It can. You just need the balls to use the second amendment for what it was made for. Under 18 USC 242 it’s a crime for a cop to steal your stuff like this. In states with citizens arrest laws YOU can legally arrest cops for doing this. In some states you can legally KILL THE COP in self defense while arresting them.

More than that, those damages need to come out of law enforcement pension and Union funds. If the tax payer's paying for misconduct there's no consequences, a million dollar hole in County's pension fund will put a lot of pressure on whichever Officer/Agency stole the money in the first place.

Seriously, CAF should be prima facia unconstitutional. Money is not a person. It is Property, and cannot, constitutionally, be taken from a citizen without due process or compensation. It also cannot be a defendant. It cannot testify as a witness. It cannot be "Guilty" of anything. It cannot commit a crime. Someone needs to take this to the supreme court, and not let them get away with dismissing it as "A local matter" Money is the same, regardless of what state it is in.

I understand how money can be crime-related money and thus becomes evidence. The part that's BLATANTLY wrong is the shift of burden of proof to the one whose assets were seized. The one making the accusation that the money is dirty logically would have to be the one required to prove their claim. The system is operating in violation of that.

The last time the SCOTUS heard CAF argued before it was 2020 in Indiana v. Timbs. However, the argument used was excessive fines. Justice Thomas St that time said he would like to see one that is sued based on fuel process. This has not happened because when the jurisdiction sees it is headed that way they give the money back. How much are you willing to spend to get back s few thousand dollars? To get to the SCOTUS it will cost you about $250,000.

Since the police used Civil AF instead of Criminal AF, I suspect they knew they were likely to lose the case against the boyfriend. Which makes his arrest questionable too. Not all process servers tell the truth either. I had a default judgement against me started when the process server swore that he served me personally! He even gave a description of me, (that he got from my DL info)! I happened to be working in the completely opposite end of the state at the time he supposedly served me. He served my boss who was twice my weight, shorter, and had different hair. When I got back at the end of the week and got the document, I had less than 5 days to get a lawyer and respond. I filled a notice of improper service and the judge gave them summary judgement because they swore again that they served me personally. I contacted the lawyer, told him that I had proof of where I was at the time he supposedly served me and he would be in contempt if he didn't rescind his statement and reject the judgment.

There shouldn't be a judge deciding whether she can sue. It should be automatic as per our Constitution and Due process. She's not even charged with a crime so the police have NO RIGHT to hold her money. In fact, the PD shouldn't need to wait for a lawsuit to return the woman's cash. This sh*t has gone on long enough. That's always been one of the biggest problems, regardless of the subject matter or level of government. They have unlimited funds, and they know you don't. On the lowest step, that works out as them knowing it's easier for you to pay that just barely affordable fine, than to pay an attorney and actually fight it, even if the charges are total crap. The problem only gets bigger and more problematic as you go up the ranks of government.

I have said this many times: If you smear responsibility thinly enough, pretty soon nobody will be responsible for anything. That's how the police and these government attorneys manage to make used car dealers look quite ethical by comparison. But the big issue is this: The person of interest, the Boyfriend, was NOT GUILTY. So anything the police seized, particularly the money, should have been returned to the rightful owners. I don't know how these idiots can say the money is guilty when there was no basis for seizing it in the first place.

Imagine how often this happened without recourse before social media. People are long in their graves never having recovered from their stolen money. The police office doorknobs it paid for long already removed and thrown in a junk box.

I would never rely on FedEx's delivery practices. A package was shipped to me that required both ID and Signature. My wife was at home, when she went outside she saw the box on the steps outside. When I checked the delivery information, the driver indicated that I (my first and last name) provided both ID and signed for the package.

I recently ordered three of the same item that was shipped via FedEx in three separate boxes (due to weight of each item). Packages 2 of 3 and 3 of 3 arrived in two days; package 1 of 3 took a whole week. All shipped from a single address and delivered to a single (different) address. The funniest part comes when I checked the tracking info: shipped from NJ to PA. The package that was delayed went to KS first …

After the covid thing, i sent 34 network devices via fedex to business locations. 5 were marked delivered, but never received. Had to repurchase and reship .

@@stevebabiak6997 There is a video of the inner workings... and they have manual steps which could easily be automated... but they don't want to spend the money to do it... and that step is manually keying the destination... and no way to undo a mistake... so they type wrong, the parcel goes elsewhere... and then when there is turned around and goes to the right place (hopefully)

What is ridiculous is that we allow thugs in government to seize property without a court order. They should have to go to court and prove by Preponderance of the Evidence that the property is the result of illegal activity. The second thing that is ridiculous is that we allow these thugs to keep the property in their coffers instead of having to turn it over to a general fund that does not directly impact them. It is amazing what we have allowed our government to become.

The idea that money is the defendant is how a bad legal fiction can corrupt the court system. Even though it's a civil action, the money should automatically get a lawyer since it can't speak for itself.

It is obscene that law and justice are this complex. One must have the money to hire a team of great attorneys to get "justice". A "right" to a speedy trial should include a 'simple-as'-possible' clause. Complexity works in the government's favor.

Something everyone needs to keep in mind: Courts are Expensive. Someone within the government is spending tens of thousands, easily at this point, to acquire $8,000 in extremely risky money. I highly suspect the individuals behind this have been told by those above to ensure the process is as hard as possible. It isn't about the money being seized, they will do this over a few hundreds, but how they go about the fight... and how much it cost and/or pain it causes everyone. The system wants that pain and doesn't care how much it costs taxpayers.

This is why the founding fathers were so focused in on such tyranny. Even in a country where this is practically spelled out in the constitution, you still have people in the government who can justify downright theft, and continue to actively defend it. If this had not slipped by the founders, they would have explicitly stated it. They actually did, but worms were able to slither around it.

Its good they are fighting these cases one at a time to get enough case law on the books, to make it easier for people to fight the government, to get their assets back. I'm wondering how long this is going to go on. Perhaps its going to take the supreme court to finally get it done. if a case finally makes it that far. How can something so unlawful continue to happen is unbelievable.

Goons with guns and badges. All these judges who side with the thieves, need to be named and shamed. Also they run the risk of a _citizens civil forfeiture._ After all, they're part of a criminal gang and take their cut of the loot. We're not targeting them, we're targeting the money. I'm sure they'll understand.

Something I've been wondering about lately is, could a victim of civil asset forfeiture ask the court for "just compensation" under the Takings Clause? The idea being okay, the government has seized the cash for the "public good" of prosecuting an alleged crime against it... okay, so you can have that cash but give me an equivalent amount of "clean" cash as compensation. The logic makes sense in my head, anyways 😂

The money should be innocent until proven guilty by the government. The money should have all rights to not incriminate itself. And it should be held to the guilty beyond a reasonable doubt to be convicted. Proving innocents can be similar to trying to prove a negative and therefore should not be the standard. Of course that is all nonsense. Lets do away with civil asset forfeiture and the ridiculous legal theories that were used to create it.

Ugh, even though the outcome was correct that whole headache just to get a hearing makes me hate the whole system. We dealt with much the same from the USCIS on my wife's case, where they claimed they sent a notice we never received, but despite their website never updating the case they forced us to refile and it cost us week north of $6k. The way the government hold people responsible for the government's mistakes is purely tyranical.

Civil asset forfeiture is tyranny, our and simple. We should have laws that allow seizing of assets which are the fruits of convicted crimes, aka criminal forfeiture, but this is completely nuts as it is now.
