I have worked in HR and payroll for over ten years. It is ABSOLUTELY NOT the employees responsibility to ensure they are paid correctly. It is good practice to review your pay because mistakes happen in payroll but if a mistake happens it is on the company to correct it. Offer letters are considered binding and if she has one that states $22 an hour she should get back payed for everything she is owed. The employer is filing her tax documents and should have caught it. I get many small businesses like these don’t have experienced finance professionals but it’s not an excuse. People bringing up why she didn’t bring up pay before or any of these things also fail to account for the power dynamics at play. It’s often hard for employees especially in smaller business to challenge their employers on pay when they are afraid of retaliation. Even though retaliation is the #1 reason companies get sued for discrimination/harassment because it’s very easy to win those cases. It’s much harder to prove an employer is being abusive or discriminatory without documentation. But you can prove retaliation. My point is, she can fight this and win.

I work for a small/middle-sized company and I always check my pay because things happen a lot. At one point I noticed that about $70 had been subtracted instead of added to my pay, and I went to HR to tell them. They agreed that it was a mistake, that shouldn't even be possible, and she would correct it. But since then it's been months and I haven't got that money back or the original $70 I should have been paid...
@joelman1989
7 ай бұрын
@@CainXVII i did mention it but to be clear I do recommend always checking your pay for that reason. Things do happen. There are HRIS systems that should prevent a lot of errors but they’re only as good as the information that gets put into them and without people trained to be very detail oriented and know what to look for it’s not uncommon for errors like that to happen. That’s pretty annoying though that you still haven’t gotten your money. We all make mistakes. But when I make a mistake that results in an error on a check I (and my coworkers) treat it as an emergency. I’ve even added money to checks to cover for late fees etc. Because I hate the idea of someone missing out on money because of my mistake. My first supervisor was honestly a Nazi about this stuff. She would freak out over the tiniest error and I resented her for years. Then I went to a company that was incredibly mismanaged and I realized how grateful I was that she drilled perfection into me. I immediately encountered tons of errors in the system and worked for weeks to correct everything. Set up processes to prevent future errors. My point is that there is a best practice that should be followed but unfortunately it isn’t always followed. Still, it’s ok the employer to correct issues promptly.

@@frickfrack7075 Not exactly. Burden of proof as I understand it is a principle in how the evidence is judged at the end of the trial. That's different from the beginning of the trial, which has a process called "discovery" where both sides have to gather their evidence, which can include search warrants and subpoenas if the judge agrees they're necessary. They're supposed to enter all of this into evidence and share it with each other before the trial begins. It can get SUPER messy. If you're suing someone who fired you because you were late, they can demand you turn over every email and text message in your possession that mentions you, your job, your boss, and lateness, to see if you WERE punctual or not. @@Tayl0r_ I agree with what that other commenter said. My uncle's a retired tattoo artist, he was one for almost 40 years and he said two very important things when it comes to a tattoo is a shop you trust, and an artist you trust. Always look around and find the perfect fit, and start off with a small tattoo and begin building a custom/artist relationship. Small pieces allow you to judge how the artist handles finer details and how gentle/heavy handed they might tattoo. You always wanna make sure you can sit through a tattoo of any length and it's important to make sure you find an artist that listens to you even for a small tattoo. Because trust me, a big tattoo is gonna require some breaks, from both you and the artist. I plan to get a custom tattoo made in a year when I can save up the money for it, and the artist is more than happy to wait until I have all the parts of this tattoo ready to begin designing. There was an artist in my town that was sexually assaulting people for years during appointments, and the cops turned a blind eye to it because of lack of evidence. He made the mistake of telling people he was related to a famous musician, and when said musician looked into it and saw what his name was being used for, he contacted the state attorney's office. I didn't realize he also didn't pay his workers until he constantly wouldn't pay his subcontractors and vendors and then he eventually withheld my check when I quit. I reported him to the Colorado labor board because he did the same thing to the previous admin I learned but nobody cares lol they use it as a control and manipulation tactic because they have done it before and had nothing happen because they think thryre above it all because they DON'T have consequences.

Why don't more people shop around and do research before getting their tattoo? I went to 5 different parlors and through at least a dozen artist books before choosing my artist for my first tattoo. And then I went to check his reviews to make sure. Hearing these horror stories just has me asking more questions

Agreed. I knew from a young age I was gonna get tattoos, they're cool, I'm artsy and my parents have tattoos and I just always loved them. So I looked for practically a year and then got my first tattoo on my 18th birthday, at a shop my dad had also gotten a tattoo at, by the same artist, with my own money, and both my parents were there to watch me 😂😂😂. It sounds so cheesy but it was a really special day for me and is honestly something I'll remember for the rest of my life. What's funny is my uncle is a retired tattoo artist and before I ever got any tattoos he told me to find an artist I trust to do it, and he wound up being the one to do most of my tattoos when I was 22 😅.

He owes her the pay rate they agreed upon. This happened to me. i realized the manager at this small store I worked at was calculating the hours incorrectly (she was rounding at 100 minutes...instead of 60...). I had to go back through months of pay stubs and hand written hour notes to recalculate everything. Ultimately it was only like $300 but they still had to pay myself and the two other employees ($200 for one maybe $60 for another) everything we were owed.

As someone who has a lot of tattoos, I absolutely cannot emphasize enough to *Do your research* before you get any tattoos from anyone. I spent literal years looking for someone to do a tattoo of a persons face on me. That being said, I have a funny tattoo mess up that has happened to me. I have the music of my wedding song tattooed on my arm (I have the treble notes and my husband has the bass) and half of the notes are upside down because neither me or the artist noticed during the stencil & tattoo process. It was almost a year before I noticed, and by then, we both just laughed about it. 😂

I looked into it and told the manager about and the mfer laughed and asked what took me so long to notice. Dude was tryna play it off like it wasn't serious, but I ended up getting that back pay. 3:22 The problem is mostly employers DO get away with underpaying employees. It's the single most costly property crime in the US, wage theft. If you want to get paid and your employer doesn't want to pay, you can't go to the police. You have to go to the NLRB or state employment agencies, you can get a lawyer if you can afford one but otherwise you can report the employer and wait. Most people just give up. If you live in America, say thanks to the Republicans who have continually underfunded the NLRB because they, the Republican Party supports the company over the worker. This is what they meant when they run their campaigns on 'Deregulation' for the last 40 years.

As someone who has worked in managerial/HR positions for over 20 years, it is 100% the employers responsibility to pay their employees appropriately and to provide back pay for any mis paid time. In the US, Federal labor laws are clear on this. She could have waited years to report the difference and he would still need to make it right.

This made me realize that I got a really good deal on my last tattoo (wings that cover a large portion of my back, in black with lots of shading to make each individual feather stand out, all done in a single session that took about 6 hours, and cost less than $500, including the original art work and a promise to not do the same piece on anyone else so mine remains unique).

Former resident of WA for over 25 years, with business ownership experience, and my wife was an HR director in the state. Her responsibility is to make sure she's getting paid the correct rate, however, her responsibility ends the moment she notifies her employer. That could be after 1 day, or 1 year, and it would still be the employers problem. One of the first things my wife and I do when we begin working for companies is check contracts, and ensure they're being upheld. One time she had to retroactively pay an employee five years of backpay. Oh boy was he happy, and the company was happy to have caught it. As far as the defamation, the manager only has a case if he can prove the methods she used to obtain the information was through unprivledge communication. Washington is NOT a one party state, and regardless of truths, if shared information was obtained illegally that opens an individual up to Tort.

In Washington live here, work here in the field of pay. If her contract says $22 that is what she would be paid. And any hours she was not paid that should be corrected ASAP. If not then you need to call labor and industry and file a complaint ASAP. First, request in writing. All labor boards will always ask if you reached out to the company first before they do. So reach out and give them a chance to respond in writing

I didnt notice until i looked more closely at my pay stubs because usually id just look at my take gome pay, that i was still getting student wage after two-ish months. I brought it up to my manager, the general manager, and then the lady that handles paychecks. Lady that did paychecks apologized and said she thought she had my birthday marked to change my pay but much have forgotten so she changed it to the right rate and gave me "back pay". So the differenece between would i should have gotten to what i did get was given to me on my next paycheck.

Markie, Regarding your question "do they think they'll get away with it forever?" the answer is - No, but they'll profit more than they lose in the long run. Take botting in a video game. You have the cost of the game, cost of the bot and cost of running the computer while you are botting. If your bot can produce more income for you than it cost to run before it gets caught then its worth it. The exact same principle applies to scammers. Overall they make a net positive and the consequences do not outweigh the net gains. It's sad and the best defence is personal knowledge so you don't become ignorant to their tactics.

In a previous job, I met a guy who was trying to save his business. One of his employees got tired of not getting paid properly and turned the employer in. I can’t remember which government department it was, maybe Department of Employment. They came in and seized all the payroll records and other pertinent employment records. The biggest thing they got the employer on was tax evasion. Under-paying his employees robbed the government of the employee taxes. So he ended up owing back taxes, interest and penalties, fines, and back wages (unpaid wages). He owed hundreds of thousands of dollars. Needless to say, he lost his business. Don’t know if any of the employees got the money owed them because typically the government agency gets their money first.

As far as the getting shorted on wages, I don't have personal experience but my dad told me a story when he was first starting his job as a carpenter and joined the carpenters union. He found out about 3 months into his new job he was being shorted $1.75 (which was worth more in that time) and he went to the union to get help because he said that's what the union is for. They told him that there was nothing they could do because he didn't notice within the first month. My dad, very upset, went to his boss and explained the situation. His boss didn't know about it and fixed the mistake and payed him missing wages. Basically, I think unions are supposed to help with missing wages like that but they don't always

I had a similar situation on a much smaller scale. I had a tattoo appointment that was made before the pandemic, so when they were closed down everyone was just kind of waiting around, not knowing when they'd be able to reopen. Perfectly understandable, I waited until a couple weeks after shops could reopen and called to find out about rescheduling. I was given the run-around and kept getting fobbed off. After about 2 months of this, I called once again and he didn't even remember my name or what I wanted. He very sarcastically said "I've been a little busy trying not to lose my business." My response was that I was a customer willing to support his business by giving him money and good word of mouth if he would ever do the tattoo. It wasn't thousands of dollars so I guess my project was small potatoes to him. I've never tried so hard to give someone money only to get this treatment!

Tattoo drama is a long old history, there was even that SA situation a few years ago where people were finally coming out about how they were either attacked by their artist, in the shop or that their artist had SA'd other ppl n people having to decide whether or not to get cover ups for them or keep them and disconnect it from the artist. There was even a movement of other artists being willing to cover up those pieces for free. This all happened on insta (at least IDK if other platforms) a few years back.
