So with what's going on in the world today. It's been so hard to get in and see a doc. There saying 3 months for the PA to see us. I messed up my back and knees on a combat deployment just getting back a couple months ago. They also made me jump as soon as I got back. Didn't believe I was hurting until I got my MRI. The 82nd way I guess. Should I go off post to have someone look at my legs and having migraines a couple times a week getting more and more frequent. Thanks in advance..

Brian, thank you for the videos. Very informative and relevant to our Veterans when attending a C&P Exam. I recently attended my exam for lower lumbar strain increase. You have to input as much information as you can in the forms they send you. DO NOT LEAVE ANY LINE BLANK!! Just like you stated, do the research "Google your conditions! I went from 10% to 60% for Intervertebral disc syndrome and Radiculopathy, sciatic nerve for both legs. Keep up the good work!!

His estimation: He didn't feel that he made any errors. She listened and seemed accepting that the pain he described was real. Waiting game now. God is in control. May His will be done. C&Ps can feel cold, it's common, but as long as he described his pain as best as he could, and communicated how it affects him daily, he will surely be approved. hey Brian, during my C&P examination the LHI rep stated "off the record" that the VA is telling them to not note pain in a joint We need to make sure Vets are listing this on their statements.

There is no such thing as off the record at a C&P exam. The entire purpose of the exam is to put things on the record.

I had my exam for ankle and knee pain and they were denied. Under the evidence, he listed that no pain was noted. That's BS, I specifically told him about my pain and flare ups and how his exam caused me pain.

How about the spinal cord, I have a remand that they rated me at 10% but I am wheelchair bound because my spinal cord was pinched off and they didn’t add loss of use of my legs?

Brian you are on target on the issues of veterans....as for me I hate everybody "equally"...stay away from people is normal way of life...Back condition is a bitch...my 40% rate and daily pain...no surgery for me just deal with it and life moves on we all should fight to get 100% and all conditions....keep filing secondaries because we all have them.

I've diagnosed with Bilateral Foraminal Stenosis at L5, S1. My back, legs and feet hurt at trying to walk. I'm at 100% P&T with SMC(L). Is it possoble for a Loss Of Use claim. Had lower back injury in service documented.

It is possible, but just remember that anytime you file a new claim the VA can re-evaluate any currently service connected disability.

I injured my back in the military in 1989 and it’s documented in my medical record. I’ve been going to the VA for the past 20 years and was diagnosed with a herniated bulging L4, L5, S1 disc. The VA doctors have been filling out my family medical leave act documentation which Says that I can miss work between 3 to 4 days up to three episodes per month due to incapacitation. I filed intent to file July 20, 2020. I am currently waiting for my rating for my back injury as well as PTSD and other secondary conditions.When I went to my C&P exam, my range of motion was less than 10% on all angles and I experience pain at the 5% range of motion. With my losing money due to missing work due to incapacitation for two or three months every year, I should get rated 60% for my back. What do you think Brian? It is also documented in my VA medical records that I have complained about sciatica, hip pain due to my back, and these are secondary conditions. Radiculopathy I will claim as a secondary condition because my lower extremities are tired all the time and they ache all the time and the sciatica pain goes through my hips, my butt, my legs and my feet.

Good morning Brian! I apologize for both the length and change of topic... I tried searching but perhaps due to my own ineptness wasn't able to find a video to address my question to so please bear with me. If I have spondylosis L4/5 and an extruded herniated disc L5/S1 is that one claim or can they be separate? Now the curve ball; I have hydrocele left testicle and a "small" but painful varicocele in the left testicle... can I claim a hydrocele and varicocele and if so separate or is a teste a teste? Elite member here. I have been denied twice now for my back. I submitted a diagnosis, nexus, DBQ, buddy statement. My C&P wrote what is consistent with a 40% rating. There was a duty to assist error, so they sent it to a family practice doctor who said it as least as likely as not service connected. I feel like the failure to assist error caused them to seek another medical opinion. Am I wrong thinking this?

You only pay if we assisted you getting the rating increase. If you filed a rating on your own with out the assistance of your coach or our independent med team you wouldn't pay for that increase. But if we help you for rating A & B, and then assist you for C, yes you would then pay for all 3.

Make sure you go to Doctor and get everything and anything that hurts documented also make sure all of your complaints are then submitted during your out processing. It'll make your process a lot easier. Also request a sleep study asap before you separate.

@Elmore, never assume the rater has your records. Any time you submit a claim you want to provide all relevant medical information and evidence to them. Don't rely on them to go and look for it.

That amount is the backpay from when you filed your claim to when it was approved. Moving forward the monthly compensation for 20% is $284.93. I had herniated discs while in service which led me to get a medical discharge. But when I was applying for disability they didn't have any section for herniated discs so I selected hernia general. After googling I saw that this is a different type of hernia than what herniated discs... Any idea on what I should do??

March 1st of May 23 I suffered a massive hemorrhagic Stroke and I have pretty much been piloting the sofa ever since. You talk about Lost, that will strip you of your stamina energy and everything else. I'm mostly just a bag of bones right now. I've lost 80 lbs. Unintentionally and I'm just a shadow of my former self.take a look at a song by the group Enigma from 2022 titled return to innocence.that helped me.

@Donald, the VA still uses DBQs, but only allow their doctors to use them and will not accept private use DBQs. our network of independent medical professionals saw this coming and now provide our members IMOs. Independent Medical Opinion Letters for them to use.

I received a 20% medical discharge for sponylisthesis. 2 years ago I received new diagnosis of disk hernation and arthritis as well as lumbar strain and radiclothapy. I applied for increase to the spondy disability and secondary for my nerve. I was awarded the nerve and they only updated the spondy to reflect the new diagnosis of disk herniation and spinal stenosis. My question is can I file separately for the ivds and arthritis and lumbar strain despite the VA combining those issues into my original spondy disability?

82nd Airborne Division Veteran, did 8 years as a paratrooper and had a parachute malfunction a few months before ets. I did get seen in the military prior to ets however wasn't told anything about va or claims despite leaving military with spinal stenosis, radiculopathy, sciatica and spinal degeneration and it it's a combined 40% for "lower back strain" lol. Anyway also have chrondromalacia of my patella joints in both knees, hearing loss and now Gulf War syndrome claim ahead plus another C & P exam this week for lower back strain evaluation. Summed up I'm 80% va rating however it shows 90% when I add but va won't budge past 40% on back issues and I've been fighting the VA since 2010 with major pains, on SSDI but don't qualify for unemployability because no rating is above 40%. What else can I do? I had Veterans Law Group btw worst experience and the VFW helped me get more small increases than anything I paid for with money. Please help me, been fighting the va for years and years and I'm 45, my wife has to help me with many tasks like putting on jeans because bending hurts bad and also cant grab food or anything from bottom shelves. Overall BS the VA, I have a bachelor's but can't sit long enough without spasms for a degree that is just a piece of paper on the wall. Also was diagnosed with sleep apnea at 43 and hopefully that claim goes through because my 60mm mortar gun position was up against a burn pit in Kuwait and we burned shit trash like MRE trash and nitroglycerin packs thus later after the military was waking up not breathing with headaches thus I filed a claim for Gulf War syndrome which Veterans Law Group didn't pursue but my VSO recently added it because diagnosed with sleep apnea and need a cpap now.

It could be a ratable claim, you need to make sure you have a current diagnosis for it and you'd also need an independent medial opinion nexus letter to help tie it to your time in service.

So I have a question, I am fighting a denied disability right now. Mainly it so my back and neck. I finally was able to get all records needed, and buddy letters. So I do think I have a good chance of getting the denied switched to a percentage. I just left my appointment and I don't know I have a good feeling that it will be reversed .......now my question with all that being said, do they back pay you from the first time you filed for the disability for your back or whatever it was and they denied you or just from the time you filed your dispute to their decision? Just seeing if anyone knows..my opinion it should be from the initial time when I submitted it but I can see why they wouldn't want to do that. Thanks for all the good information, love this channel and has helped get me from 30 to 50 already.

If you kept your effective date alive through appeals they will pay you back to that date.

@@VAClaimsInsider working on that. Recently got my Gerd service connected secondary to my feet and now sitting at 30% monthly . Working on getting into the VA Healthcare system now. Hopefully I can submit a claim for my back problems later this year.

Been 10% for lumbar 17yrs Suddenly my legs started goin numb and weak Backs of my thighs go tingly and i cant walk almost at all Nearly fall down few times a month Im terrified at what future holds

I went to the VA for my diabeties check up and was asked about my back, she said (nurse practioner) on a scale of 1 to 10 how would I rate my back, I said 50 to 100, she said I'll get me a back x-ray (that never happened) and a blood pressure monitor (that never happened) was suppose to se the nurse practioner in 3 months (instead saw a dietician). The only thing I can think of is since biden took office, it is now okay for the VA to LIE TO THE PATIENTS at least this is how it seems to me. So I have taken matters into my own hands, I now take 1500 miligrams of pain killers every 12 hours to cure my back pain since the VA will not do anything about it and as far as going to the VA, I can't walk any great distances anymore because of the diabeties. So I guess I am just left here to die by my own hands, and God forbid they won't issue hydrocoridone anymore and tramdole makes me sicker than a dog, so I take equate 3 tablets of 500mg each every 12 hours and if I can't get rid of this back pain soon, I may increase to every 6 hours or every 3 hours until I am dead. You seem to offer great advice, but so far, that is is "great advice" and on my end, I will have to do all the walking (which I can not do anymore) and all the talking to doctors to get it raised (so if I can't walk, I can't talk to the doctors to get it raised. Thank You for letting me have a place to vent my NEW ANGER AT THE VA.
