Police can and do solicit trespasses from business owners to people. It is not illegal. It is absolutely morally wrong. However, they can ask a store owner if they want a certain person to be trespassed

The name under “complainant,” has to be someone who represents the property; it can’t be the name of the cop.

Hah one time I was wearing my AR glasses out while in the park, just kind of screwing around, seeing how they work outside in broad daylight, etc and next thing I know two beat cops are asking me questions for seemingly no reason. "What are you doing here, do you live in town, do you normally come to this park at 10am" that kind of thing. I reached up and clicked the button on my glasses to turn off the display so I could see them better, and they both froze in their tracks. One asked "Are you recording?" and I just played along and nodded (they don't have a camera.) They both immediately turned and walked away without saying another word.

Emmanuel wasn’t required to provide identification, as he wasn’t pulled over for a traffic violation, or crime. No citizen is required to assist in any investigation. As such, he wasn’t required to provide identification.

I don't think that the second encounter should have been included in this video. However, it teaches us some important lessons. 1) EVERYBODY makes mistakes. Even those who should know better. In my opinion, he did what most people do. He cooperated fully with the police officers because he knew that he was innocent. He basically accepted the officers' "guilty until proven innocent," by convincing them that he was innocent. This guy is a CIVIL RIGHTS attorney??? I think I have a migraine! 2) Police officers make ALL of their (initial) decisions based on racial/ethnic/sexual orientation/gender prejudice. It doesn't matter how successful or important you are. Everything that they did and said was based on that. The police officer's comment about Emmanuel's "slick" business card told us everything. In my opinion, it reeked of condescension and disrespect. 3) You should never (implicitly or expressly) waive ANY of your rights! This encounter should have lasted three minutes. "Get off of my property!" "Goodbye." Or as my Dad would say "have a blessed day in the Lord!" Then, Emmanuel should have walked (drove) away, remaining on the property. The officers (probably) would have moved on. This was a fishing expedition.

Emmanuel specifically said the only reason he provided his ID was because he didn't want the situation to escalate(aka him getting arrested/beaten/shot if he tried to walk away without providing ID). You're an idealistic FOOL saying dumb shit like "you should never waive any of your rights". Sure, if you want to willingly put yourself in dangerous situations that can end up with you getting abused or killed, keep your idealistic views and follow them to a T. That stuff sounds good on paper, but when you're actually put in a situation where waiving your rights can keep your life, a sane person will choose to do what Emmanuel did.

You should’ve run the rest of the lawyer clip. After the lawyer gets his ID back, the cops lecture him a bit more and then get in their car to leave. As they’re leaving they run his ID anyway with the information they wrote down. He had asked for the body camera and had the proof. Last I heard he had a lawsuit against the police, not sure what happened after.

If the police are trying to get you to confess to any crime, it means that they have no case against you and that they need your confession to wrap up there investigation. The first words out of your mouth when those detectives open that door is, can I have my lawyer please. Then, you just sit there silently.

It's not a lawful order but it looks like one because it's a cop asking it... I actually asked a state trooper to call in fish and game, because I was pretty sure humans weren’t in season and his fishing expedition was violating wildlife laws. His partner laughed, but it earned me an extra ticket. Luckily I beat it all in court.

@@stjeep , my bad, forgot I responded to someone else in this thread. Your right he’s not supposed to know my buddy, but I hate when people just claim a story is fake. I grew up in a heavily policed small town. I had more run ins with my local sheriffs then I could possibly remember. The same friend was also responsible for almost getting me arrested in another traffic stop, because I was going well over a 100 in a school zone and we had been drinking(I was young and stupid, I don’t condone my actions). He didn’t want me to stop and when I did he wanted to run. Long story short, I managed to keep him quiet and in the truck and it turned out to be one of the fastest stops in my life. From start to finish it was less then 5 mins and all that time was the cop writing out tickets and handing them to me and requesting I go straight home and don’t come back out until tomorrow. My ass was puckered for weeks after that close call.

I have an idea, but Im no expert. They are a police force obviously, and they definetly need to represent that. Maybe in their defined behaviour, they need to be associated as strong, social and so on. If some cop critique his partner in front of others it seems like they are not a coordinated unit, but rather a chaotic duo. If some people see this behaviour, they will lose even more faith in the police, even though the critique is definetly justified. So they pretend nothing weird happens, which is even weirder. A few reasons. 1. A untied front. Showing you are in anyway dissatisfied with the other police present opens the door for the alleged criminal present to try and drive a wedge between them in an attempt to make their case not stick or escape. 2. The Thin Blue Line. Loyalty above all else (even reason sometimes), to not support them is seen as a betrayal of that loyalty. 3. Your own life. See the Thin Blue Line, violate it and when it comes down to it the other cops might be a second too late rendering back up.. the second it took for an actual criminal to gun you down because you disagreed with them once, and it can almost never be proved.

I remember in my mid twenties I had just been released from county for failure to pay fines when I got home it was a beautiful day i showered, got cute and took a walk i was like 5 blocks from my house and was stopped by a cop claiming i fit the description of someone with warrants i told her I just got out of county and gave her my name and my probation officer name and the next thing you know im surrounded by police, thrown on the ground and placed in back of the cop car and not once did they check the information i gave them i never looked at them the same since

Look up the law for yourself, I know they vary from state to state, but it is very much illegal for police officials to solicit trespassing without the property owners explicit consent. And I didn’t pick this up from Facebook university or KZitem Law School. I’m currently a law clerk and that was after 15 years of clerking for the same judge in my county. I noticed the partnering officer is smart enough to not say anything to the citizen on camera. And I refuse to identify the ownership of a trash receptacle. That should be a staple of a city employees investigation.

I was pulled over for some BS reason, years ago. I'm not going into that story... They pulled me and my passage out of my car. The officer proceeded to ask me who owned the car; I told them I did. When I did that, I stopped and corrected myself. I told them I was in the process of buying the car, but the car was registered under my friend's mother's name. I gave them her full name, address, and home & work number, this was before cell phones. Keep in mind the reason they pulled me over was due to me missing a screw on my license plate (yes, I'm African American), They pulled me over for that BS and then arrested me for the position of a stolen car! I was booked and put in jail... My friend's mother was furious with the police, keep in mind my friend is an Italian-American and she lit into the police for detaining me for a bogus charge. She didn't understand why they would arrest me for a stolen car when the car was NEVER reported stolen, and the fact that I provided all of her contact information to the police. They towed my car and I didn't have enough money to get it back. I still had to pay for the car which I did, but my friend's family members had a little taste of what I had to deal with on the daily.

The first video with the officer saying it’s not registered to him but a female so it needs to be towed. Is like saying we need to call tow trucks on police vehicles because it’s not registered to them but the department. Second video, cops is making this harder more than it should he’s just using anything that comes to mind. They must’ve forgot they have his license and not check his address. Third video, he’s smart for asking a lawyer and how he played it out.
