Wow that's horrible losing majority of your rights to your beats is ridiculous i have a question I'm now getting into producing beats but I create my own original beats I want to use vocal samples is that just as problematic as sampling other artists instrumentals if you can answer my question I definitely would appreciate it thank you.

As far a sampling goes...How much is the difference between actually "sampling" the music and "duplicating" the music with a different instrument?

@@GOGETTAMUZIC2010 One is master license, the other is mechanical license for the composition. You have to properly clear licensing for both. It is always better to recreate, sampling is just way too complicated these days, and no matter how much people are claiming it is "art", it will never be as original as your own composition.

Absolutely right! I used to be a sample based producer until I learned this part of the business. After knowing this. I learned how to arrange and layer instruments. I do miss the obscure sounds I use to find with sampling, but now I’m on to something different and also fun. Plus original. Don’t have to be worried about clearing samples of other published and recorded work. ✊🏾

💯 As an individual who uses 100% samples from commercially released music you told zero lies! It absolutely makes sense to find alternatives to get your rightful share of your composition. It's just something about sampling commercially released music from vinyl that sonically is most appealing to me personally. But eventually I'm going to have to adapt for the business side to make sense! Salute for dropping gems! ✊🏾

thanks for sharing. It's wild how unfair the legality of samples is. I could be wrong but I think it's because it's mostly labels that own the music. I bet if artists owned more of their music (which should be the case regardless) then we would see more freedom with sampling. Charging $10k for a sample that hasn't made any money yet is ridiculous. If you sample a song, you should only have to pay a percentage of the money you make, in my opinion. And that percentage should be decided by the artist who created the sample.

it's crazy how many intricacies are involved in copyright laws ... I recently watched an interview with a well-known producer. He spoke on another producer regarding sampling.... apparently some producers just say FCK IT and just hope for the best ..... idk... I think that's kinda dope.

On Sting: I watched a video about Money for Nothing (Dire Straits) on which he sang and they used I think the melody for Don't Stand So Close To Me. In the video the guy said Sting hadn't wanted any royalties from Knopfler (they were friends) but his publisher refused that and fought to make sure he got a chunky share of royalties. Point being, afaik it's the publisher and/or master rights holders who make these demands.

Respect for this information DJ Pain, as an upcoming producer this is very helpful. It's better to create your own samples, but sometimes when you find something really nice on the internet and you reverse chop pitch, flip it up. It's sad to delete it just because it's not your own sample even if it doesn't sound like the original sample in any way, If I get sued or I don't receive any royalties because of sampled material I won't let that stop me from creating amazing music. Music should not be just for money or protection, most of all music is Art, Connection, Passion.

They usually take it all, in most cases, because the sample wasn't cleared before its release. If you negotiate it ahead of time (assuming they allow you to use it at all) you will usually, in most cases, come out with a better outcome. that's been my experience. I definitely feel you because i stopped using samples as well. It only took seeing -42k for sample licsensing on my first royalty statement to change my approach, and this was in the early 90s

I used a sample in a track for band and the owner of the sample said that if i wanted to use it i would have to give up 50% of royalties and they would also then 'own' the new song. The sample was integral to the song, the band didn't want to shelf it so we had to give up ownership of our own song using the sample, it was crazy.

Thanks for sharing your experience Would be cool to hear you talk about the different ways royalty splits work, or how to hold your back up when negotiating/pricing your beats to sell to labels (though I know this might be very subjective). I always listen to your stuff. Thanks for your input to the comminity. I started making beats using third party samples and I find making my own samples way more fun anyways! But if you make soul based beats it hits different digging into some old 70s soul records. The downsize is that it is hard to clear it.

Anything I sample, I am smart enough to no try to profit off of it. The worse that can happen with any of that is that they take it down or monetize it - big deal, I'd just remake it with original music and put it out as an original mix version. Now, anything that I want to push with my name seriously behind it, in hopes of someday profiting from, (from start) I would never sample, not even if trying to get it cleared (which wouldn't even be worth it, to me. First, my original work would kill anything that I could ever make from samples of other people's work, and two, if doing it on a serious level, why use other people's work to begin with? The only reason I even ever sampled anything to begin with is because it is a part of my upcoming in the culture from my starting days from the year 1987, where sampling was a huge thing - I honestly never had to, once I begin making my own music in 2001. I just put out a music album (with zero samples), and it sounds like the kind of work that people would look for to get samples from, but I Copyright all of my original work and have tracking services incorporated with them, so... It's really all pretty simple. Instead of sampling, just make all of your own shi

That's not why hiphop was created LOL. Hiphop came from block parties, looping breaks and later chopping into something else is ALL an extension of djing, and all came from 'happy accidents'. It was natural progression from highly creative observant people, it wasn't because they lacked creativity to make music.. they made hiphop. Don't act like the samples made hiphop, if you really believe that, you don't know hiphop.

@@DJPain1 Cause it seems like people have a problem with samples. And it’s like fuck something getting flagged or getting a sample cleared. It’s despairing hearing this as a up & coming producer. Nobody cared about a sampled getting cleared in the late 80’s early 90’s. It’s important to have the knowledge but music is so shitty nowadays cause business fucks up the art. Labels aren’t investing the money they used to invest into rap like before, rap is on a decline. We never followed rules in this game. Your saying you won’t get any money for samples beats if you don’t do your due diligence on copyrights. But your focused on the logistic side of music, which black/ hip hop artist never cared about any of that. There’s ways to get around samples getting cleared and publishing. We’ve literally been finessing this system for years & getting away with it. Idk I’m just frustrated with the modern ideas/ rules of music. It’s stunted growth cause of this type of thinking. Quality content. EDM producers like pretty lights started hiring bands to make their own samples too. It's too bad that even if we aren't in a position to make money off our beats at the moment, we're still technically at risk of legal disputes over "copies" made. 🙄 some of us just want to make music. This is why I like being able to make my own samples on multiple instruments.

They get real stupid, as especially do the so called “.creators” I’d be just fine with if one day if music, movies, sports, television, and especially the internet… if one day it were abolished, made illegal, or just disappeared Then everyone would have to get actual jobs and there would be no more of this self-righteousness intellectual property dispute nonsense

I’d love to hear your take on tracklib. I think it’s an amazing service. I’d like to see a lot more of certain styles of music on it but i think any producer could say that about any source including their own record collection.
