Currently construction workers are upgrading a few of the units but not all. Some were already upgraded prior to the sale. So I expect they will be up for rent soon. What can I legally do to receive compensation for having been forcibly moved out and finding only a higher rent apt? I am 69 yrs old, on SS, and waiting to get into a senior complex that could take a very long time. Three of the other tenants were 78 and two in their 80's. One moved in with her children and the other two had to move to other cities (Detroit, La Mesa) to find affordable housing. What can we do? The owner obviously evicted us for higher rent. Thanks

You should discuss the situation with an attorney from lawhelp.org (it's free or low cost legal assistance). They attorney will help determine if lawful and proper notice was given...especially if they aren't really changing the use of the building as explained in the notice.

HI, I am a landlord and I have the following two questions: It sounds like, whether the tenant files or doesn’t file a COVID-19 declaration; or applies or does not apply and receive state rental assistance, I cannot evict him for non-payment of rent until June 30th unless I am evicting him(the tenant) for no fault categories? In other words, can I evict him for non-payment of rent if he does NOT provide to me a blank covid declaration? Also, I’ve seen in the SB91 bill, page 20, what are described as “covered period - 3/1/21-6/30/21” and “protected period - 3/1/21-8/31/21” What are covered and protected periods in the context of page 20 from SB91? Hello Dennis, good questions. Even if the tenant does not return the blank declarations, if it gets in front of a judge, the tenant can perfect this, meaning turn them in at that time. So it will be tough to evict. Run your scenario by a good, local eviction attorney. As for protected versus covered, the distinction really isn't all that important, IMHO. I just got an Unlawful Detainer complaint filed against me. I was denied rental assistance when I applied the first time. I decided to submit another application because this notice is a clear threat of being unhoused which is one of the qualifications listed on the Sera2 website. Also I'm not sure how the landlord was able to file this when the reason I fell behind on rent was due to covid.

What about if I can’t pay rent for the upcoming months (feb, March, April, may 2021 etc). Are tenants safe from eviction for any of these months? Not sure if I missed the answer to that in the video. So informative and so helpful btw. We really appreciate the knowledge!

According to SB 91, tenants are protected from eviction for nonpayment of rent due to COVID-19 through 7/1/2021. If you miss those months, you'll need to make sure you pay 25% of the rent for any of those missed months by 6/30/21. Good luck!

Its not that you never have to pay the rent-- its just delaying it. You will owe all of it at the end of the moroatorium. This law is misleading and unconstitutional

Great info Christian! What about if the one tenant I have that can't pay any rent is my 37 year old son? In April of last year he was forced to close his brand new shop in LA and eventually he lost his lease, his business, and all the money he put into it. As a result of no income, he hasn't been able to pay the $800/month rent on the duplex I own since then. Can I/we qualify for the 80% rental assistance under SB 91 going back to last year even though my tenant (we have a legal rental agreement) is my son? I haven't found any restrictions on father-landlord/son-tenant situations but what's your take on our predicament?

Question: A new landlord just purchased the 4/plex were I live in and he just gave me a rent Increase notice of over 23% and he gave me 60 days to comply with the rent increase. He states that there is a law here in California (I live in Huntington Park) were a new landlord can increase the rent as much as he wants do to his mortgage been higher than of the previous owner. Does this law true? I have a Month to Month rental agreement and I have never stopped paying my rent.

This is not true! If the property is a 4plex, it would be subject to AB 1482, which means that annually the rent can only be increased 5% plus Consumer Price Index. This kind of landlord gives good landlords a bad name. I would reach out to Legal Aid for help and ask them if it qualifies as harassment from your landlord...you may be surprised.

Great question...it's a tough call. As long as you carefully screen and choose an applicant with strong credit and income, odds will be in your favor, but there are no guarantees.

No, the proof of service doesn't need to be attached. It needs to be appropriately served, but proof of this can be separate, e.g. an affidavit of service.

Luckily I have a tenant who is paying the rent. They are month to month and I would like to send them a termination letter because I would like to sell the house. Does this fall under the no fault reason for termination for removing the property from the rental market? The property is in Ca. I notified the tenant via certified USPS mail that the property was exempt from AB 1482. Would I still owe them relocation expenses?

Hi Christian, our tenant has a month to month short term lease, less than one year, from December 2020 with a hard end of May 15, 2021. She has created threatening scenarios where 2 male tenants had to move out (one replaced the other so this lasted a two months), she sublet the home, she lied about an unlawful detainer on her application (we didn't catch it until later), she has never paid her full security deposit, and now she has a "legal advisor" who had her fill out the covid "can't pay rent" form. So, questions are: Does this new bill apply to short term tenants? Can we move family in on May 16, 2021 when her lease expires? What documents do we need to make that happen? She has a baby and her legal advisor says Good Luck on trying to evict her during this housing shortage...Thanks for any answers! Katy

One thing to note, she is technically not a short term tenant, that usually means a tenancy less than 30 days...and there could be different laws for that scenario. 😀In my nonlegal opinion, SB 91 will apply to her. You'll need to hire a good, local eviction attorney ASAP to help sort through the specifics on this one....assuming the lease had the correct, required language about a relative moving in and you don't renew the lease, then you may be able to move to an unlawful detainer if she doesn't move out. An attorney will help sort through this. Good luck!

So barring the other lease violations, do I understand the math? The monthly rent is $3,000/month. The Covid financial distress form allows tenant to pay less each month, however, she responsible for the entire amount eventually. For example, if she pays $1,000 in March, she must pay $250 by June 30, 2021, and the additional amount due of $1,750 by July 1, 2025 which will be awarded to the Landlord in small claims court. I rent a room in a 4 bed 2.5 bath house with 5 adults and 2 kids. The landlord is a non-resident. I would like to know what my rights are for privacy such as: can they visit the house whenever they want without notice? can they “inspect” my room even with notice but provide no reason for the inspection? Also all the signage they leave in the house about what we are not allowed to do. I am in California and not sure if I am considered a “lodger” and if I am what rules do they need to follow. Lots of websites either provide info related to San Francisco or L.A. areas, not specific to the county I am in. I cannot afford to move but I don’t want to be taken advantage of or harassed. I also have a medical condition that if I am stressed to much I have seizures.

You should definitely reach out to your local Legal Aid office for assistance. You may be a lodger, but Legal Aid will be able to give guidance. You can also reference your lease for these items. They should have to give you a minimum of 24 hour notice for a walkthrough.

Great video as always! Landlord here in the Bay Area. My tenant moved out last month and owes me significant amount of backed owed rent from April/November 2020 due to the pandemic. For this 80% payment, will I need his cooperation? I offered him some advice on how to pay me back with this stimulus in December helping out landlords and he basically told me to take a hike. I guess I can always take him to small claims, but if I can get 80% of the payment from this new bill, I would probably just move on.

I have been without water for 9 months and live in a high risk fire zone where we were evacuated last year. Landlord cut utilities. House is in probate. I'm exhausted from getting water to survive and we are coming in to fire season again which stresses me to the highest level. I'm having a hard time finding a place to move to. What can I do?

@@WIREassociates the executor is the one who is causing all of the problems. I took care of thier dad until he died and called her immeditally when I found him dead on the couch. They did not come to see if he was ok when he did not answer the phone for a whole week. He asked me to move here to help him and help me. Now they are trying to call me a squatter which is far from true. Most all of the attorneys around here are for the landlords. I have tried to find one that is pro tenant to no avail. Legal aid is so backed up that they say,,,, Are they still trying to evict you? No not again not as of yet. But i have heard rumors in this very small town that they are trying to say I poisoned him. I took care of him when he told me he was sick for days. I washed his soiled sheets, tried to get him to eat, made fires for him to stay warm, took care of his dog, I was there for him but they are so cruel to me. I live in my trailer now on the property because rats came in while we were evacated and I couldnt take the invasion any more, They have destroyed so much of my property and the house. I do not know what to do any more. I have read that turning off the utilities is a violation of tenants rights in Cali and they could be liable for up to 100.00 dollars a day for every day that the water is off. Is been a long time and water company will not call me back. What should I do? Who should I call?

Just want to say thank you for this information. My question is my tenants are on a month to month rent without a renters agreement or lease. They have been served with an eviction notice and given 5 month of rent free in order to move out. From January of 2021 to May of 2021, but now they are seeking legal action and do not want to move out. P.S they DID NOT suffer any Financial losses due to covid.

You can find one through your local landlord or apartment association. Some questions they will be able to address: was the eviction notice valid? Do they have a valid case against you for any reason? You definitely need a good attorney in our corner to help!

You can try to evict them and when you go to court they will have to prove that they lost income. If they fail, you win. Just be careful not to get a liberal judge because they might feel sorry for the wife being incapacitated and side with them!

Hello, in this video you mentioned that if purchasing a SFR a new buyer is allowed to evict current tenants (with 60 days notice) but that this does not apply to multi-family properties. I am looking to purchase a 4-plex and live in one unit but many are fully occupied. What types of no-fault evictions are available for multi-unit properties? What if we are also planning a major renovation?

You'll need to get a good local eviction attorney involved. You could say that you're taking a unit off the market, because you're moving in. As for the major remodel, it will need to be for habitability, not just for cosmetic upgrades. Your eviction attorney will give the best guidance.

You need to reach out for legal assistance ASAP. You can find free or low cost legal assistance by looking for Legal Aid in your area and/or visiting lawhelp.org. The CARES Act was the first bill passed for stimulus help. There were funds in the CARES Act that were distributed for renters in some areas. The new stimulus bill that passed at the end of December had funds for California that are being distributed at the state level and some local municipalities as well. In many cases, wherever the CARES Act funds were distributed, then the new funds will be coming from those places as well.

We have a tenant who hasent moved out for months after giving us a move out date. We have it in writing and signed. She have been a nuesance ever since. Asking us to clear the parking lot for days so she can start moving only to have no movement. Asking us to come by to pay rent, but then when we come by she is absent or not willing to talk. We cant cant to get this person out but the courts havent got back to us.

Yes, that's in SB 91...I haven't touched on it. It will become a bigger issue when landlords are finally able to take tenants to small claims court because that's when they will have to explain. Is it me, but doesn't that part of SB 91 seems like a trap for the landlords who don't cooperate with the state Rental Assistance Program ? I'm going to have to do a video on that...

@@WIREassociates Let's be honest-- both AB3088 and SB19 are full of traps for the unwary. You can't take any retaliatory steps against tenants for missing rent, you can't base housing decisions on anything that occurred during thie COVID period, you can't sell or assign Covid Rental debt until a date certain. Someone is going to put two and two together and sting a large property owner badly.

You'll need to discuss with a good local eviction attorney. If they've lived there for longer than a year, then they will need 60 day notices, no 30. You'll also have to make sure that you are terminating the tenancy for an allowable reason. can you have in the lease that the tenant also has to give 60 days notice to vacate after one year. and we should have the option of paying back the after the moratorium is lifted. also another question: the tenants were give a 3 day notice before the shelter of place went into effect. they owe over $5.000. can that be deducted to from the deposit.

Yes, you can require that a tenant gives a 60 day notice in a lease as long as both parties agree and sign. If they move out and money is owed, you can deduct form the security deposit and go after the rest in small claims court starting 8/1/21. Good luck!

I don't see the link showing how to determine area median income. Please advise. My tenant and property are in Pacific Palisades, CA and I see the LA Times published some stats a while ago that show the actual median income for Pacific Palisades, but I am not sure if the SB91 requires using any specific region, like City of LA as a whole, but that seems like it would be unfair as there is quite a range of incomes. Also, there are apparently different types of notices to tenants depending on whether they are "Non-high income Tenants" or "High-income Tenants" While our tenant would normally fall under the high income category, in 2020 that is definitely not the case. Which year of income should we use to determine which form to use? We don't know 2019 as they have been tenants for 3~4 years, but we have a good idea of 2020 income. As for "high income," run it by a good local attorney, but if you have proof that they were high income form the application, then you can still treat them as high income. BTW, SB 91 did not create a separate notice for "high income" like AB 3088 did.

@@WIREassociates Many thanks. I am watching this now daily. SB91 actually says "no later than March 15" so will they wait until the last day? Really appreciate all your information. I think you said in one of your videos that people should not apply to both the state and the local program (in my case CA and LA City). Wouldn't it make sense to apply and just accept the one that works better? We don't know which one will have more funds available for our circumstances. Also, regarding the HUD calculation which I found on your other video, does it make sense that LA County is only $77,300 when Orange County is as you said about $103,000? I feel like I am not looking it up right. If one property is in a low rent district and other is in a higher income area, that would put the people in higher income areas who are struggling at a real disadvantage. Many thanks again!

Hello I commented on a past video. My landlord gave me a 60 days notice in December because they want to sell. I paid all rent on time except in January I paid 25% to catch up on car payments and insurance etc. Yesterday the management company came over and handed me papers saying 1. I’m not allowing real estate agent to come in 2. I am subleasing (which I’m not). The owner wants to come in and do upgrades and Ive already let them in 3-4 times. I have kids here ..I’m trying to catch up to move but need allot more time as I can’t afford this area. A lawyer said they have a right to sell property which is not what I’m reading or understanding here.

You can try this link as well: www.lawhelp.org/ I can't give legal advice, but I can tell you that they can't give a 60 day notice just because they are selling...this is against SB 91 (and AB 3088). They can potentially terminate your tenancy if the buyer is going to move in, but they need to be under contract with a buyer who is going to move in before giving THAT notice.

The notice of termination has 2 boxes marked which are B. owner intends to withdraw from rental market. E E. Owner entered into contract to sell to a natural person AND purchaser intends to occupy the property AND title to the premises is Exempt. The owner wrote me a note saying she wants to get property on the market asap and wants to do upgrades but the management company sent me a "Notice of Sale and Entry" in December. Along with the termination notice in December they sent me "rent cap and just cause addendum" dated in 2010 for me to sign which Im not signing. Also the management company sent me blast email they said was to all tenants that the property is NON Exempt. Legal aid is not helpful because they dont know specifics and attorneys are all for the landlors because they can afford the retainer fee. Im wondering if you know if I have to let a realtor in to the home to sell?...because this was the new paperwork they sent yesterday that IM refusing to show property but I have letters saying the real estate agent needs to come in here and do upgrades before selling. so they are not showing the property yet. Im not understanding how they can sell a property without the buyer seeing the property ....but I guess it's possible.

I can't give legal advice, but have heard attorneys say that you must cooperate with showings, i.e. let the real estate agent in, as long as you were given proper notice. If you don't, they can potentially evict you, depending on where you are. Maybe ask to see proof that they entered into a contract and the buyer intends to occupy (if the buyer intends to occupy is mentioned in the C.A.R. Purchase Agreement). Keep trying with Legal Aid or www.lawhelp.org/ Make a list of the facts with dates and copies of the notices and rental agreement to give to Legal Aid...this could help! Good luck!

@@WIREassociates I did and they do not have much help for commercial properties, even though LA's moratorium treats both residential and commercial the same! This moratorium has given everyone a false sense of security once the Oct 5 passing of some legislation allowing landlords to pursue UDs at will. That Oct 5 detail took me so long to find and it's buried in the legal details of the govt website (State, I think)

so my unemployment ran out in August and I have been struggling to find work with no luck. I have been renting this house for over 6 years with zero issues or problems yet I haven't been able to pay rent since august. my landlord has been harassing me telling me that I need to move to a cheaper place, I need to get a job, that I need to pay now and that I am just taking advantage. she also comes super late at night, after 9pm, and takes pictures and creeps around the property like a weirdo. she has taped up the CDC Declaration info all over the garage and front door, which I already had and have been sending her each month to protect myself. now she sent me a 15 day notice and is lying saying that I have subleased the property without her permission!! she told me back in October, which I have proof of, that she will allow me to rent out 2 rooms here to help out with rent. I did find 1 person and have been paying partial rent since we still can't afford to cover the whole amount but now she is using that against me to get me out. she put notes on peoples cars on my street 2 weeks ago saying not to park in front of HER house and that she is going to be evicting me. I had a neighbor call the number she left on the letter, he put it on speaker so I could hear, and she flat lied saying she didn't know who was living in her house and that I rented it to some stranger and moved out! so yea she is making things up when she knows I live here and have been here the whole time. so yea I covered more then the 25% of back rent owed by Jan 31st 2020, plus i got her on video denying the subleasing allegation when she came to plant a random tree in the front yard. so I hope if I get dragged into court that I can use that against her. I am still sending the old CDC Declaration since I can't find any updated one, I hope that still protects me. here in California we have till June 30th I guess for eviction protections but my lease is up in July and I plan on moving out of California anyways. We still don't have access to any rental assistance, I have all the documents ready to go to apply for that to get everything paid and back on track. nobody asked for this and I have been a model Tennant and renter for years so for those who say people are deadbeats for not paying rent then know it's not 100% the renter, there are crazy landlords out there as well, I have one. : (

I am familiar with the laws and I know she is violating them. I have warned her a few times that I am going to report her and that there's steep penalties for doing what she is doing. if she keeps it up I will just move forward and report her.

I have a few questions for a low-income Disabled Tenant, living on a fixed SSDI income. 1) Can a Landlord raise the rent immediately following a repair to the property, even if he claims the raise is not due to the repair? (which he can prove it was). 2) Can a Landlord increase rental payment, so that Tenant essentially reimburses Landlord for the recent repair? 3) Can a Landlord increase rental payment, so that Tenant pays for repairs still needed to his property? 4) Can Landlord evict Disabled Tenant to avoid making needed repairs to property? 5) Is the Tenant legally protected if he refuse to pay rent increase, because needed repairs havent been made to the property in the last 5 -10 years? (I.e. Broken/non-working/rusted lighting fixtures, stucco repair, dilapidated dryrot fence, non-working outlets, leaking toilet/warped flooring, 29 year-old-badly-stained carpet, no new indoor paint for 16 years etc.) (Note: The Landlord informed the Tenant he would raise the rent if he made the repairs. So the Tenant has not insisted on the repairs. The Tenant is Disabled, living on a small monthly SSDI payment, with nearly all of his income going toward rent, and would be in dire straights if the rent was increased, or if he were evicted from the property). 6) Can the Tenant hire repairmen to make repairs above and deduct it from rent? 7) What is the maximum amount a Landlord can raise the monthly rent right now during COVID season for a property located in Palmdale, CA (Los Angeles County)? (Current rental payment is $1475. mo) How often can he raise the rent? 8) What Agencies can help a Disabled Tenant whose always made their rental payments on time for 16 years, contact for help if Landlord attempts to evict Tenant for not agreeing to increased rental payment, without repairs being made? 9) I heard that apartment buildings are required to replace carpet every couple of years. Are there any requirements for a HOUSE, to replace 29-year-old badly-stained carpet that is seperating and shredding at the seams, and caused tenant to trip over? Also, there is a dilapidated wood-rot fence in the backyard which the neighbors 4 dogs have broke through on a few occasions. This Disabled Tenant and his Service Dog are unable to go into the backyard due to the dangers posed of being attacked and mauled, as his previous dog was. What can the this Disabled Tenant legally do to have the fence reinforced/replaced so that he can use the backyard that he is paying for, without being penalized with a rent increase? He is in a compromised position. What Agencies can help him? Thank You So Much For All Your Help And Advice. It's MUCH Appreciated! 😊

Two places to turn for help are by googling "Legal Aid" and your area and/or visiting www.lawhelp.org/ (this answers #8) Here's my nonlegal opinion on those questions. Yes, a landlord can raise right now unless there is a local moratorium that prevents it. Most landlords aren't raising rent right now because they don't want to rock the boat...tenants can easily stop paying rent right now as long as they are effected by COVID-19. All the tenant would have to pay is 25% of missed monthly rent by 6/30 and they won't be able to be evicted. So this is a disincentive to increase rent right now. As for the maximum increase, it the property is nonexempt, then it would be subject to AB 1482, which means the increase would be a maximum of 5% plus CPI (which is around 1% right now). But some houses, condos, townhomes are exempt and the increase can be any amount. BTW, a rent increase would need a minimum of 30 day notice. #6 Yes, a tenant can do this if a landlord refuses to make health and safety repairs (or gives a tenant permission to do this). #9 No, there isn't any requirement for rentals to have their carper changed every few years, unless there is a local law stating this, but I don't know any areas that do. Hello, we are in a home and have lived here for three years. Our lease just expired and they switched us to month-to-month. They just informed us that we will be getting 60 day notice because they are selling the house. They also informed us they will be hosting an open house next weekend with two people at a time coming in. I informed them that I am not comfortable with this because I am high risk for Covid. Hi Melissa, where are you located? The California Association of Realtors currently recommends no open houses, so I am a little surprised by that. They also can't deliver a Notice to Terminate Tenancy unless the buyer is moving in, which obviously they don't know yet. Thanks so much for the reply. I’m in Northern California. They haven’t given notice yet but they said they expect offers soon. The realtor said it would be an open house style with 2 people coming in at a time. I told her that I’m high risk due to my disease and on immune suppressant drugs. I’m also preparing for surgery with a 6 week recovery. I don’t even let family over. She didn’t listen and is planning on still doing it this Saturday. I was just wondering if I can be evicted if I don’t let her in due to being high risk?

In my nonlegal opinion, SB 91 mentions that the Rental Assistance Program funds are only for back rent and utility expenses. I don't think legal fees fall into the back rent category so I don't think you can be reimbursed through that program, but clarify with a good local attorney.

I believe the attached is a direct quote from SB91. Please clarify, why you think legal fees would not be an obligation: (i) “Rental debt” includes rent, fees, interest, or any other financial obligation under a lease for use and occupancy of the leased premises, but does not include liability for torts or damage to the property beyond ordinary wear and tear. My lawyer has read it and feels as though SB91 is silent to stuff, but I am so beat up... at this point I think I will risk it and shoot for 80% of the debt. Currently the debt includes legal fees. I know you are not a lawyer, but even so... I am surprised by you (and my lawyer) not sounding out with a 'YES' legal fees are either part of 'fees' or part of 'any other financial obligation'. I see it as a 90% clear. Either way, thanks for the response.

I'm a landlord who needs to move my family into the rental unit, i emailed my tenant to let him know my intention since last August and told him I'm willing to work with him on returning his deposit once he finds a new place, he replied with a threaten email that he's protected under the California eviction moratorium and he can take me to court. I understand that the eviction moratorium is for those who can't pay rent due to the pandemic but he's always paying his rent on time. I would like to work with an attorney on the issue but don't have any lead, would you recommend one? My property is in LA county.

Doubt it if your tenants have no money. You'll have to ask them in writing to use their deposit to cover any outstanding balance on owed rent. Good luck with that

SB 91 changed this...your tenants now have until 6/30/21 to pay the 25% that was missed. s for the 80%, your tenant will have to be considered an eligible household (I discuss in this video what that means: kzitem.info/news/bejne/s6GcwKinnGSmrIY If you take the 80%, then you won't be able to evict them for the nonpaid past rent or go after the other 20%.

The short answer is no, unfortunately, the bill doesn't address this scenario. The bill does say that a landlord or tenant can initiate the claim, which is good news for you, but we won't know what is needed from the tenant until the set up the application process in March.

I believe my tenant lost her job before COVID (cannot confirmed since tenant refused to communicate), and the lease expired 12/31/2020, we had communicated to the tenant since Oct 5, 2020 that we were not renewing the lease. Tenant is not moving out, nor paying any rent. Does it consider under at fault? The tenant never signed the covid forms that we provided.

Yes, a notice can be given before 6/30, but it needs to be a remodel for habitability, not just cosmetic.

Find a good, local eviction attorney for guidance on using at fault or no fault just cause to terminate tenancies. If it's no fault just cause and the property is not exempt form AB 1482, you will owe a relocation fee.

This doesn't seem like the correct use of "withdrawing from the market" but an attorney (and ultimately a judge) will give guidance. The courts were closed until August 2020 for most evictions, but are open for evictions again as long as the evictions follow SB 91. Some areas may have a local eviction moratorium that is more strict than SB 91. A good, local attorney will know.

So I’m being told that I need to pay $5000 in 24 hours if I want to stay but if I don’t pay that then I have to pay $1000 & leave tomorrow they never gave me a notice I don’t know if I’m being evicted or a chance just to get out the lease I’m very confused because I also was told by family that my landlord cannot do that but I read online it said that the law of eviction has been banned but now it’s expired so I’m so confused at this point I don’t know what direction to go

Do you mean a lease or rental application? If you don't have a lease, then you should get one in place ASAP. If you don't have an application, that's OK, but make sure you have policies in place for leasing in the future that include applications from all prospective tenants.

I was wondering one last thing - In SB91, there are punitive damages (page 9) to effect of $100-2000 against landlord for committing “fraud, oppression or malice” and $1000-2500 fine on the landlord for utility cut-off, possibly for reducing services. Are there any fines on the tenant for committing perjury on the COVID-19 Distress Declaration?

Thanks for watching, Judi! Technically, it's up to the landlord to deliver the blank declaration to you each month that you miss. And then yes, you would sign and return one for each month...there's no change in this in SB 91.

I had the same question however listening to his video he does sort of allude to the fact that the new SB 91 bill takes over and the 25% will not be due now until July 1 and that includes what is owed this weekend that’s how I took it in the video but I would like it to be 100% clarified also

Hi, was wondering if anyone can help answer my question So I paid my rent in full on time for this month & then my landlord handed me a rent increase notice of 11% which would be effective 30 days from now. I then informed her that anything above 10% requires a 90 day notice & thats when she got irritated and replied by telling me just for complaining that I'm now being evicted & to move out by the end of the month. So my question is, does the 30 day eviction take place from the day I was told to move out even after I paid in full for the month? Or does the 30 day eviction process begin after the month that I paid for is over? She refused to refund my rent and she hasn't given me an eviction letter but she did let me know about it by text. I know this is considered retaliatory eviction but just wanted to know if I have to move by the end of this paid month or the following month? Thanks

You don't need to move at all since you haven't been given any legal notice. This is why the laws were created...for landlords like this! You need to reach out for legal assistance ASAP and share the texts with them. You can find free or low cost legal assistance by looking for Legal Aid in your area and/or visiting lawhelp.org. A good local attorney will help you understand your rights in your specific situation. Good luck!

@@WIREassociates She actually just gave me a legal "60 day notice to quit" document by AAGLA. So even though I paid rent in full a couple of days ago. My 60 day eviction notice still begins today? Or after the month is over? The letter says it begins today but I doubt she mentioned the fact that I already paid her in full for this month

Yes, chicken or egg for sure. This is one of many reasons why landlords need to have strict screening policies that require proof of income and then keep good records. With these records, landlords would have better proof of "high income."

One question: was the tenant in possession longer than a year, because if so, it would need to be a 60 day notice. As long as the notice is correct and lawfully delivered, then you can move forward with an unlawful detainer...a good, local eviction attorney will be able to give you the legal guidance you need.

Once again great information. Your videos and what is happening with tenants and landlords in California has given me some ideas on how tenants should be helped in Ontario. Currently, the government has down little for tenants and we are facing too many lockdowns for everything and tenants are being evicted left and right 24/7. The current lockdown being 82 days.
