I appreciate the detailed talk. Without the details this type of talk is near useless and possibly dangerous. Teach your children about handling financial assets. Take your children with you to meetings with lawyers etc., when possible so that they have roll models. Pre-nuptial agreements are a good thing for most people. All above is my opinion and not meant as advice.

We are still waiting on the IRS to better define RMDs in 2024. So far they have waived penalties on folks who did not take RMDs on inherited IRAs for 2021 through 2023. Sounds like the thought process on funding the government, kick that can.

Per the Secure Act, traditional IRA non-spouse beneficiaries have to withdraw the total account balance within 10 years after the IRA owner dies. What is the Secure Act rule on the required distribution timeline for a non-spousal Roth IRA beneficiary? I am getting ready to name my Living Trust as my Roth IRA beneficiary so as to have security income in my trust to pay my mortage payments until the house can be sold. The house & property are already titled in the name of my trust. I really value and appreciate you insight on this situation.

What happens when an IRA owner named her spouse as the beneficiary on her IRA, but the trustee of her trust, named others as the IRA owner's beneficiaries in their trust, but didn't change the beneficiary on the IRA account. When the IRA owner dies, does the beneficiary on the account override the beneficiaries named in the trust?

We have an irresponsible beneficiary; my strong inclination is donating much to charities. My mother named a drug addict relative as the executor of her will. The outcome has been demonstrably horrible.

Sure you can. You can name whomever you want as beneficiary.

Likely the spouse would need to agree to it and sign of form or an affidavit in front of a notary. In one case in my experience, this was required even to name our living trust as a beneficiary of my retirement account rather than naming my spouse who was co-trustee.

I enjoy your channel and have learned a lot. I have 2 episode suggestions: 1. I am in a retirement planning group, and a lot of people, especially older ones, think they should put their family members on their house deed. Some neighbor told them to do a quit claim deed and all will be well. They want to avoid probate or protect from Medicaid, but they don't realize they lose the stepup and that there are risks that they could lose the home in a lawsuit or end up co-owners with an ex-inlaw. A friend did this with her 5 kids and when she had to sell it, it was a nightmare getting them to sign off the papers when they were scattered across the country and one was out of country. Can you do an episode explaining the pros and cons of adding people to your house deed? 2. Another suggestion is to explain about giving money to your kids so you can live with them. I know a couple who sold their home and gave the money to an adult child to add onto their property so the parents could live nearby. But they have no basis in the property, which is good for Medicaid planning, but also it appears to be a gift, and I think it could disqualify them from Medicaid assistance for 5 years after the last payment for construction costs. Can you discuss the best way to handle this kind of arrangement? I have some other friends whose parents have in mind they will sell their own house and put the money into a mother-in-law quarters on the child's house. Also the issue of what if they don't get along, and the parent wants to move out, but has no money left because they gave it all to the kids to add on to the house.
