A lot of times you hear lawyers talk about feeling like their client or even their defense is being targeted and sometimes it's hard to tell how genuine that is but I think in this case it is actually true. Going after an attorney for medication they're prescribed seems at worst reaching for something and at best incredibly negligent (and honestly that doesn't seem too likely).

compare and contrast what level of evidence it takes to arrest a private citizen vs a cop. For you and me all they need is a cop accusing you of a crime to immediately arrest you. For cops even when caught on camera it takes an 18 month investigation even when everything is clearly caught on camera.

This upcoming trial will take months, but all those who pled not guilty will ultimately be found guilty in the end. The minimum sentencing guidelines explained to them prior to electing to take a not guilty plea are pretty harsh… Huge gamble for those electing to go to trial, especially with he plea deals reached with some of the defendants involved who will have to testify against their co-conspirators.

@goaliereids3523

@@williewoods5595 I promise you that defense counsel will have a monumental task to say the least in defending their clients against Georgia's RICO Act and all charges against them in the indictment. Georgia's state statute requires a lesser threshold in order to prove a RICO Act violation than the federal statute. I do believe that the state will not have an issue proving this in court beyond a reasonable doubt in order to convince 12 people they are all guilty based upon evidence presented. I'm not even factoring in the other defendant's testimony which will be heard as part of their plea deals. This testimony will be extremely damning to defense counsel and hard to disprove as these individuals were directly involved in the illegal activity and/or had first hand knowledge of what was occurring over the past couple of years.

Georgia's Controlled Substances Act looks a lot like those in most states. The "original container" laws used to be very common. Ohio repealed its law over a decade ago, and I wonder if Georgia did too, unknown to the officers who made the arrest. It was actually law enforcement and regulators who pushed to repeal the Ohio law, because it gave drug dealers an excuse to carry around large quantities of drugs, and forced innocent patients to do likewise.

I think it may have changed since 2020. ??? § 16-13-75. @@Sweetyhide Good research! So it has to be in the original container unless the person is one of those named in 16-13-35 or 16-13-72. 16-13-35(c)(3) lists "An ultimate user or a person in possession of any controlled substance pursuant to a lawful order of a practitioner or in lawful possession of a Schedule V substance". Attorney Manettas was exempted from the original container law, since he was that ultimate user. Assuming of course that he obtained the drugs pursuant to the lawful order of a practitioner. The law was simply misapplied to him.

@@vmackey11 I don't know what your source is, but it seems unlikely. My state borders Canada and we changed our law quite a while back. I'm not sure what your source is, but when I still worked in this area, the trend was for states to eliminate these laws. They were enacted in an era when the container allowed LE to gain easy assurance the drugs were legal, but as states passed prescription monitoring laws the old laws were no longer needed and became counterproductive. If the trend has stopped, it's a real shame.

I'll tell you why, so if he got lucky sneaking them to his client, his name isn't all over them and with all the issues surrounding drugs in this case why on earth wouldn't he be more careful?
